SUBJECT: PLANNED DEVELOPMENT PERMIT NO. 1010 - G.H. PALMER ASSOCIATES
NON--CONFORMING ENCROACHMENT AGREEMENT
BACKGROUND
PP-•1010 is required, as a condition of development, to provide a
meandering sidewalk running the length of the project along the Los
Angeles Avenue frontage. In attempting to meet this condition the
developer has discovered an extraordinary requirement of Caltrans to
attach a rider on the previously approved encroachment permit (No.
787-6RW-0930).
The developer is precluded from completing the condition requirement
unless the City accepts responsibility for maintenance and liability of
the sidewalk.
Recently the City entered into a similar situation with the acceptance
of the maintenance and liability of landscaping with Caltrans for this
project. The City in turn has a separate agreement with G.H. Palmer
Associates for landscaping maintenance along the Los Angeles Avenue
frontage.
Staff has drafted an agreement letter (see attached) under the direction
of Caltrans to satisfy their needs.
RECOMMENDATION
Review and consider the letter of agreement with Caltrans so as to
permit a meandering sidewalk along Los Angeles Avenue for PD-1010 and
authorize the City Manager to sign the letter of agreement.
