Traffenstedt, Senior Planner DATE: April 8, 1994 (CC Meeting of 4-20-94) SUBJECT: CONSIDER APPROVAL OF AN AGREEMENT WITH THE LEVY COMPANY AND THE APPROVAL OF A PROFESSIONAL SERVICES AGREEMENT WITH AUSTIN-FOUST ASSOCIATES (AFA) , INC. , FOR PREPARATION OF A TRAFFIC STUDY FOR THE SPECIFIC PLAN NO. 1 PROJECT BACKGROUND It is the preference of the Levy Company and staff to have AFA prepare the Traffic Study for the Specific Plan No. 1 project. Because MA is already under contract with the City for all traffic model work, the applicant has agreed with staff's suggestion that the City hire AFA so as to avoid a conflict of interest. Two draft contract agreements are attached to this staff report. The first contract is a joint agreement between the Levy Company and the City for the selection of AFA and the payment of all costs by the Levy Company. The second contract is the agreement between the City and AFA, and includes the scope of work proposal for the Traffic Study work. Since the MA Agreement will be Exhibit "1" to the Levy Company Agreement, with the payment terms as Exhibit "2" , the attachments to this report are included in that arrangement. DISCUSSION The attached draft agreements are based on the agreements recently approved for the Specific Plan No. 8 environmental impact report (EIR) . The Levy Company has elected to directly hire a consultant to prepare the EIR for the Specific Plan No. 1 Project, and has selected Impact Sciences. Development Planning Services (DPS) has been hired by the Levy Company to prepare the specific plan and coordinate the preparation of the EIR and related studies . The attached agreements are for preparation of the Traffic Study only. The payment terms contained in Exhibit "2 " to the Levy Company Agreement itemize all known City and consultant costs related to dst-03-07-94/4:34pmC:\WP51\SP-ACC-RPT.CTR The Honorable City Council April 8, 1994 Page 2 preparation and review of the Traffic Study. Because the actual cost of the Traffic Study work to be done by AFA is $14,500, the City Manager is authorized by the Municipal Code to sign both of the attached contract agreements, if approved by the City Council. RECOMMENDATION 1. Approve an Agreement with the Levy Company for preparation of the Traffic Study for Specific Plan No. 1 by AFA, subject to final language approval by the City Manager, and authorize the City Manager to sign the Agreement. 2 . Approve a Professional Services Agreement with AFA for preparation of the Traffic Study for the Specific Plan No. 1 Project, subject to final language approval by the City Manager, and authorize the City Manager to sign the Agreement. (AFA) is pleased to propose a scope of services to prepare a traffic study for the Specific Plan No. I area located in the northwest portion of the City of Moorpark. The traffic study is intended for submittal to the City in support of the overall Environmental Impact Report (EIR) being prepared for the project. We have prepared our suggested scope of services based on discussions with City Staff and Dennis Hardgrave of Development Planning Services (DPS), the developer's representative, as well as our own knowledge and experience regarding circulation issues in the city. The individual tasks comprising the scope of work for the study are described as follows: TASK 1. Available Traffic Study Assimilation and Review. Review existing conditions traffic data that is available, and determine the need for any additional traffic data required. TASK 2. Impact Analysis. A trip generation, distribution, and intersection impact analysis associated with the land use and circulation plan will be carried out. Traffic conditions will be analyzed for both a short-range and a long-range setting. Short- range conditions based on the year 2000 version of the City's traffic model will be analyzed for two land use settings (typically with and without a first phase of the project), and long-range (year 2010) traffic model forecasts will be used to analyze conditions with and without full development of the proposed project. In addition. up to two short-range circulation alternatives and up to three long-range circulation ' alternatives will be examined. TASK 3. Mitigation Measures. This task will identify and evaluate suitable mitigation for project traffic at intersections where the City's standard level of service is not provided and/or maintained. City of Moorpark March 1, 1994 Page 2 TASK 4. Special Issues. This task will address special circulation issues,such as future new roadways (SR-11S, SR-23, and the Broadway extension), and the relationship between the Specific Plan area and General Plan circulation element. TASK 5. Local Circulation. In this task the local circulation system will be reviewed. Subject areas to he addressed will include access, signalization, and safety. TASK 6. Traffic Study Report. This will be prepared in a format suitable for incorporation into the EIR, and will provide a comprehensive description of the impact analysis and of the findings and recommendations for project mitigation measures. The work is proposed to be completed on a time and materials basis for a fee not to exceed $14,500 based on the estimated personnel allocation and cost per task, as shown in Table 1. This estimate includes two work sessions during the course of the study, but does not include attendance at public hearings that may take place during or at the end of the study. Costs for attendance at any such meetings would be charged on a time and materials basis and would be provided upon request. Included on the cost estimate summary table is a separate cost item representing the City's fee for providing traffic model forecast data. The fee amount is based on the number of traffic forecast settings described earlier in work task #2, including four land use analysis model runs (short-range and long-range with and without project land use) at$750 each and five circulation alternative model runs at $500 each. A $1,000 contingency has also been added at the City's request for additional model runs that may be required for the analysis. The actual cost for processing multiple model runs for a project of this type may be somewhat less per run since preparation tasks do not necessarily need to be repeated once a first run has been completed. Project Manager for AFA's work effort will be myself and 1 will be supported by Catherine Lawrence, an AFA Traffic Engineering Associate with extensive experience in the preparation of traffic impact analyses in Ventura County. Joe Foust, one of AFA's principals,will also assist with the work effort in an advisory role. Work shall begin immediately upon notice to proceed with a draft report completed within 45 days following receipt of the City's specifications for carrying out the traffic model runs.
