On October 19, 1992, the Planning Commission approved Resolution PC 92 -267 for the construction of a 3,200 square foot Mc Donald's restaurant which has since been completed. Minor Modification No. 1 was approved on May 11, 1993 for modifications to the landscaping and sidewalk. On May 17, 1994, Mc Donald's Corporation applied for Minor Modification No. 2 to install a pay phone and eliminate the left turn limitation when exiting the site. This application was found incomplete on June 3, 1994 and was never processed. The current application, Minor Modification No. 3, was filed on May 23, 1996 for the construction of an addition to the building to be used as a "Playplace ". Project Description This application is for the construction of a proposed 1,093 square foot addition to a 3,200 square foot restaurant to be used as an indoor play area ( "Playplace "). a) Design. The addition will be 28' x 34'6" in size, located at the southwest corner of the building, in the same location as the proposed future tot lot which was originally approved. Height of the addition will be 27', which is 2' taller than the tallest part of the building. The proposed addition will match the architectural style, materials, and colors of the existing building. Large windows are proposed to provide light for the play equipment. This will also allow the equipment to be viewed from outside when the interior is illuminated. +(116 CPD 92 -2 Minor Mod 3 August 7, 1996 Page 2 b) Setbacks. Currently the restaurant has setbacks of 83' from Spring Road, 88' from Los Angeles Avenue and 129 'from the corner. These setbacks will change to 64' from Spring Road, 68' from Los Angeles Avenue and 91 ' from the corner which meet the Zoning Code requirements. c) Intersection. This intersection is one of the busiest in the City. Any proposed improvements to this corner must maintain an excellent visual image. As conditioned, this proposal will add to the present building with similar architectural treatments to the existing building. d) Landscaping. An additional landscaped planter shall be built on the northwest side of the building adjacent to the drive -thru exit. This planter will relocate the drive -thru exit further from the pedestrian walkway and end of the building and improve visibility for vehicles traveling in both directions. e) Parking. 32 parking spaces are required for the existing 3,200 square foot restaurant. This addition will require 8 additional parking spaces. The 40 spaces (including calculation of motorcycle spaces) provided on site are adequate to serve both the existing and proposed uses. f) Permit Requirement. Condition No. 170 of Resolution No. 92 -267 requires "After the 14th month of operation, Mc Donald's Corporation shall install the Tot Lot consistent with the approved Site Plan. " The approved site plan indicated that the tot lot would be outdoors and surrounded by a wall. Because the proposed tot lot is inside a building addition and not outside, as approved, a Minor Modification is required. This Minor Modification request meets all applicable Zoning Code requirements. The Modification request is conditioned to comply with all previous conditions of CPD 92 -2 and has further been conditioned as follows: 1) Improvements depicted on the approved plans shall be modified by the approved Minor Modification conditions of approval. 2) Plans shall be modified to eliminate the upper row of windows on the southwest elevation. A decorative window surrounded by molding similar to the pre -fab molding design used on the other elevations may be placed above the tile canopy. 3) A tiled canopy shall be added to the south west side of the Playplace addition. Canopy design shall match existing canopies on the building. 4) The applicant shall paint a limit line at the exit of the drive- thru. CPD 92 -2 Minor Mod 3 August 7, 1996 Page 3 5) The driveway exit on New Los Angeles Avenue and Spring Road shall be re- striped with a striped pattern to indicate vehicles exiting the site to turn right and to read "Right Turn Only" subject to approval by the Director of Community Development and the Chief of Police. 6) Applicant shall post and maintain "Right turn only" signs on the driveways exits on both New Los Angeles Avenue and Spring Road. Each sign shall be 5' tall and of high visibility. 7) Additional landscaping in the new planter shall be provided. A landscaping plan must be approved by the Director of Community Development prior to issuance of a zoning Clearance. 8) All required landscape plan review fees shall be paid. 9) Approval of a Zone Clearance is required prior to the initiation of construction. 10) Colors and materials must match the existing building. 11) No additional building signs are allowed. Existing signs meet the maximum allowed sign area. Applicant shall install a sign at the end of the drive -thru warning vehicles to watch for pedestrians. Sign shall be approved by the Director of Community Development prior to installation. 12) All conditions of Resolution No. PC 92 -267 and Minor Modification No. 1 remain in effect. This proposal has been reviewed by the Director of Community Development who approved the application on July 30, 1996. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, a public hearing should be scheduled. The last day for an appeal to be filed is August 15, 1996. The next available hearing date is August 21, 1996. If the Council takes no action, the Director's decision will become effective on August 16, 1996. CEOA: The project is Categorically Exempt from CEQA requirements as a Class 1, Exemption for addition to existing structure. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 17.44.030 - Permit Standards, in that: a. The Minor Modification is consistent with the intent and provisions of the City's General Plan and the Zoning Ordinance; b. The Minor Modification is compatible with the character of surrounding development; C. The proposed Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring prope wjz- 6 uses; [V����•• EXHIBIT D d. The Modification would not be detrimental to the public interest, health, safety, convenience, or welfare; and e. The conditionally permitted use is compatible with existing and planned land uses in the general area where the development is to be located. Appeals: As stated in Section 17.44.090, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval, conditional approval or denial with the Community Development Department who shall set a hearing date before the City Council to review the matter at the earliest convenient date.
