SUBJECT: Consider Approval of State -Local Partnership Program
Supplemental Agreement for the Tierra Rejada Road
Widening Project

In December of 1990, the City Council approved STATE -LOCAL ENTITY
AGREEMENT NO. SLTPP -5436, which is required in order to participate
in the State -Local Transportation Partnership Program. Pursuant to
the terms of that Agreement, each project to receive funding under
the program must be approved via execution of a Supplemental
Agreement. Prior Supplemental Agreements approved under this
program are listed as follows:
No. 001: Los Angeles Avenue Widening [West]; and,
No. 002: Traffic Signal @ Spring Road and Peach Hill Road.
This requests approval of PROGRAM SUPPLEMENT NO. 003 [SB93-
5436(082) / E. A. Number 07- 928729], relating to the widening of
Tierra Rejada Road from Spring Road to Moorpark Road. The amount
of the State Grant authorized by this Agreement is $283,410.
Staff recommends that the City Council approve the subject
Supplemental Agreement and authorize the Mayor to execute said
document on behalf of the City Council.

Attached are tt.,) (2) copies of Supplement No. 003 to Local
Agency - State Master Agreement No. 07 -5436. This Supplement
covers the State - Local Partnership funds in the City of
Moorpark, California for the above captioned project.
Please execute and return all copies of the Supplemental
Agreement, along with a certified copy of the City Council
resolution or minutes authorizing execution, before June 15,
1993, or it will not be valid. Include the date of execution,
the City Council resolution number and the resolution date as
appropriate on the first page of the Supplement.
Upon return to the District, all copies will be executed by
the Chief of Local Streets and Roads Branch and one copy returned
to you for your records.

PARTNERSHIP PROGRAM AGREEMENT NO. SLTPP -5436
This Program Supplement is hereby incorporated into the State -Local Trans-
portation Partnership Program Agreement for State Share Funds which was
entered into between the Local Entity and the State on 01/05/91 and is
subject to all the terms and conditions thereof. This Program Supplement
is adopted in accordance with Paragraph 3 of Article I of the aforemen-
tioned Master Agreement under authority of Resolution No. ,
approved by the Local Entity on (See copy attached).
The Local Entity further stipulates that as a condition to payment of funds
obligated to this project, it accepts and will comply with any covenants or
remarks setforth on the following pages.

1. It is mutually understood between the parties that this
contract may have been written before ascertaining the
availability of legislative appropriation of funds, for
the mutual benefit of both parties, in order to avoid
program and fiscal delays that would occur if the
agreement were executed after that determination was
made.
The total amount of State -Local Transportation
Partnership funds payable by the State shall not exceed
$283410 to be encumbered and reimbursed as follows:

2. The State Funds Share is calculated based on the lower of the
approved eligible application amount or the eligible award
amount.
3. Within 120 days of project completion a Final Report of
Expenditures must be transmitted to the Caltran's District Local
Streets and Roads Engineer.
4. A Final Audit must be completed and transmitted to the Caltran's
District Local Streets and Roads Engineer by December 30th (the
State fiscal year following project completion).
5. The Reimbursement Ratio for this Cycle 3 (92/93) project is
21.570.
6. In accordance with the State and Local Transportation Partnership
Program Guidelines dated April 1992, Section IV, Project
Eligibility, the 10% allowance for construction engineering and
contingencies is not eligible after Cycle 2. Only state /agency
furnished materials can be added to the contract item cost for
State Partnership funds eligibility.
