Traffenstedt, Senior Planner SST DATE: January 11, 1993 (CC Meeting of 1- 20 -93) SUBJECT: CONSIDER REQUEST BY WILLIAM AND MILDRED LA PERCH FOR THE CITY TO INITIATE A GENERAL PLAN AMENDMENT FOR THEIR 25.73 -ACRE PROPERTY LOCATED AT 7200 WALNUT CANYON ROAD BACKGROUND The attached letter from William and Mildred La Perch requests a land use designation of 1 dwelling unit per 5 acres (Rural Low), which requires a General Plan amendment. The La Perch property currently has a land use designation of Open Space -1 (OS -1), 10 -40 acres /dwelling unit, and the zoning is Rural Agricultural (RA) 10- Acres. Typically, staff does not accept an application for a General Plan amendment unless the City Council concurs with the initiation of the requested amendment. DISCUSSION The La Perch request is for a Rural Low (5 Acres /dwelling unit) land use designation. For consistency purposes, a zone change from RA 10 -Acres to Rural Exclusive (RE) 5 Acres would be required if the land use designation is modified as requested. Since the size of the La Perch property is approximately 25 acres, there would be the potential for a total of 5 lots, versus 2 lots with their current OS -1 designation and RA -10 Acres zoning. The General Plan designations for the adjacent properties are as follows: North - Rural Low (5 Acres /dwelling unit), South - Utilities (Ventura County property includes Waterworks District No. 1 Office) and OS -1 (10 -40 Acres /dwelling unit), East - Specific Plan No. 2 - 475 -712 dwelling units (Overlay designation of OS -1 and Rural Low is maintained until Specific Plan is adopted), and West - Rural Low (west of Walnut Canyon Road). The request for a Rural Low land use designation is consistent with the existing land use designations for the adjacent properties to the north and west and is compatible with the existing land use designations for the properties to the east and south. The property to the west of Walnut Canyon Road is predominantly undeveloped; however, there is an approved tentative map (Tract 4620) which would allow 66 lots with a minimum lot size of 5 acres. WOZNIAK Mayor Mayor Pro Tern Councilmember Councilmember Councilmember The Honorable City Council January 11, 1993 Page 2 The property to the north of the La Perch land is owned by Abe Guny, and was given a land use designation of Rural Low (5 Acres /dwelling unit) in conjunction with the recent General Plan Update. The property to the east is owned by JBR Development Company, and was given a land use designation of Specific Plan No. 2 in conjunction with the General Plan Update (the density range for Specific Plan No. 2 is 475 -712 dwelling units). A portion of the property to the south of the La Perch land was given a Utilities designation in conjunction with the General Plan update, since it is owned by the County of Ventura and contains the Waterworks District 1 office and other County Public Works facilities. There is an additional area of OS -1 land which borders the La Perch property to the south. Based on the land use designations for the surrounding properties to the north, east, and west, staff can support the initiation of a General Plan Amendment for the La Perch land to change the land use designation from OS -1 (10 -40 Acres /dwelling unit) to Rural Low (5 Acres /dwelling unit). RECOMMENDATION Direct staff to accept an application for a General Plan Amendment and Zone Change to change the land use designation from OS -1 to Rural Low and the zoning from RA -10 Acres to RE -5 Acres. The property is "k .`j3 26 acres and is currently operating as a horse ranch where we board, breed and train Arabian and Hanovarian horses. When we moved to Moorpark, the area north of Casey Road was designated as a non - growth, open space land use. All of the surrounding property at that time was zoned OS -10 and OS -20. We assumed that this density would assure us of retaining the rural nature of this area. Recent changes in land use designation have surrounded us with properties zoned as high as 1.6 dwelling units per acre. Our property is bounded by JBR to the east (1.6 DU per acre), Abe Guny (1 DU per 5 acres) on our northern property line, Aspen Ridge (1 DU per 5 acres) to the west of us; and just south of us, beyond the County Water Yard, the Schleve project with extremely high density. So that our property may be in consonance with the surrounding properties, we are hereby requesting that a land use designation of 1 dwelling unit per 5 acres be approved for our property. I am enclosing a topographical map: and with density averaging, the property could easily accommodate that designation. We have no intention at this time of going beyond the change in land use.
