GEDNEY City Treasurer TO: The Honorable City Council FROM: Niall Frit , Director of Community Development DATE: April 15, 1985 SUBJECT: ASSIGNMENT OF IMPROVEMENT AGREEMENTS FROM THE COUNTY AND TRANSFER OF CONSTRUCTION FEES PROPOSED ACTION Authorize the Mayor to sign the attached agreement. BACKGROUND INFORMATION Since the beginning of the fiscal year, the responsibility for public works construction inspection has been transfered in phases from the County to the City. The transfer is now complete and with the attached agreement the County would transfer to the City construction inspection fee deposits that they received prior to July 1, 1984. An issue of discussion between City and County staff has been the responsibility for enforcing or administering deferred construction improvement agreements. It is now recommended that the responsibility for administering those agreements be assigned to the City. Concurrence in the assignment will also have to be obtained from each developer and to the bond issuer. Please have the appropriate individual execute the original and one copy of the Agreement and return to my care as soon as possible . The additional copy is for your records until we send you a fully executed copy for your file . Since you are submitting this Agreement to your Council on April 15, 1985, I will try to put this on our Board of Supervisor' s Agenda for April 16, 1985 . I will keep you advised of any changes to the above schedule and request that you notify me if you have any changes . WHEREAS, City wishes to administer Improvement Agreements and inspect the construction of public improvements within City except for water and sewer facilities , in connection with development which began before City' s incorporation or in the first year immediately thereafter; and WHEREAS, County has adopted refundable Construction Inspection Fees to collect funds from developers to pay County' s cost of providing inspection of public improvements related to land development ; and WHEREAS, the fees collected must be used to pay for inspection of public improvements , including water and sewer facilities ; and WHEREAS, County has no objection to City' s assumption of the Improvement Agreements and responsibility for construction in- spection. NOW, THEREFORE, in consideration of the above information and the covenants and conditions herein contained , the parties hereto agree as follows : 1 . City agrees to accept the assignment of Improvement Agree- ments and the responsibility for inspecting construction of public improvements within City except for water and sewer facilities that are to be operated and maintained by Ventura County Waterworks District No . 1 for all land de- velopments identified in Exhibit "A" . 2 . County agrees to provide a detailed accounting and transfer to City, within 30 days of the date of this Agreement, all the remaining balances of Construction Inspection Fee de- posits , including accrued interest, less the amount necessary for County to complete the inspection of Ventura County Waterworks District No. 1 facilities , for all land develop- ments identified in Exhibit "A" . The estimated amounts of such deposits to be retained by County to complete such inspection, and the actual amount to be transferred to City, as set forth in Exhibit "A" . 3 . City agrees to accept such deposit balances and agrees to restrict the use of these funds to cover City' s cost of pro- viding construction inspection for those land developments identified in Exhibit "A" . . r 4 . City agrees to return any unexpended balances to the re- spective depositors upon developer' s completion and City' s acceptance of the public improvements for which inspection was provided. 5. County agrees to transfer any additional unexpended balances to City upon developer' s completion and County's acceptance of Ventura County Waterworks District No . 1 facilities . Said funds will be: received and used by -City as specified in paragraphs 3 and 4. 6 . The parties understand that additional Construction In- spection Fees may be collected by County or City, if neces- sary, in accordance with the Fee Schedule adopted by County (Resolution No. 222/239 dated 8-31-82) and by City (Resolu- tion No . 84-119 dated 7-18-84) .
