Lease a Portion of Surplus Freeway Right -of -Way ..I? lei/
Adjacent to Griffin mark for Park Use GGGG
BACKGROUND
1. Caltrans recently completed the construction of the Route
118 / Route 23 freeway connector project. Caltrans is now
in the process of preparing a design for the construction
of freeway landscaping for that project. The construction
of these improvements is expected to begin later this
year.
2. In the process of reviewinq the design for the freeway
landscaping, staff noted that the design for the freeway
landscaping included a flats "useable" area within the
freeway right -of -way immediately adjacent to Griffin Park
(see Exhibit 1). The approximate size of this "flat" area
is one hundred twenty feet by four hundred fifty feet
(120' x 4501), or 54,000 sq ft (1.24 ac.).
3. Staff contacted Caltrans and suggested that the flat area
at the "toe" of the slopes supporting the freeway off -ramp
and Collins Drive overpass would be put to better use if
it were added to the adjacen+ (`ity park. Caltrans agreed
with this concept.
DISCUSSION
A. Park Expansion
If approved, the subject property would be added to
Griffin Park. This would provide more useable are for
park use, improve the aesthetics of the area and reduce
the amount of landscaped area to be maintained by
Caltrans. It is proposed that, if added to the park, the
area be planted in turf to maximize the flexibility of its
use by people visiting the park. Improvements to be
undertaken by the City would include the relocation of the
existing chain link fence. There are sufficient monies in

the Campus Park Zone of the Park Improvement Fund for this
purpose. If the lease is approved, an appropriation will
be requested based on a final cost estimate for these
improvements to be prepared by staff.
B. Purchase vs Lease
It has been proposed to Caltrans that the City purchase
the area in question. At the present time Caltrans has
only agreed to leasing the property to the City. City
staff is still negotiating with Caltrans regarding the
possible purchase of the property,
It is the recommendation of staff that the City pursue the
transfer of the use of this property to the City in what
ever form possible. It would be preferable to accomplish
this transfer prior to the proposed construction of the
freeway landscaping project. To do this, it is necessary
that Caltrans receive some form of a commitment from the
City in the very near future,
RECOMMENDATION
Staff recommends that the City Counc3.1 take the following
actions:
1. Approve, in concept, the use of a portion of surplus
freeway right -of -way adjacent to Griffin Park for park
use.
2. Direct staff to proceed with negotiations to acquire the
property in question.
3. Approve the lease of the property, if necessary, and
authorize the Mayor to sign necessary lease documents
subject to final language approval by the City Manager and
the City Attorney.
