SUBJECT: A Resolution to Enable the Enforcement of the
California Vehicle Code at 633 - 693 New Los Angeles
Avenue (Moorpark Pines Apartments)
OVERVIEW
This presents for consideration at a public hearing, a
resolution making the private roads and parking areas in the
Moorpark Pines Apartment Complex subject to the provisions of
the California Vehicle Code (CVC).
DISCUSSION
A. Authority
The City enforces the CVC in a number of privately owned
parking areas in commercial shopping centers and multi - family
residential developments. Enforcement of the CVC on private
property requires the adoption of a resolution by the local
agency at the request of the property owner.
B. Request
The City is in receipt of a request (Exhibit 1) for such
enforcement in the Moorpark Pines Apartment complex. The
request was submitted by the owner of the property.
C. Notice
A notice of this Public Hearing was sent to the property
owner in accordance with the requirements of the California

RECOMMENDED ACTION
Staff recommends that the City Council adopt the attached
resolution declaring certain roads and parking facilities on
private property subject to the California Vehicle Code.

Enclosed is a copy of the letter you sent me on November 20. I
called Ken Gilbert at the end of the month to inform him that I
wanted to be included in this arrangement. This letter is
confirmation.
We would like the City Council to designate Moorpark Pines
parking areas enforceable for parking and traffic violations. I
think this is a wonderful service for the apartments and the
community.
Also enclosed is a document as proof of my ownership.

The City of Moorpark is in receipt of your letter requesting that
the Moorpark Police Department undertake the enforcement of certain
traffic and parking regulations within the Woodcreek Apartment
Complex.
The California Vehicle Code (CVC) requires that, prior to
undertaking the enforcement of traffic regulations on privately
owned roads and parking facilities, the City Council must conduct
a public hearing on the matter and notify the property owners
affected of the City's intent.
THIS IS TO NOTIFY YOU THAT, pursuant to Section 21107.8 of the CVC,
a public hearing on this matter will be held at a regular meeting
of the Moorpark City Council on January 20, 1993, commencing at
7:00 p. m. at the Moorpark Community Center, 799 Moorpark Avenue,
Moorpark, California. You are invited to be present and to be
heard at said meeting. If you should have any questions, please
give me a call.
