Consider Opposing a Proposal to Transfer Solid Waste
Permitting and Enforcement Authority to the State
As part of the Governor's reorganization plan for combining the
Integrated Waste Management Board and the Department of
Conservation, a proposal has surfaced that would transfer all solid
waste permitting and enforcement authority from existing local
enforcement agencies (LEA) to the state. This proposal is being
pushed by large solid waste industry leaders including Waste
Management Inc.
The Integrated Waste Management Act (AB 939) allows local
governments to either act as their own LEA or to select another
agency to do so. Ventura County cities and the County choose to
have the Ventura County's Environmental Health Department to act as
the LEA for the region. Cities retained land use authority.
LEA responsibilities to permit and regulate solid waste facilities
should be conducted at the local level (city or county) and should
not be transferred to the state. Cities and counties are more in
touch with local climatic, geographic and solid waste conditions
than is the state. In addition, transferring LEA responsibilities
to the state represents a threat to local control.
The League of California Cities is strongly opposing this proposal.
Recommendation
Staff recommends that the City Council oppose the proposal to
transfer solid waste permitting and enforcement authority to the
state, and direct the Mayor to communicate the Council's position
to Governor Wilson, the appropriate legislative representatives,
and to the Integrated Waste Management Board.
