SUBJECT: Consider Resolution to Adopt a Project List to be Funded by
Senate Bill 1 (SB 1): The Road Repair and Accountability Act of
2017 and Authorize the Finance Director to Certify Past
Discretionary Spending on Local Streets to the State Controller
BACKGROUND/DISCUSSION
On April 28, 2017 the Governor signed Senate Bill 1 (SB 1), the Road Repair and
Accountability Act of 2017, into law which will nearly double the amount of revenue cities
and counties will receive from the state for local street maintenance and rehabilitation
needs. On September 16, 2017 the Governor signed Assembly Bill 135 (AB 135) cleanup
legislation for SB 1. In the part of the statute relevant to this staff report, the law was
changed to simplify the process by which cities and counties could approve SB 1 project
lists. Cities only need to adopt project lists at a regularly scheduled meeting by resolution
and not adopt the list as a budget amendment.
The California Transportation. Commission (CTC) provided guidance to cities and counties
in mid-August that requires project lists to be submitted that include, at a minimum: a
description and location of projects to be funded by SB 1 revenues; schedule; and useful
life of the work. The CTC does not approve city and county lists but rather tracks and
reports on the program. Cities can revise the lists as desired. To ensure that the City
receives funding, the list must be sent to the CTC by October 16, 2017. The project list is
provided as Attachment 1. The City will be required to submit a proposed project list and a
completed and in-progress expenditure report each year.
Staff proposes that general maintenance including but not limited to pavement marking,
pavement maintenance, traffic signals, street lighting and landscaping work be
accomplished in the vicinity of Moorpark College utilizing the first year of SB 1

revenues, which will be received on a monthly basis beginning in February 2018. Staff
will return to Council with a specific design for this work in November.
FISCAL IMPACT
Staff anticipates that approximately $250,000 of new funding will be made available to the
City in this first year. That amount will increase over several years as new fees and taxes
take effect.
SB 1 includes a requirement that cities and counties continue to make investments in local
streets and roads from their discretionary funds based on the annual average of what was
spent during three fiscal years beginning in 2009-10. In this context, discretionary funds
only includes the General Fund. For Moorpark that "maintenance-of-effort" (MOE)
threshold investment must be at least $93,597 per year moving forward. The City is
required to certify that the State Controller's accounting is correct (attachment 3).
STAFF RECOMMENDATION
1. Adopt Resolution No. 2017- and authorize staff to submit the proposed
project list to the California Transportation Commission prior to October 16, 2017.
2. Authorize the Finance Director to certify the MOE calculations are correct.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA TO ADOPT A PROJECT LIST
TO BE FUNDED BY SB 1: THE ROAD REPAIR AND
ACCOUNTABILITY ACT OF 2017
WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017
(Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the
Governor on April 28, 2017 in order to address significant multi-modal transportation
funding shortfalls statewide; and
WHEREAS, SB 1 includes accountability and transparency provisions that will
ensure the residents of the City of Moorpark are aware of the projects proposed for
funding in our community and which projects have been completed each fiscal year;
and
WHEREAS, the City of Moorpark must include a list of all projects proposed to
receive funding from the Road Maintenance and Rehabilitation Account (RMRA),
created by SB 1, which must include a description and the location of each proposed
project, a proposed schedule for the project's completion, and the estimated useful life
of the improvement; and
WHEREAS, the City of Moorpark will receive an estimated $ 250,000 in RMRA
funding in Fiscal Year 2017-18 from SB 1; and
WHEREAS, funding from SB 1 will help the City of Moorpark maintain and
rehabilitate streets in the City of Moorpark this year and into the future; and
WHEREAS, the 2016 California Statewide Local Streets and Roads Needs
Assessment found that California's streets and roads are in "at-risk" condition and this
revenue will help increase the overall quality of our road system; and
WHEREAS, without revenue from SB 1, the City of Moorpark would have
otherwise postponed street projects; and
WHEREAS, modernizing the local street and road system provides well-paying
construction jobs and boosts local economies; and

WHEREAS, the local street and road system is also critical for farm to market
needs, interconnectivity, multimodal needs, and commerce; and
WHEREAS, police, fire, and emergency medical services all need safe, reliable
roads to react quickly to emergency calls and a few minutes of delay can be a matter of
life and death; and
WHEREAS, maintaining and preserving the local street and road system in good
condition will reduce drive times and traffic congestion, improve bicycle safety, and
make the pedestrian experience safer and more appealing, which leads to reduce
vehicle emissions helping the State achieve its air quality and greenhouse gas
emissions reductions goals; and
• WHEREAS, restoring roads before they fail also reduces construction time which
results in less air pollution from heavy equipment and less water pollution from site run-
off; and
WHEREAS, the SB 1 project list and overall investment in our local streets and
roads infrastructure with a focus on basic maintenance and safety, will have significant
positive co-benefits statewide.
NOW, THEREFORE IT IS HEREBY RESOLVED, ORDERED AND FOUND by the City
Council of the City of Moorpark, California, as follows:
1. The foregoing recitals are true and correct.
2. The following project is planned to be funded with Road Maintenance and
Rehabilitation Account revenues:
Description: General maintenance including but not limited to pavement
•marking, pavement maintenance, traffic signals, street lighting and
landscaping work.

Estimated useful life: 7 years

Dear Mr.Ahlers:
On April 28,2017,the Governor signed Senate Bill(SB) 1 (Chapter 5, Statutes of 2017),known as the
Road Repair and Accountability Act of 2017. SB 1 was enacted to address basic road maintenance,
rehabilitation,and critical safety needs on both the state highway and local streets and road system.
Beginning November 1,20.17,SB 1 taxes and fees will be deposited into the newly created Road
Maintenance and Rehabilitation Account(RMRA).This will result in more than double the total
amount of state local streets and roads fimding apportioned annually to cities and counties by the State
Controller's Office(SCO)for road maintenance and rehabilitation.
Expenditure authorities for RMRA funding is governed by Article XIX of the California Constitution;
Revenue and Taxation Code,Division 2,Part 5,Chapter 6,section 11051;and Streets and Highways
Code,Chapter 2,Division 3,section 2030(b).
To receive the RMRA apportionments,cities and counties have a maintenance-of-effort(MOE)
requirement established in Streets and Highways Code section 2036 which specifies that cities and
counties must annually expend from their discretionary expenditures for street and transportation
purposes an amount not less than the annual average of their discretionary expenditures during fiscal
year(FY)2009-10,FY 2010-11,and FY 2011-12,as reported to the SCO pursuant to Streets and
Highways Code section 2151.
RMRA funds are subject to audit by the SCO for compliance with Article XIX of the California
Constitution,Revenue and Taxation Code section 11051,and Streets and Highways Code sections
2036 and 2151.
Attached is a Calculation Summary Sheet of the City of Moorpark's MOE.This sheet contains
expenditure amounts funded by discretionary sources certified by the city's fiscal officer in its Annual
Street Report(ASR)to the SCO.
