CITY OF MOORPARK

SUBJECT: Reconsider Bids for the Construction of Block Walls Along
the Rear of Properties Located on Sherman Avenue [North
Side of Los Angeles Ave East of Spring Rd]
BACKGROUND
On January 20, 1993, the City Council appropriated funds, approved
the design and authorized advertisement for receipt of bids for the
subject project. At the Council's request, bids were received and
opened for both block and prefabricated wall on 2/22/93. The City
Council reviewed the bids at the meeting of March 3, 1991 (March 3
staff report attached) and approved the award of the contract to
DWM Construction for a prefabricated wall with a grapestake finish.
The approval was subject to review and approval by the City Council
Public Works, Facilities and Solid Waste Committee of the
specifications for the prefabricated wall, as outlined in the bid
documents.
DISCUSSION
A. Unqualified Sub
As stipulated in the contract documents, DWM submitted
specifications from their prefabricated wall supplier, Designer
Concrete Products, on March 4, 1993. Upon review of these
specifications, field review of samples, and conversations with
CalTrans and Designer Concrete Products themselves, it was
determined that the supplier could neither meet CalTrans
specifications or fabricate a grapestake or slumpstone finish,
as required in the bid documents. For this reason it is
necessary for the City Council to reconsider their action of
March 3, 1993.
B. Substitution
DWM has submitted two letters (attached) on March 8th and 9th,
stating that due to their listed subcontractor's inability to
provide a product, as requested in the bid documents, and the
fact that they could not provide such a product for the
submitted bid price, that they be allowed to withdraw their bid
for a prefabricated grapestake wall. DWM stated, however, that

if they are allowed to change subcontractors, they could meet
the bid specifications and hold their bid price for a
prefabricated slumpstone wall. Section 4107 (7) of the Public
Contracts Code of the State of California states that a prime
contractor may substitute subcontractors "... when the awarding
authority ... determines that the work performed by the listed
subcontractor is substantially unsatisfactory and not in
substantial accordance with the plans and specifications...."
Should the City Council elect to award a contract for Alternate
IB (Prefabricated Slumpstone) it is recommended that the City
Council approve this substitution.
C. Options
It is recommended that the City Council select one of the
following options:
1. Alt I -A: Pre -fab Grapestake Wall: Approve the request from
DWM to withdraw their bid for Alternate IA and award a
contract to the lowest responsive bidder Bloise Construction
for $144,269.00.
2. Alt I -B: Pre -fab Slumpstone Wall: Approve the request from
DWM to substitute the subcontractor for the "pre -fab"
slumpstone wall from Designer Concrete Products to PRECON
Products LTD and award a contract for design Alternate IB to
DWM for the bid amount of $128,536.90.
3. Alt II: Precision Block: Award a contract for design
Alternate II to DWM Construction for the bid amount of
$108,162.30.
4. Alt III: Precision Block with Stucco: Award a contract for
design Alternate III to DWM Construction for the bid amount
of $118,701.80.

Bloise Construction listed Precon Products, Ltd. as the
subcontractor /supplier for the prefab walls. In addition, DWM
has requested that they be allowed to substitute the

subcontractor /supplier listed in their bid for the slumpstone
prefab wall, to Precon Products, LTD. Precon is capable of
meeting CalTrans specifications and providing either the
slumpstone or grapestake designs for the prices set forth in the
proposals. Precon sample brochures have been distributed to the
City Council under separate cover. Should the City Council
select one of the pre -fab design alternates, Precon will be
given 30 days to provide all final design specifications for
City approval in accordance with the requirements of the project
specifications.
E. Fiscal Impact
It is estimated that the amount
of the previously
approved
appropriation ($189,000)
will be sufficient
to fund any of the
above described options.

RECOMMENDATION
Staff recommends that the City Council take the following actions:
1) Select one of the Options described in Section C above.
2) Award a contract for the construction of the project in
accordance with the selected design Alternate to the bidder and
for the price indicated in Section C above.
3) Approve the construction contingency amount for the project
indicated in Section E above and authorize the City Manager to
approve additional work, if required, not to exceed ten percent
(10 %) of the contract price; and,
4) Authorize the Mayor to sign necessary contract documents.

You have informed DWM Construction that the subcontractor we listed
for the Pre -Cast wall option on the above project is not certified
by Caltrans. We utilized /listed "Designer Concrete Products" in
our proposal as they were registered in specifications - "Wall
shall be manufactured by ... Designer Concrete Products (Page
F -14 of spec's). It is unfortunate that the specifications
directed us to utilize a unacceptable manufacturer.
You have offered DWM the option to meet our bid proposal pricing
with a different precast manufacturer who will pass Caltrans
specifications. We offer the following:
Grapestake Precast: We are unable to meet our bid figure of
$88,640 with another manufacturer.
Slumpstone Precast: We can meet our bid figure of $101,714.40
by utilizing PRECON Products LTD, state license 246528, class
C -42.
We appreciate the opportunity to work through the clarifications on
this proposal. Additionally, DWM believes we have not submitted a
proposal which could be considered non - responsive due to our strict
adherence to the bid proposal specification package.

Per your request, please accept this letter as a follow up to
yesterdays letter (faxed at 3:30 p.m., ref /9321).
In regards to DWM's bid for the pre -cast grapestake wall, we are
unable to meet our bid price with a Caltrans approved manufacturer
(see 3/8/93 letter for reasons). Due to this circumstance; DWM
Construction must withdraw section IA of our proposal. Our Base
Bid, and Alternate sections, IB, II, III are to remain under
consideration by your City Council.

the design and authorized advertisement for receipt of bids for the
subject project.
DISCUSSION
A. Project Desigp
The bidding documents require bids for a base bid and four
design alternatives described as follows:
Alternate Description
IA Construction of the wall using pre- fabricated
panels with a grapestake design;
IB Construction of the wall using pre- fabricated
panels with a slumpstone design;
II Construction of the wall using precision block;
III Construction of the wall using precision block wall
with a stucco veneer.
B. Bid Schedules
Schedule I (Base Bid) of the bidding documents includes all of
the items of work not related to the construction of the wall
(e. g. removals, relocations, etc.). Bids for the alternate
wall designs are set forth in Schedule II. Award of the
contract must be based on a combination of the bid received for
Schedule I plus the bid for one of the Alternates in Schedule
II.

C. Bid Results
Bids for the subject project were received and opened on
February 22, 1993. Exhibits have been prepared setting forth a
summary of the bids identified as follows:
