SUBJECT : PEDESTRIAN BRIDGE ACROSS THE ARROYO SIMI ; PD-1010 (PALMER)
At the direction of the City Council , a status report concerning the pedestrian
bridge across the Arroyo Simi is being provided. Condition No. 29 of PD-1010
(Palmer) , approved on September 3, 1985, had the developer responsible for
one-half (1/2) of the cost, with the City retaining the option to have the
developer construct the bridge with the other one-half (1/2) of the cost to
be reimbursed from adjacent development to the west. The actual language
of Condition No. 29 of PD-1010 is as follows:
"That the applicant is to be responsible for one-half the cost for design
and construction of a pedestrian bridge across the Arroyo Simi . At the City' s
option, applicant may either provide cash or construct the pedestrian bridge,
with a reimbursement agreement for costs in excess of their obligation.
Reimbursement to come from adjacent development to the west. If at some time
in the future, the City determines that the area of benefit includes properties
other than adjacent property, the City will rebate a proportionate share of
the costs for the bridge. The location and design of this facility shall be
subject to review and approval by the Planning Commission. A bicycle and
equestrian trail shall be constructed on top of the levee adjacent to the site."
The bridge across the Arroyo Simi is on the City's Circulation Element. In
June 1986, during an update of the Los Angeles Avenue Area of Contribution (AOC) ,
the City Council included $200,000 for two-thirds (2/3) of the estimated cost
for the subject pedestrian bridge. Subsequent to this action, the Tierra Rejada/
Moorpark Road AOC was updated to include the other one-third (1/3) cost for the
pedestrian bridge in the amount of $100,000. This action was taken, since the
Council felt that the bridge costs should be borne by a larger area and the AOC
mechanism provided the ability to spread the costs in that manner.

The developer of PD-1010, G.H. Palmer, had begun some preliminary design/study
of the bridge, including the the short-lived investigation of the possible
relocation of the "historic" bridge from the Piru area. Palmer has requested
consideration for a refund or credit of that portion of his costs on the
bridge work that the City subsequently determines is useful in design of the
bridge. No decision has been made on this request. Any reimbursement would
come from the two AOCs.
On July 16, 1986, the Parks & Recreation Commission considered alternative
locations for the siting of the pedestrian bridge. The Commission has recommend
that the bridge be placed at the terminus of Liberty Bell Road. In conjuction
with this action, they recommended that the City work with the Villa Campesina
project to construct a parking lot on a portion of the park land to be dedicated
as part of that project. The City Council has not yet acted upon this recommend-
ation.
It has been staff's intention to prepare a Major Modification to PD-1010 to
resolve the conflict/overlap between the PD-1010 condition and the AOC reports.
There are potentially other items in PD-1010 that will require modification,
and it is planned that all items be considered at one time. The other items
include the timing of signal improvements at Moorpark Avenue and the low and
moderate income requirements. The options concerning the pedestrian bridge include:
1. Delete Condition No. 29 from PD-1010, since the AOC now funds the bridge.
2. Require G.H. Palmer to construct the pedestrian bridge and reimburse them
with AOC funds.
3. Leave Condition No. 29 in place; and
A) require Palmer to deposit the cost for one-half of the cost of the
bridge as a reduction or supplement to the AOC funding; or
B) require Palmer to construct the bridge with 50% reimbursement to
come from the AOCs, with a subsequent reduction in the AOC fees; or
C) rescind the June 1986 Council action of including the project in
the AOCs.
At the present time, staff favors option No. 1, since the bridge is intended to
serve a larger area and is more approrpiately funded by the AOC mechanism. Option
No. 2 is not recommended at this time, since installation of the bridge would
be premature. The Community Park site in PC-3 is not designed and the timing,
location and nature of the improvements to this park site have not yet been
determined.

RECOMMENDED ACTION:
No action is recommended at this time, since the subject of the pedestrian
bridge, as related to Condition No. 29 of PD-1010, will be the subject of a
Major Modification in the future.
