SUBJECT: Consider Resolution Updating Solid Waste Collection Fees
Discussion
This item, if approved, would make the annual adjustment to solid waste collection fees as
specified in the Franchise Agreements between the City and the refuse haulers. The City
reviews and updates its solid waste collection fees annually. Approved rate adjustments
take effect January 1.
There are two components used in considering an increase in rates: the Consumer Price
Index (CPI) and the Simi Valley Landfill tipping fees. Per the City's Franchise Agreements,
the CPI factor used in the City's annual solid waste fee calculation is based on 86% of the
CPI increase for all consumers in the Los Angeles Urbanized Area during the period
September- September, less housing. The CPI factor for 2007 is 1.66 %. The second
component in the fee update is the landfill tipping fee. The County approved a landfill rate
increase effective January 1, 2007. The disposal fee for discards will go up $1.58 per ton to
$44.95, and the yard trimmings discards will go up $0.67 per ton to $32.38. The two
components combined (CPI and landfill tipping fee) per the Franchise Agreements, results
in a $0.57 (2.41 %) increase to the residential rate. Attachment "B" shows the calculation.
Based on the CPI, landfill rate, and Franchise adjustments, the City's regular residential
solid waste collection rate will increase $0.57 per month, to $24.23, representing a 2.41 %
increase. The senior citizen and super recycler rates will increase $0.38 per month to
$18.06 per month.

Commercial rates will increase about 2.06% depending on the weight capacity that is
factored into the rate structure for the various commercial service levels.
In addition to the consideration of the annual solid waste collection rate, staff is requesting
that the Council consider establishing several new service fees. Some of the proposed fees
are for new services and some for activities that currently take place. These fees are
consistent with service fees charged by other jurisdictions.
Credit Card Payment Convenience Fee (By Phone): $5.00
The fee is meant only for customers who want to pay by credit card over the phone.
It is meant to encourage customers to pay their bill using other available options
since this method is more labor intensive. All other payment options will remain free,
which include paying online by credit card or directly through a customer's bank
account, paying by check, or paying by cash if the customer wants to go into G.I.
Industries or Moorpark Rubbish Disposal to pay. No customers will be "forced" to
pay this fee, since there are a number of free payment options available. If
approved, both G.I. Industries and Moorpark Rubbish Disposal will implement the
convenience fee.
Extra Bag Pick up: $3.00/bagor$5.00 %art
The current "Schedule of Rates" does not allow for residents who may have one or
two additional bags of trash or recyclables to be collected by the solid waste hauler.
The new fee would permit residents to receive extra bag pick up on their regular
trash day by calling ahead of time to request the pick up. The fee helps to cover
hauler staff time used to exit the vehicle and refill the cart with the remaining bags,
as well as the disposal cost of the material.
Extra Collection on Non - Scheduled Pick up Day: $25.00
For those residents who have extra trash to be picked up and cannot wait for their
regular trash day, residents would now be able to request a special pick up. This
would be useful to residents who may have had a large gathering at their house and
have an excessive number of trash bags from food waste, disposable plates, etc.
Residential Cart Re- delivery Fee: $15.00
This fee is intended for those residents who have had their solid waste carts
removed by the waste hauler because they have not paid for trash service.
Currently, if a resident has his /her carts pulled for non - payment, the hauler must re-
deliver the carts for free when they re- establish service (by paying off their debt).
The only other penalty is a $5.00 /month late payment charge that the resident was
charged for not paying the bill on time. The new $15.00 charge is meant to act as a
deterrent against residents not paying their solid waste bill.

Temporary Roll -off Extra Day Fee (Post 7 days, trash only): $10.00 /day
This fee is meant to reduce the number of customers who request the delivery of a
roll -off, only to let it sit on the property for weeks before having it collected by the
solid waste hauler. This runs the risk of leaving the waste hauler with no roll -offs for
additional customers. This new fee would be applicable to roll -offs used for trash
service, not recyclable materials or roll -off compactor rates (both trash and
recyclables).
Temporary 3 Cubic Yard Bin Rate (Post 7 days, trash only): $5.00 /day
This fee is similar to the roll -off extra day fee listed above. As with the roll -off fee,
this per -day charge would not be applicable to recyclable materials.
Permanent Customer Roll -off Extra Day Fee (Post 30 days, trash only):
$10.00 /day
This fee is similar to the temporary roll -off and 3 cubic yard bin fees listed above,
however, it is intended for more permanent customers, such as a large construction
operation or other extended stay projects where roll -offs are necessary due to the
large solid waste stream. This fee would not be applicable to roll -offs or compactors
used for recycling purposes.
Solid Waste Bin Locking /Unlocking Fee: $20.00 /month
This fee would be applicable to commercial accounts that have a lock on their solid
waste bin that the solid waste hauler must unlock before emptying the bin and then
relock when returning the bin to its solid waste enclosure. This fee would only be
applicable to those commercial accounts where the business does not want to
unlock the bin on its own and then relock the bin after the bin has been emptied.
This fee is meant to reduce the number of keys and lock codes that the driver
carries with him /her and will reduce the amount of time that the driver must spend at
each address.
All of the proposed new fees fall within the definition of Gross Revenue as defined in the
Franchise Agreements and are subject to the City's Franchise Fee. Staff will return to the
Council with a proposed process fee and amendment to the Franchise Agreements to
address illegal roll -offs, at a future Council meeting.
The residential and commercial rate adjustments are calculated in accordance with the
Franchise Agreements. The new rates would become effective January 1, 2007.
Attachment "A" is the rate resolution and proposed rate sheet. Attachment "B" is a rate
calculation worksheet showing the 2007 proposed solid waste collection rates in relation to
the existing rates.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, UPDATING THE SOLID WASTE
COLLECTION SERVICE FEE SCHEDULE AND RESCINDING
RESOLUTION NO. 2005 -2414
WHEREAS, the City provides residential and commercial solid waste and
recycling collection services; and
WHEREAS, on September 18, 2002, the City Council granted exclusive
franchise agreements with G.I. Industries and Moorpark Rubbish Disposal for the
collection, transportation, recycling, and disposal of solid waste in residential and
commercial — industrial areas within City limits; and,
WHEREAS, the Franchise Agreements provide for adjustments to the service fee
schedule pursuant to a specified formula; and
WHEREAS, the City Council declares its intention of maintaining reasonable
rates for collection, management, and disposal of solid waste and recyclables within the
City limits.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. Effective January 1, 2007, the monthly residential solid waste,
recycling, and greenwaste collection rate shall be as shown in Exhibit 1 ".
SECTION 2. Effective January 1, 2007, the commercial, industrial, and multi-
family solid waste, recycling, and composting bin collection rates shall be as shown in
Exhibit 1 ".
SECTION 3. Effective January 1, 2007, the temporary bins and roll- off /drop box
rates for solid waste, recycling, and composting bin services shall be as shown in
Exhibit 1 ".
SECTION 4. Effective January 1, 2007, the annual Solid Waste Management
Fee for exemption to the required solid waste collection service shall be $24.40.
SECTION 5. The City's Residential Franchise Agreements Service Fee
Schedules (Exhibit "F" of Residential Franchise Agreements) are hereby replaced with
the attached Service Fee Schedule upon the effective date of this resolution.

SECTION 6. The City's Commercial Franchise Agreements Service Fee
Schedules (Exhibit "F" of the Commercial Franchise Agreements) are hereby replaced
with the attached Service Fee Schedule upon the effective date of this resolution.
SECTION 7. This resolution shall be effective January 1, 2007.
SECTION 8. This Resolution hereby rescinds Resolution 2005 -2414 in its
entirety upon the effective date of this resolution.
SECTION 9. The City Clerk shall certify to the adoption of the resolution and
shall cause a certified resolution to be filed in the book of original Resolutions.
