SUBJECT: Request for Support of AB 2972 Enhancing
Civil Liability Protection for Local
Government
Larry Van Nostran, President of the Executive Committee of the
Southern California Joint Powers Insurance Authority (SCJPIA),
has requested in his letter of April 13, 1994, your support of AB
2972. His letter is attached along with -3 copy of his letter of
support to the California Assembly
AB 2972 was introduced by Assembly Member Fred Aguilar, (R)
Chino, in an effort to preserve the resources of local
governments. As noted in the SCJP(A :Letter dated April 13, 1994
to the Assembly, this bill has man; facets all directed toward
safeguarding the financial resourcf is of !-)cal governments.
Recommendation
Staff recommends City Council support of AB 2972 and requests
that the Mayor be directed to write to the Assembly indicating
the Moorpark City Council's pos_iti� !j o!'I this legislation.

Attached is a copy of a letter forwarded to the California State Assembly in
support of AB 2972 as introduced by Assembly Member Fred Aguiar. This
measure would enhance civil liability protection for local government.
Letters of support from your city to the Assembly Judiciary Committee and
copies to the League of California Cities would be greatly appreciated, and
could be of benefit to all of us in local government.

municipalities is important. It is our understanding that AB 2972 will do the following:

entity or public employee shall be decided by the court as a matter of law.

• Add street lighting to the list of traffic control items for which there is an absolute
immunity.
• Provide a public entity with additional design immunity with respect to older
infrastructure improvements that were reasonable when approved, but have since
become subject to overuse or would now be constructed in accordance with a
different standard.

Expand natural condition immunity to all public property, regardless of safety services
provided.
