The Act amends civil rights legislation to provide rights to access, employment, telecommunications, public accommodation and transportation to persons with disabilities. The underlying intent of the ADA is equal opportunity, full participation, and independence for persons with disabilities. The regulation pertaining to transportation services requires public agencies providing fixed route bus service to implement complementary paratransit service. Paratransit service is defined as a "demand responsive ", door -to -door transit system. ADA paratransit service is limited to individuals who are functionally unable to use fixed route services. Persons with disabilities are not eligible for paratransit service merely by virtue of being disabled. Under the ADA, an individual must meet established requirements in order to be eligible for paratransit service. The City submitted its original Plan in January 1992. At that time, the City chose to utilize a fixed route /route deviation system to comply with the ADA regulations. When paratransit is implemented in Moorpark, the City's transit system will continue to operate with one bus along the existing route, following the same schedule. Upon request, the bus will deviate from the set route to pick up or deliver a paratransit eligible individual and return tc the same point on the route to continue its run. PAUL W. LAWRASON JR. WOZNIAK Mayor Maya Pro Tern Councilmember Councilmember Councilmember Phaw on Pecyded Papa ADA Paratransit Update January 13, 1993 Page 2 To remain in compliance with the Americans with Disabilities Act, the City is now required to submit a Paratransit Plan update by January 26, 1993, which includes public testimony. The update should address any changes in the Plan since its original submittal. Since the City has not implemented its program, there have not been any significant changes. As proposed by staff, the update will contain the following elements: Progress report on milestones: (see attachment A). Demand Estimates: While the City's demand estimates have not changed, the FTA is requesting that each operator complete a designated form (see attachment B). Budget: (see attachment C). The FTA expressed concerns about the City's statement that the paratransit program would not require additional funds beyond those already allocated for the fixed route system. To address this concern, staff proposes showing costs for staff time and estimated fuel for the paratransit service. This will not mean an increase in the transportation budget but will allow for better tracking of actual costs. Public Participation: In addition to the public hearing, staff proposes the creation of a Paratransit Review Committee charged with the responsibility of reviewing and providing comments on the City's Plan and subsequent updates. The Committee would be comprised of five individuals representing Moorpark's disabled population (1), City Council /Transportation and Streets Committee (1), the Citizens Transportation Advisory Committee (2), and staff (1). The Transportation and Streets Committee (Hunter and Wozniak) reviewed the proposed paratransit update and concurred with staff's recommendations. Recommendation Staff and the Transportation and Streets Committee recommend that Council receive public testimony and approve the City's Americans with Disabilities Act Paratransit Plan Update as identified in the staff report. A w0j 4 A II. PROGRESS REPORT ON MILESTONES The City of Moorpark is behind its original implementation timetable. The delay is a result of a regional effort to coordinate the certification process. The City's revised schedule for implementation is as follows: Develop Eligibility Certification Process - January 1993 The City will be participating in a Countywide certification process designed to provide consistency with all the paratransit operators in the County. The Certification process was recently approved by the City and the Ventura County Transportation Commission. Establish a Paratransit Committee - January 1993 The City has formed a Paratransit Review Committee comprised of individuals representing the disabled population, City Council, Citizen Transportation Advisory Committee, and staff. It will be the responsibility of this committee to review the City's Paratransit Plan and subsequent updates and provide comments.
