At that meeting, the Planning Commission recommended that the City Council approve Conditional Use Permit No. 92 -3 and Variance No. 92 -3 subject to modified Conditions of Approval. This Conditional Use Permit was first scheduled for the City Council meeting of February 17, 1993, but was continued as the original applicant (Community Christian Church) was unable to complete their transaction with the property owner. As the Community Christian Church was no longer going to pursue approval of the Conditional Use Permit to occupy the Kazuko Court building, they contacted the Shiloh Community Church, who had indicated an interest in pursuing the application process for the Conditional Use Permit. The Department of Community Development received a letter from the Shiloh Community Church on February 26, 1993, officially notifying the City of their intention to assume the CUP process as they had entered into a agreement with owner of the building at 5238 Kazuko Court. Since then, the Shiloh Church ran into difficulties completing their transaction with the property on Kazuko Court and subsequently entered into an agreement with Moorpark West regarding the building approved as IPD 90 -11. This matter was continued from the City Council meeting of April 21, 1993 at the request of the applicant, as the church did not want to withdraw their application for Conditional Use Permit No. 92 -3 until the City Council acted on Zone Change 93 -1. Given the tentative approval of Zone Change 93 -1 and Minor Modification No. 3 to IPD 90 -11 for occupancy of the industrial building by the church, the applicant has made the decision to no longer pursue approval of CUP 92 -3. On May 25, 1993, the applicant formally withdrew their application for Conditional Use Permit 92- 3. PP05 :26:93 111:39aM:\CCI.MrsM 1 Recommendation: Staff recommends the City Council accept the Shiloh Community Church request to withdraw their application for Conditional Use Permit No. 92 -3 and that staff be instructed to close the file and return any unused deposit to the original depositor.
