Gilbert, Director. of Public Works DATE: April 28, 1994 (Council Meeting 5 -4 -94) SUBJECT: Consider a Resolution Restricting the Parking of Unattached Trailers and Semitrailers on City Streets BACKGROUND This matter was considered by the City Council on March 2, 1994, and referred to the Transportation and Streets Committee for review and input. This report and the attached Resolution has been revised to incorporate the changer suqqested by the Committee. DISCUSSION A. Seventy -two Hour Limit Section 10.04.220 of the Moorpark Municipal Code prohibits the improper storage of vehicles on City Streets. Pursuant to this Section a vehicle may not park in one location for more than seventy -two (72) hours. One of the methods of determining if a violation of this Section has occurred, is noting whether or not the reading on the vehicle's odometer has changed. B. Improper Storage of Unattached and Semitrailers on City Streets In that trailers and semitrailers do not have odometers, it is not possible to demonstrate that an unattached trailer or semitrailer has not been moved. Accordingly, the City has found it difficult to impossible to enforce the seventy -two (72) hour parking limitation on unattached trailers and semitrailers. The subject resolution (attached) will resolve this problem by prohibiting the parking of unattached trailers and semitrailers on a City streets, except as or- )vided for in the Resolution. ,nrntor Unattached Trailers April 6, 1994 Page 2 C. Prohibiting the Parking Unattached Trailers and Semitrailers Section 22507 of the Califc >rrni a vehicle Code r CVC) states in part as follows: "Local authorities may, by ordinance or resolution, prohibit or restrict the stopping, parking or standing of vehicles, including but not limited to, .. , on certain streets or highways, ... during all or -ertain hours of the day." In a recent decision, the court:, have upheld the right of local authorities to prohibit or restrict the parking of specific types of vehicles on City streets it is the opinion of the City Attorney that the City may use this provision of the California Vehicle Code to urohib)t the parking of unattached trailers and semitrailers or "ity ,treets. If adopted, the attached resolution will establish a parking prohibition for trailers and semitraiLers on any street within the City of Moorpark, with the Fol.owing exceptions: 1) any trailer or semitrailer attachedl to a vehicle capable of moving the trailer or sem i tr .i i l-�r 2) any trailer or semitrailer the process of being loaded or unloaded; and, 3) any trailer displaying a Temporary Trailer Parking Permit. D. Temporary Trailer Parking Permits At the suggestion of the Transportation and Streets Committee (Mayor pro tem Hunter and Councilmember Wozniak), the attached resolution was revised to include provisions for the issuance of permits to allow for the storage of trailers (not semitrailers) on the street in front of a residence for an extended period of time for the purpose of 1 ) allowing the resident to load and unload the trailer and 2) permitting the temporary parking of a guest's trailer. The attached resolution sets forth certain minimum standards to be followed in issuing Temporary Trailer Parking Permits. Those standards are restated as folLows: a) a permit may be issued to An unattached trailer when the owner or renter of said trailer (hereinafter "PERMITTEE") requests said Permit in 'c -illow for the parking of 'nter Unattached Trailers April 6, 1994 Page 3 said trailer on the street in front of the PERMITTEE'S residence for an extended period of time for the purpose of loading and /or unloading: b) a permit may also be issued to allow a quest of the PERMITTEE to park a trailer on the street in front of the PERMITTEE'S residence; c) in order to be valid, a permit must state the license number of the trailer, the address of the PERMITTEE and the dates that the permit is valid7 d) in order to be valid, a permit must be affixed to and displayed in a conspicuous place on the trailer; e) the maximum permit period shill not exceed two three (3) day periods; f) no more than twelve (1?) permit- may be issued to any PERMITTEE during any one year peri.ad; g) no more than one (1) permi, may ,)e issued to a PERMITTEE during any given period; h) the permitted trailer must b( legally parked in front of the address of the permittee i) a permit issued to a trailer does not exempt the trailer, the PERMITTEE or the registered owner of the trailer from any established parking restrictions, including parking prohibitions established fc, the purpose of facilitating street sweeping E. Motor Homes As stated above, the attached resolution is designed to restrict the parking of vehicles which do not have odometers. It is not designed to address any problems which may be caused by the parking of motor homes on City streets. It is the intent of staff to review this issue and report back to the City Council at a later date, regardinca possible means to address such problems. cnnotor Unattached Trailers April 6, 1994 Page 4 F. Signs In order to be effective, it will be necessary to post signs giving notice of this parking restriction. In lieu of posting such signs at frequent intervals on every street in the City, the resolution directs that. such signs be placed at all entrances to the City and at certain other locations as deemed appropriate by the City Manaqer to provide for adequate notice. In addition, the Resolution stipulates the minimum size of the sign and the sign lettering to ensure that such signs are readable by passing motorists. G. Notice The Transportation and Streets Committee suggested that, if adopted, notice of this resolution should be sent to the known registered owners of all trailers who reside within the City of Moorpark. This would be accomplished by legally accessing the records of the California Department of Motor Vehicles (DMV) and /or by compiling a list from -3 windshield survey of the City. RECOMMENDED ACTION Staff recommends that the City Councij take the following actions: 1. Adopt the attached resolution restricting the parking of unattached trailers and semitrailers )n City streets. 2. Direct staff to send a written notice of this action to all registered owners of trailers who reside within the City. :rnotor RESOLUTION NO. 94 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, PROHIBITING THE PARKING OF UNATTACHED TRAILERS AND SEMITRAILERS ON CITY STREETS WHEREAS, Section 22507 of the California Vehicle Code (CVC) provides for the prohibition or restriction of the stopping, parking or standing of vehicles )n •,ertain streets or highways during all or certain hours of the dav; and, WHEREAS, it has been determined that such parking restrictions may be made to apply to specifi( tyres of vehicles, as specified by the local agency; and WHEREAS, the City Council has determined that the public health and safety would be better served if the parking of unattached trailers and semitrailers on City -,treets were restricted; and, WHEREAS, CVC Section 22507 al:,o provides for the issuance of permits exempting certain vehi.•?.es from specified parking restrictions; and, WHEREAS, the City Council ha determined that such parking permits, making trailers exempt from said parking restrictions under certain specified conditions, should be made available to and, upon request, issued to the -wne- of a trailer. NOW, THEREFORE, THE CITY COUNCIL OF' THE CITY OF MOORPARK, CALIFORNIA, DOES HEREBY RESOLVE, I )FTERMINE AND ORDER AS FOLLOWS: SECTION 1. That, except as rioted in Section 2 below, the parking of any trailer or semitrailer upon any highway, street, alley, public way or public. place withiir the City of Moorpark is hereby prohibited. SECTION 2. That said parking prohibition shall not apply to any trailer or semitrailer meeting tho criteria for exemptions, said criteria being defined as follows a) any trailer or semitrailer which is at all times while so parked attached to a vehicle capable of moving the trailer or semitrailer in a normal manner upon the highway, street, alley, public way or pubic plate. b) any trailer or semitrailer whicrn is in the process of being loaded or unloaded. c) any trailer which displays a 1'emporary Trailer Parking Permit issued by the City in accordance with the provisions set forth in SectioTi 3 of the s 1 <esolut on. Resolution No. Page 2 SECTION 3. That the City Manager shall establish procedures for the issuance of Temporary Trailer Parking Permits, said procedures to include the following minimum provisions: a) a permit may be issued to an unattached trailer when the owner or renter of said trailer (hereinafter "PERMITTEE ") requests said permit in order to allow for the parking of said trailer on the street in front of the PERMITTEE'S residence for an extended period of time for the purpose of loading and /or unloading! b) a permit may also be issued to allow a guest of the PERMITTEE to park a trailer on the street in front of the PERMITTEE'S residence; c) in order to be valid, a permit must state the license number of the trailer, the address of the PERMITTEE and the dates that the permit is valid; d) in order to be valid, _i permit must be affixed to and displayed in a conspicuous (lace on the trailer; e) the maximum permit period shill not exceed two three (3) day periods; f) no more than twelve (1.�) permits may be issued to any PERMITTEE durinq any one year period; g) no more than one (1) permi? may :)e issued to a PERMITTEE during any given period; h) the permitted trailer must b( 'Legally parked in front of the address of the permittee. i) a permit issued to a trailer does not exempt the trailer, the PERMITTEE or the registered owner of the trailer from any established parking restrictions, including parking prohibitions established Eor the purpose of facilitating street sweeping. SECTION 4. That the City Manager is directed to place and maintain signs giving notice of said parking prohibition at a conspicuous location at each entrance to the City, as well as at other additional locations as deemed necessary and appropriate by the City Manager, to facilitate the proper and adequate notice of said parking prohibition.
