SUBJECT: Consider Granting /Acceptance of Easements Between the
City and the Ventura County Flood Control District
Required for the Construction and Use of the Arroyo Vista
Community Park Pedestrian, Equestrian, Bicycle, Emergency
Access Bridge Over the Arroyo Simi
DISCUSSION
A. Background
The design for the Arroyo Vista Community Park Pedestrian,
Equestrian, Bicycle, Emergency Access Bridge is completed. It
is the intent of staff to request Authorization to Advertise for
bids as soon as the all required rights -of -way are obtained.
B. Status of Right -of -Way Acquisition
1. Cabrillo: The Cabrillo Economic Development Corporation has
conveyed Easement Deeds to both the City and to the VCFCD
required for the construction and use of the subject bridge.
2. SCE: The City has retained the services of an appraiser to
prepare an appraisal report for the property required from
the Southern California Edison Company (SCE) to proceed with
the project. When that report is completed, an offer will be
presented to SCE to purchase the required property.
3. VCFCD: Approval of the subject items will complete right -of-
way acquisition efforts with VCFCD.
C. Easement to the City
The Ventura County Board of Supervisors, acting in the capacity
of the Board of Directors for the Ventura County Flood Control
District (VCFCD), has approved an Easement Deed (Exhibit 1)
granting to the City an easement across the arroyo needed to
construct and use the subject bridge.

It should be noted that certain wording set forth in this
Easement Deed subordinates all City rights to construct and use
the bridge, to all present and future rights of the VCFCD to
construct, use and maintain flood control facilities. Staff has
been advised by the City's design Engineer that the City's
proposed pedestrian bridge is fully compatible with the VCFCD
proposed channel widening project. The pedestrian bridge is
and /or will not be in conflict with any known plans of the VCFCD
for the improvement and use of the Arroyo Simi.
D. Easement to VCFCD
Attached as Exhibit 2 is a copy of an Easement Deed to be
granted by the City to the VCFCD. This easement is to allow for
the relocation of the levy access road required to accommodate
the subject bridge.
RECOR IENDATION
Staff recommends that the City Council take the following actions:
1. Approve a Certificate of Acceptance for an Easement Deed
(Exhibit 1) from the VCFCD and direct the City Clerk to
record said deed and certificate.
2. Authorize the Mayor to sign an Easement Deed (Exhibit 2) to
the VCFCD and direct the City Clerk to forward said executed
document to the VCFCD for acceptance and recordation.

The property granted herein is an easement for pedestrian, bicycle and equestrian access
and related purposes, together with access for all emergency vehicles, over that certain
property described on page 2 and delineated on page 3 attached hereto and made a part
hereof by reference.
This easement is conveyed upon the express condition that it is subordinate to the right of
the Ventura County Flood Control District (District) to construct, maintain and operate
flood control facilities therein and if any improvements, or portions thereof, constructed
therein by grantee interfere with the future exercise of said right, grantee shall remove,
revise and /or relocate said improvements at no cost to District.
