Consider Art in Public Places Obligation for Village at
Moorpark Shopping Center and the Grove Shopping Center
DISCUSSION
The City's Public Art Advisory Committee comprised of Council members Clint
Harper and Janice Parvin, Parks and Recreation Commissioner Sandra
Thompson, and public members Dennis Swinburn and Jennifer Varnell (Ms.
Varnell was absent) met on November 1 to consider the art in public places
obligation for Village at Moorpark Shopping Center and the Grove Shopping
Center. This Agenda Report represents the Committee's recommendation.
As a condition of approval for Commercial Planned Development Permit, CPD
2004 -01, Village at Moorpark Shopping Center and Commercial Planned
Development Permit, CPD 2004 -02, Grove Shopping Center each project is
required to prepare and install a public art project on -site, or with City approval,
pay a fee in lieu of an art project. The approved art projects must be completed,
or fee paid, prior to the issuance of the first building occupancy.
The Village at Moorpark Shopping Center project falls under the City's Art in
Public Places Ordinance 321 and Resolution No. 2005 -2408, which sets the
value of the art obligation at one percent (1%) of the total building valuation for
the development, excluding land value and off -site improvement costs. The
Grove Shopping Center project was approved prior to the approval of the Art in
Public Places Ordinance and was conditioned under the City's previous policy,
which set value of the art obligation at $.10 per square foot of building space.
Each of the two developers proposed the installation of fountains as their art
obligation. Ordinance 321 allows for fountains at the City's discretion. However,
every shopping center developer to date has requested the installation of a

fountain to satisfy its public art obligation and the Council has expressed the
desire to see art projects other than fountains. While fountains in shopping
centers are desirable, in staff's opinion the City's public art needs in such
projects is more appropriately met by providing freestanding sculptures. In
recognition of the attractiveness and quality of the fountains proposed by both
developers, staff and the Advisory Committee recommend that the Council
accept the fountains as fulfilling a substantial portion of their art obligation. Staff
and the Advisory Committee recommend that the remaining obligation be fulfilled
with a freestanding sculpture.
Village at Moorpark Shopping Center
Based on the City's current policy, the Village at Moorpark Shopping Center art
obligation is valued at $63,199. The developer must either design and install an
art piece approved by the City with a value of $63,199 or pay an in lieu of the
same amount. The developer plans to construct two fountains to serve as
attractive gathering places at the center (see attachments Al & A2) at an
estimated cost of $316,000. Additionally, the developer has agreed to install a
freestanding sculpture valued around $10,000. It is proposed that the final
placement and design of the sculpture be approved by the Parks, Recreation and
Community Services Director and the Community Development Director. The
Advisory Committee supports this recommendation.
Grove Shopping Center
The Grove Shopping Center falls under the City's previous Art in Public Places
policy, which sets its art obligation at $1,835. Under the City's Ordinance 321, the
developer's art obligation would be $14,202.
Like the Village at Moorpark, the Grove Shopping Center will include two
fountains (see Attachments B1 & B2). The fountains are described as one -of -a-
kind antique limestone water sculptures from France. The reported cost of the
fountains is in excess of $50,000. At the Advisory Committee request, the
developer has agreed to include a freestanding stone sculpture on the project
site. Again, it is proposed that the two directors be authorized to approve the
sculpture and its placement. The Advisory Committee supports this
recommendation.
STAFF RECOMMENDATION
Approve the recommendation of the Public Art Advisory Committee as outlined in
the Agenda Report.
