SUBJECT: Progress Report — Time Warner Cable Television
BACKGROUND:
Time Warner has completed the transition and taken over all aspects of the Cable TV
Franchise and operating system in Moorpark. Staff has received confirmation that Time
Warner has notified Bank of New York (BNY) in writing that the purchase of Adelphia's
assets has in fact taken place. Therefore the new Irrevocable Letter of Credit from Time
Warner to secure customer service performance based on the franchise agreement has
been accepted.
The City has received numerous calls from subscribers about channel realignment and
discontinued channels. Very few calls have been received about rate changes. A
number of popular channels like Animal Planet and the Travel Channel have been
moved from the Basic Cable Lineup (now called Broadcast Basic) to the Digital Tiers.
These changes are a result of programming negotiations between the programmers and
Time Warner.. Many cable customers electing to move to the new TW digital packages
may actually see reduced monthly fees. This has produced a few calls. There have also
been a few calls about the High -speed Internet service referred to as High Speed On-
Line (HSO) and the conversion from "Adelphia.net" to "Roadrunner. net" as an e-mail
address for those affected subscribers. The HSO migration will begin on December 4m
Concerning the October 9 letter from Time Warner about the possible loss of two Fox
Network Channels (KTTV — 11 and KCOP- 13), Patricia Fregoso -Cox,
Community Affairs Vice President for our North Division, reports that two contract
extensions have been made. The original letter was sent because, at the time they did
not have signed contracts for these channels and the current contracts were due to
expire in less than 30 days. FCC Regulations require that anytime there is less than a
30 day window between expiration and renewal commitments the company must notify
franchising agencies. Time Warner feels very sure that they will be able to secure
agreements with Fox before the expiration of the extension agreements and that there
will be no interruption in service for these channels.
