22; and Consider Resolution Amending the Fiscal Year 2017/18
Budget to Fund the Landscape Architect Services
BACKGROUND & DISCUSSION
On June 21, 2017, the City Council approved two Agreements with Architerra, Inc. dba
Architerra Design Group (Architerra) to re-design planter and turf areas in the Country
Club Estates Landscape Maintenance District (LMD) (District 15) and the Moorpark
Highlands LMD (District 22). This work is the latest phase of the City's progress on.the
Drought Action Plan (DAP) that was approved in July of 2015. Action item A.2.b of the
DAP called for the renovation of planters and turf areas with California native plants or
other low water use landscaping in LMDs and at City facilities. In District 15 the area of
work includes the parkways and streetscape areas along the length of Championship
Drive. In District 22, the area of work includes the parkways and streetscape areas
along Spring Road and Ridgecrest Drive.
In addition to the provisions of the DAP, in December, 2015, the State of California
updated the California Code of Regulations Title 23, Division 2, Chapter 2.7, Model
Water Efficient Landscape Ordinance (Ordinance). The Ordinance is adopted by
reference in Chapter 15.23 of the Moorpark Municipal Code. It imposes a wide range of
water conservation mandates on local agencies including landscape and irrigation
design guidelines that limit the types of plant material and irrigation systems allowed in
certain landscaped areas. For example, overhead spray irrigation is prohibited within 2'
of hardscape such as sidewalks or streets, and sub-surface irrigation or other irrigation
means that produce no runoff or overspray are required in areas less than ten feet in
width.

The provisions of the Ordinance require that any renovation area that exceeds 2,500
square feet in size must conform to the requirements of the Ordinance, and due to the
fact that the median islands fall within the overall renovation area, the landscape
architect has recommended a partial renovation of the center median islands on
Championship Drive, Spring Road and Ridgecrest Drive as part of the overall
renovation work in District 15 and District 22. Architerra has submitted a proposal for
the redesign of the irrigation system in the median islands from the current pop-up spray
irrigation system to an embedded drip irrigation system, with separate bubblers for the
trees. Additionally, the proposal includes a partial renovation of the planting in the
medians with a drought tolerant, low water use plant palette. When completed, the
construction documents for the median island renovation will be incorporated into the
construction documents for the parkways and streetscape areas so that construction in
each LMD can be bid as one project.
The proposed cost for median island redesign is $40,200 for District 22 and $19,300 for
District 15. Staff is also requesting additional contingency funding of$10,967 for District
15 to bring the contingency amount for the contract to 15%, as only 5% contingency
was originally included in the agreement due to FY 16/17 budget limitations. No
additional contingency is requested for District 22. Since the median island landscape
redesign was not included in the original Agreements with Architerra for landscape
architect services in District 15 and District 22, staff is requesting that City Council
approve amendments to both agreements (Attachments 1 and 2) for this work.
FISCAL IMPACT
Amendment No. 1 to the District 15 Agreement includes an increase of $19,300 for
median island landscape redesign, plus $10,967 for additional contingency, for a total
increase of $30,267. Amendment No. 1 to the District 22 Agreement includes an
increase of$40,200 for median island landscape redesign. Funding for these additional
services was not included in the adopted FY 17/18 budget.
At 6/30/2018, the projected fund balance for the Country Club Estates Fund (2315), is
approximately $1,546,000, while the projected fund balance for the Moorpark Highlands
Fund (2322), is approximately $3,078,000. Staff is requesting a budget amendment of
$30,267 from Country Club Estates Fund (2315) and $40,200 from Moorpark Highlands
Fund (2322).
Cost estimates for the median island renovation work in Districts 15 and 22 have not
been prepared. Staff will return to the City Council to discuss overall project costs once
the construction documents have been completed.
STAFF RECOMMENDATION (ROLL CALL VOTE)
1) Approve Amendment No. 1 to Agreement with Architerra, Inc. for $30,267 for
median island landscape redesign and contingency in District 15 (Championship

Drive), and authorize execution of the Amendment by the City Manager, subject
to final language approval by the City Manager.
2) Approve Amendment No. 1 to Agreement with Architerra, Inc. for $40,200 for
median island landscape redesign in District 22 (Spring Road and Ridgecrest
Drive), and authorize execution of the Amendment by the City Manager, subject
to final language approval by the City Manager.
3) Adopt Resolution No. 2017- amending the FY 17/18 budget to fund
landscape architectural services.

AMENDMENT NO. 1
TO AGREEMENT BETWEEN THE CITY OF MOORPARK AND
ARCHITERRA, INC. DBA ARCHITERRA DESIGN GROUP FOR LANDSCAPE
ARCHITECTURAL SERVICES FOR CHAMPIONSHIP DRIVE
This Amendment No. 1 to the Agreement between the City of Moorpark, a
municipal corporation ("City"), and Architerra, Inc. dba Architerra Design Group, a
corporation ("Contractor"), for landscape architectural services ("Agreement"), is made
and entered into the day of , 2017.
RECITALS
WHEREAS, on June 27, 2017 the City and Contractor entered into an
Agreement to have the Contractor provide landscape architectural services for
Championship Drive; and
WHEREAS, whereas the City has the need for additional landscape architectural
services for Championship Drive; and
WHEREAS, the Contractor has submitted a proposal dated September 15, 2017,
which is attached hereto as Exhibit E; and
WHEREAS, the City and Contractor now desire to amend the Agreement to
increase the compensation for services to be performed by Contractor from eighty-four
thousand seven hundred fifty-six dollars ($84,756), which includes a five percent (5%)
contingency of in the amount of four thousand thirty-six dollars ($4,036), by a value of
thirty thousand two hundred sixty-seven dollars ($30,267), which includes a fifteen
percent (15%) contingency in the amount of fifteen thousand three dollars ($15,003), for
a total contract value of one hundred fifteen thousand twenty-three dollars ($115,023),
and document said agreement to amend by jointly approving Amendment No. 1 to the
Agreement.
NOW, THEREFORE, it is mutually agreed by and between the parties to the
Agreement as follows:
I. Section 1, TERM, is amended by replacing this section in its entirety as follows:
"The term of this Agreement shall be from the date of execution to
completion of the work identified in the Scope of Services and in
conformance with Exhibits C, D and E, unless this Agreement is
terminated or suspended pursuant to this Agreement."
II. Section 2, SCOPE OF SERVICES, is amended by replacing this section in its
entirety as follows:

"City does hereby retain Consultant, as an independent contractor,
in a contractual capacity to provide landscape architectural services, as
set forth in Exhibits C, D, and E. In the event there is a conflict between
the provisions of Exhibits C, D, and/or E, and this Agreement, the
language contained in this Agreement shall take precedence.
Consultant shall perform the tasks described and set forth in
Exhibits C, D, and E. Consultant shall complete the tasks according to the
schedule of performance which is also set forth in Exhibits C and E.
Compensation for the services to be performed by Consultant shall
be in accordance with Exhibits C and E. Compensation shall not exceed
the rates or contract value of one hundred thousand twenty dollars
($100,020), as stated in Exhibits C and E, plus a fifteen percent (15%)
contingency in the amount of fifteen thousand three dollars ($15,003), for
a total contract value of one hundred fifteen thousand twenty-three dollars
($115,023), without a written Amendment to the Agreement executed by
both parties. Payment by City to Consultant shall be in accordance with
the provisions of this Agreement."
III. Section 5, PAYMENT, is amended by replacing the second paragraph in its
entirety as follows:
"The City agrees to pay Consultant monthly, in accordance with the
payment rates and terms and the schedule of payment as set forth in
Exhibits C and E, based upon actual time spent on the above tasks. This
amount shall not exceed one hundred thousand twenty dollars ($100,020),
as stated in Exhibits C and E, plus a fifteen percent (15%) contingency in
the amount of fifteen thousand three dollars ($15,003), for a total contract
value of one hundred fifteen thousand twenty-three dollars ($115,023) for
the total term of the Agreement unless additional payment is approved as
provided in this Agreement."
IV. Remaining Provisions:
Except as revised by this Amendment No. 1, all of the provisions of the
Agreement shall remain in full force"and effect.

Dear Mr. Laurentowski:
We are pleased to submit this proposal for Landscape Architectural Services in
connection with the project referenced above. This agreement is by and between
Architerra Design Group, Inc. (ADG) and The City of Moorpark (Client).
PROJECT OVERVIEW
The City of Moorpark's Parks and Recreation Department currently oversees and
maintains landscape, irrigation and hardscape improvements within Landscape
Maintenance Districts (LMD's) throughout the City.
Many of these LMD's include aged streetscapes in need of renovation to meet the
State of California's AB 1881 "The Model Water Efficient Landscape Ordinance",
provide for better water conservation through the use of improved irrigation
technologies, as well as replacement of high water use plants.
This proposal addresses two median islands on Championship Drive. The two median
islands are located at the intersections of: Championship Drive and Walnut Canyon
Road, and at Championship Drive and Grimes Canyon Road.
For the median islands, the City has requested that the irrigation system be redesigned
from the existing pop-up spray irrigation system, to an embedded inline drip irrigation
system, placed on a grid for the shrub areas, with a separate valve system, and
bubblers for the trees.
Additionally, the City has requested that ADG prepare new planting plans for the same
median islands to replace the existing turf and shrub areas.
Our scope of services to meet these goals are further defined below.

SCOPE OF SERVICES
ADG agrees to perform professional services for the Client as set forth below for the
Basic Fee as indicated:
Conceptual Design Phase to Include:
1. Project Kick-off Meeting with ADG Staff for review project goals, deliverables and
schedules.
2. Provide a site visit of the project area with ADG staff (two members) to
photograph/document existing on-site plant materials, irrigation systems, and
relevant off-site conditions.
3. Prepare planting design development plans for 2-3 "typical" plan_t replacement
conditions on previously developed CAD base sheets.
4. Prepare preliminary plant replacement palette,with photos.
5. Meet with City Staff to review plant palettes, and irrigation retrofit strategies. (1
meeting)
6. Revise and finalize design exhibits as required by final City review.
7. Project Administration (Bi-weekly Status Report and Project Scheduling)
8. Telephone Consultation.
B. Construction Document Phase to Include:
1. Base Sheet Development utilizing City Engineering title block, at 20-scale, 24"x36".
(2 sheets) City to supply base files in AutoCAD format for project area for ADG's use
in developing project base sheets.
2. Soil collection and testing, two tests will be collected to be utilized for final soil
amendment recommendations and Soil Management Plan (As required by
MWELO).
3. Title Sheet Preparation.
4. Preparation of landscape and irrigation Demolition Plans identifying removals of
existing landscape and irrigation improvements. (2 sheets)
5. Irrigation Plan Preparation at 20-scale. (2 sheets)
6. Irrigation Detail Preparation.
7. Prepare Water Efficiency Landscape Worksheets.
8. Prepare 2 Irrigation Controller Charts.
9. Planting Plan Preparation at 20-scale. (2 sheets)
10. Planting Detail Preparation.
11. Irrigation & Planting Specifications. (Book Form)
12. Prepare Annual Irrigation and Planting Maintenance Schedule.
13. Submit plans to the City at 50%, 75%, and 100%completion.

14. Attend one progress review meeting with City staff to clarify and coordinate
construction documents and specifications.
15. Revise plans per Agency Plan Check redlines.
16. Provide City with AutoCAD files in 2012 file format upon final plan approval.
17. Provide City with one set of stamped and signed plans, both hard copy and PDF
format.
18. Provide City with itemized statement of probable construction costs at 100%
construction document completion.
19. Project Administration (Preparation of Bi-Weekly Status Report and Project
Scheduling).
20. Telephone Consultation.
21. Utility Research (Irrigation Point of Connection, Pressure).
C. Bidding Phase to Include:
1. Assist City with bid Form preparation.
2. Attend Pre-bid Meeting.
3. Answer contractor's requests for information (RFI's).
4. Respond to City with all clarifications and addenda items.
D. Construction Observation Phase to Include:
1. Provide reviews of contractor's material submittals and respond to RF|'s/subshh/hon
submittals.
2. Construction observation site visits; two progress meetings on site with contractors.
3. Provide one final inspection to indicate contractor deficiencies and compliance,
and completion.
4. Preparation of site review reports for submittal to Client for review, and contractor
for correction. Five reports total, including punch lists.
5. Project Administration.
If the Scope of the Project as outlined above is changed materially, the Basic Fee shall
be changed in the same proportion.
Fees and Terms
Services described above shall be provided for in accordance with the terms and
conditions in Appendix A attached hereto and which is incorporated and made a part
of this Agreement by reference. We estimate the following fee breakdown by Phase
"Hourly not to Exceed":
A. Conceptual Design: $3'500.00
B. Construction Documents: $9,650.00
C. Bidding Assistance: $2'000.00
D. Construction Observation: $3,150.00

Estimated Reimbursable Expenses* $1,000.00
*We estimate that the cost of Reimbursable Expenses, as identified in Appendix A, will
be approximately the amount noted above. Reimbursable Expenses incurred are
based on the demands/needs of the Client.
General Work Program •lnd Time Table
Architerra Design Group proposes the following timetable for completion of this Project
after receipt of all necessary information from Client or Client's Consultants as listed
under"Owners/Architects Responsibility'.

ADG shall render its services as expeditiously as is consistent with professional skill and
care. ADG shall not be responsible for delays that may occur due to causes beyond
ADG's reasonable control.
Design Approval
Mr. Jeremy Laurentowski is designated as the person responsible for design direction to
ADG for this Project and has the authority for design approval. In the event that the
design, as approved by Mr. Laurentowski is rejected by others, and redesign is required,
such redesign shall be compensated as Additional Services.
Meetings and Site Visits
This Agreement includes Professional Service time for up to four meetings for
coordination with Client, agencies, or consultants. Additional meetings shall be billed as
Additional Services. Travel expenses shall be billed as Reimbursable Expenses.
Owners/Architect's Responsibility
Client shall provide the following information, documents, or services as required for
performance of the work. ADG is entitled to rely upon the accuracy and completeness
of such information, documents, and services, and shall not be liable for errors or
omissions therein. Should ADG be required to provide services in obtaining or
coordinating compilation of any such information, drawings, or services shall be
charged as Additional Services.
1. CAD & GIS electronic files (DWG & PDF) of streetscape project area.
2. As-builts of project area if available.
3. Soils testing and/or engineering.
4. Existing site engineering and utility base information.
S. Engineering other than that provided within the Scope of Services.
6. Agency processing of completed plans.

This Amendment No. 1 to the Agreement between the City of Moorpark, a

corporation ("Contractor"), for landscape architectural services ("Agreement"), is made
and entered into the day of , 2017.

C. Bidding Phase to Include:

D. Construction Observation Phase to Include:
1. Provide reviews of contractor's material submittals and respond to RFI's/substitution
submittals.
2. Construction observation site visits; three progress meetings on site with contractors.
3. Provide two final inspections to indicate contractor deficiencies and compliance,
and completion.
4. Preparation of site review reports for submittal to Client for review, and contractor
for correction. Five reports total, including punch lists.
5. Project Administration.
If the Scope of the Project as outlined above is changed materially, the Basic Fee shall
be changed in the same proportion.
Fees and Terms
Services described above shall be provided for in accordance with the terms and
conditions in Appendix A attached hereto and which is incorporated and made a part
of this Agreement by reference. We estimate the following fee breakdown by Phase
"Hourly not to Exceed":
A. Conceptual Design: $4,400.00
B. Construction Documents: $27,175.00
C. Bidding Assistance: $2,000.00
D. Construction Observation: $5,125.00

Estimated Reimbursable Expenses* $1,500.00
*We estimate that the cost of Reimbursable Expenses, as identified in Appendix A, will
be approximately the amount noted above. Reimbursable Expenses incurred are
based on the demands/needs of the Client.
General Work Program and Time Table
Architerra Design Group proposes the following timetable for completion of this Project
after receipt of all necessary information from Client or Client's Consultants as listed
under"Owners/Architects Responsibility".

ADG shall render its services as expeditiously as is consistent with professional skill and
care. ADG shall not be responsible for delays that may occur due to causes beyond
ADG's reasonable control.
Design Approval
Mr. Jeremy Laurentowski is designated as the person responsible for design direction to
ADG for this Project and has the authority for design approval. In the event that the
design, as approved by Mr. Laurentowski is rejected by others, and redesign is required,
such redesign shall be compensated as Additional Services.
Meetings and Site Visits
This Agreement includes Professional Service time for up to four meetings for
coordination with Client, agencies, or consultants. Additional meetings shall be billed as
Additional Services. Travel expenses shall be billed as Reimbursable Expenses.
Owners/Architect's Responsibility
Client shall provide the following information, documents, or services as required for
performance of the work. ADG is entitled to rely upon the accuracy and completeness
of such information, documents, and services, and shall not be liable for errors or
omissions therein. Should ADG be required to provide services in obtaining or
coordinating compilation of any such information, drawings, or services shall be
charged as Additional Services.
1 . CAD & GIS electronic files (DWG & PDF) of streetscape project area.
2. As-builts of project area if available.
3. Soils testing and/or engineering.
4. Existing site engineering and utility base information. •
5. Engineering other than that provided within the Scope of Services.
6. Agency processing of completed plans.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING THE FISCAL YEAR
2017/18 BUDGET BY APPROPRIATING $30,267 FROM THE
COUNTRY CLUB ESTATES FUND (2315) AND $40,200 FROM
THE MOORPARK HIGHLANDS FUND (2322) FOR LANDSCAPE
ARCHITECTURAL SERVICES
WHEREAS, on June 21, 2017 the City Council adopted the Operating and
Capital Improvement Projects Budget for Fiscal Year 2017/18; and
WHEREAS, on October 18, 2017 a staff report was presented to the City Council
requesting authorization for Amendment No. 1 to Architerra, Inc.'s agreement for
landscape architectural services for Championship Drive, and authorization for
Amendment No. 1 to Architerra, Inc.'s agreement for landscape architectural services
for Spring Road and Ridgecrest Drive; and
WHEREAS, an additional $70,467 is required to fully finance the current year
landscape architectural services and a budget amendment of $30,267 from the Country
Club Estates Fund (2315) and $40,200 from the Moorpark Highlands Fund (2322) is
requested; and
WHEREAS, Exhibit "A", attached hereto and made a part hereof, describes said
budget amendment and the resultant impact to the budget line items.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. A budget amendment in the amount of $30,267 from the Country
Club Estates Fund (2315) and $40,200 from the Moorpark Highlands Fund (2322), as
more particularly described in Exhibit "A", attached hereto, is hereby approved.
SECTION 2. The City Clerk shall certify to the adoption of this resolution and
shall cause a certified resolution to be filed in the book of original Resolutions.
