Aquilera, Director of Community Developmene DATE: April 28, 1994 (CC Meeting Q5--Q4,-94) SUBJECT: STATUS REPORT ON THE NEIGHBORHOOD PRESERVATION PROGRAM The City Council adopted the attached Ordinance No. 164 on May 12, 1993; it became effective on June l:, 1993. The Council instructed staff to implement the Neighborhood Preservation Program, however, following the resignation of nftic-er Frank Mancino, the Code Enforcement Division staff was reduced to one person. It was necessary to wait until a new Cede Enforcement Officer (A. J. Alldredge) was hired to begin the implementation. Staff advised the Council of its ntent to implement the program via a memorandum dated April 8 11114 attached). Letters were mailed to the first ieighborhood on March 31, 1994, and the inspections began on April 18, 1994. The last inspection for that neighborhood was conduc:te(i or, April 25, 1994. . Letters for the next target neighborhood have been mailed on April 29, 1994, and inspections will begin on May r , , 9')4 . RECOMMENDATION Receive and file this report_ Attachment A: \JRA. CC \HGH.PRE S�� v ORDINANCE NO.164 AN ORDINANCE OF THE CITY OF MOORPARK CALIFORNIA, ADDING CHAPTER 8.48 TO THE MOORPARK MUNICIPAL CODE RELATIVE TO PROPERTY MAINTENANCE STANDARDS AND RE- TITLING CHAPTER 8.04 OF THE MOORPARK MUNICIPAL CODE WHEREAS, it is the City's interest to amend the Municipal Code to include specific language within the Code to define a public nuisance, controlled through property maintenance. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. THE MOORPARK MUNICIPAL CODE IS AMENDED BY ADDING CHAPTER 8.48 TO READ AS FOLLOWS: CHAPTER 8.48 PROPERTY_ MAINTENANCE ection 8.48.000 APPLICABILITY. The following identificatio-: of nuisances and abatement procedures pertain to this Chaptei only. Section 8.48.010 ABANDONED,_ VACANT STRUCTURES, OCCUPIED STRUCTURES OR UNATTENDED LAND. it is declared a public nuis,ince and it is uniawfui for any person owning, leasing or having charge of any structure or unattended land in the City tt maintain such structure or unattended land in suc:n manner that an,, oi the following conditions are found to exist thereon: A. Attractive nuisance dangerous to children or injurious to health, indecent, or offensive to the senses, in the form of abandoned and broken equipment, unprotected or hazardous pool, pond or excavation or neglected machinery. Any discarded, used, secondhand, salvaged or abandoned boxcar, refrigerator car, motor bus body or similar means of conveyance or a structure of + similar nature or construction used for place of habitation residence or business in the city. The maintenance of any structure in a state of substantial disrepair, such as a broken window, roof in disrepair, wood or paper sign in deteriorated condition, damaged or unsafe porch or wall, broken step, or other disrepair not otherwise constituting a violation and which is observed from a public right -of -way or observed from neighboring properties, where such condition would depreciate the property values of the surrounding properties. N. The substantial lack of maintenance of the grounds upon which a structure exists, where said grounds are observed by the public from a public right -of -way or observed from neighboring properties, where such condition would depreciate the property values of surrounding properties. O. Maintenance of a structure in such condition as to be detrimental, injurious to hearth, or has an offensive odor. P. Recreational Vehicles defined pursuant to the Health and Safety Code as a motor home, travel trailer, truck camper, or camping trailer, with or without motive power or trailer (as defined within the Vehicle Code) used as a place of habitation, as a residence, or as legal nonconforming pursuant to the City's Zoning Ordinance. 8.48.020 NUISANCE, VIOLATION AND ABATEMENT A nuisance as defined in Sect.on 8.48.010 is hereby declared a violation and prosecution shall be as outlined within Chapter 1.12 of the Moorpark Municipal Cod-. SECTION 2. Title 8, Healtli and Safety, cf the Moorpark Municipal Code, Chapter. 8.04 ent:it:ed Nuisances, is hereby re- titled from Nuisances to Pub'i( Health. SECTION 3. If any provisi,_)n of this ordinance is for any reason held to be invalid or unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity or constitutionality of the remaining portions of this Ordinance. The City Council hereby declares '.hat it would have passed and adopted this Ordinance and etch and all provisions thereof, irrespective of the fact that �Iny )ne or more of said provisions may be declared invalid or unconstitutional. We will begin our formal inspections on April 18, 1994, in the first targeted neighborhood, and the second set of notices will be mailed to the next targeted neighborhood that same week. In cooperation with Dave's Towing, we are also offering residents the opportunity of free removal and disposal of unwanted passenger vehicles during the entire montl. c >f April 1994. Storage of any unattached trailer, camper, or mobile home is prohibited on public streets for more than 72 hours at all times. 3. OTHER "There are many more types of violations, such as conducting an illegal business from a home, illegal grading, loud noise, etc. Please contact City staff if you need more information. SUGGESTIONS kll residents should attempt to maintain good relations with their neighbors through common courtesy, mutual respect, and understanding. Ba- sic differences in language and or culture should not be the cause of problems. What should not be tolerated is an actual violation of law. Here are some tips that you may wish to use when you encounter a violation or problem situation: 1. Establish a positive association with your neighbors. 2. Communicate Language barriers can be overcome by obtaining the assistance of a mutual friend who speaks both languages. 3. Exercise common courtesy. Allow people to park in front of their own homes. Che City of Moorpark is pleased to announce th; initiation of the Neighborhood Preservation Pro - aram in March 1994, which will involve and assist residents in maintaining their neighborhoods it dean and safe conditions. WHAT IS THE PROGRAM ABOUT ? It is a Neighborhood/City Partnership. It is based on a cooperative effort between city staff and residents, working together, to identify areas in the City which either by lack of knowledge, or neglect are in need of upgrading and maintenance. The main focus will be to identify, and through volun- tary compliance, abate problems throughout the City. HOW WILL IT WORK? Beginning in March 1994, Code Enforcement Officers will begin conducting inspections in des- ignated areas of the City. When violations are identified either through observance or a complaint, a notice of violation will be sent to the resident/owner advising them of the specific problem and requesting its remedy within a reasonable amount of time. When that date arrives another inspection will be conducted to confirm if compliance has been achieved. Depending on the status, other actions will be considered. These can include closing the case, extensions, office hearings, or as a last result, issuance of citations. WHAT ARE THE BENEFITS OF SUCH A PROGRAM? Residents and property owners will reap all the benefits which consist of the following: 1. HIGHER PROPERTY VALUES. Keeping your property safe, clean, and in compliance with all applicable Municipal and Zoning Codes, will assure that you will receive the most out of your invest- ment. 2. A SAFE AND HEALTHY ENVIRONMENT. Many health problems and injuries are costly and avoidable.
