Gilbert, Director. of` Public Works May 23, 1994 (Council Meeting 6 -1 -94) Consider a Resolution Restricting the Parking of Unattached Trailers and Semitrailers on City Streets BACKGROUND This matter was considered by the City Council on March 2, 1994, and referred to the Transportation and Streets Committee for review and input. The matter was then reviewed by the City Council on May 18, 1994, and continued to the Jure 1.,. 1994, meeting. DISCUSSION A. Seventy -two Hour Limit Section 10.04.220 of the Moorpark Municipal Code prohibits the improper storage of vehicles on City Streets. Pursuant to this Section a vehicle may not park, in one location for more than seventy -two (72) hours. One of the methods of determining if a violation of this Section has occurred, is noting whether or not the reading on the vehicle's odometer has changed. B. Improper Storage of Unattached Trailers -._and Semitrailers on City Streets In that trailers and semitrailers do riot have odometers, it is not possible to demonstrate that an unattached trailer or semitrailer has not been moved. Accordingly, the City has found it difficult to impossible to enforce the seventy -two (72) hour parking limitation on unattached trailers and semitrailers. The subject resolution (attached) will .resolve this problem by prohibiting the parking of unattached trailers and semitrailers on a City streets, except as povided for in the Resolution. unmotor Unattached Trailers June 1, 1994 Page 2 C. Prohibiting the Parking Unattached and Semitrailers Section 22507 of the California Vehicle Code (CVC) states in part as follows: "Local authorities may, by ordinance or resolution, prohibit or restrict the stopping, park=ing or standing of vehicles, including but not limited ro, on certain streets or highways, during all or certain hours of the day." In a recent decision, the courts have upheld the right of local authorities to prohibit or restrict the parking of specific types of vehicles on City streets Ft is the opinion of the City Attorney that the City may use this provision of the California Vehicle Code to prohibit the parking of unattached trailers and semitrailers on r t:y treets. If adopted, the attached resolution will establish a parking prohibition for trailers and semitrailers on any street within the City of Moorpark, with the fo]Low7.ng exceptions: 1) any trailer or semitrailer ,attached to a vehicle capable of moving the trailer or semi.t,ai1,r, 2) any trailer or semitrailer the }process of being loaded or unloaded; and, 3) any trailer displaying a Temporary Trailer Parking Permit. D. Temporary Trailer Parking Permits At the suggestion of the Transportation and Streets Committee (Mayor pro tem Hunter and Counc:ilmember Wozniak), the attached resolution was revised to include provisions for the issuance of permits to allow for the storage of trailers (not semitrailers) on the street in front of a residence for an extended period of time for the purpose of 1) al owing the resident to load and unload the trailer and 2) perm=itting the temporary parking of a guest's trailer. The attached resolution sets forth certain minimum standards to be followed in issuing Temporary Trailer Parking Permits. Those standards are restated as fall < >ws:. a) a permit may be issued to an unattached trailer when the owner or renter of said trailer (hereinafter "PERMITTEE") requests said permit in order to allow for the parking of unmotor Unattached Trailers June 1, 1994 Page 3 said trailer on the street in front of the PERMITTEE'S residence for an extended period of time for the purpose of loading and /or unloading; b) a permit may also be issued to allow a guest of the PERMITTEE to park a trailer on the street in front of the PERMITTEE'S residence; c) in order to be valid, a permit must state the license number of the trailer, the address; of the PERMITTEE and the dates that the permit is valid; d) in order to be valid, a t:)ermit must be affixed to and displayed in a conspicuous glace on the trailer; e) the maximum permit period sY,-311 not exceed two three (3) day periods; f) no more than twelve (12) permits may be issued to any PERMITTEE during any one yer period; g) no more than one (1) perms may k)e issued to a PERMITTEE during any given period; h) the permitted trailer must be legal:'ky parked at a frontage of the address of the permitter i ) a permit issued to a trailer does not exempt the trailer, the PERMITTEE or the registered owner of the trailer from any established parking restrictions, including parking prohibitions established fr�r the purpose of facilitating street sweeping E. Motor Homes As stated above, the attached resolution is designed to restrict the parking of vehicles which do not have odometers. It is not designed to address any problems which may be caused by the parking of motor homes on City streets. It is the intent of staff to :review this issue and report back to the City Council at a later date, regarding possible means to address such problems. unmotor Unattached Trailers June 1, 1994 Page 4 F. Signs In order to be effective, it will be necessary to post signs giving notice of this parking restriction. In lieu of posting such signs at frequent intervals on every street in the City, the resolution directs that such signs be placed at all entrances to the City and at certain other locations as deemed appropriate by the City Manager, to provide for adequate notice. In addition, the Resolution stipulates the minimum size of the sign and the sign lettering to ensure that such signs are readable by passing motorists.. G. Notice The Transportation and Streets Committee suggested that, if adopted, notice of this resolution should be sent to the known registered owners of all trailers who reside within the City of Moorpark. At its May 18, 1994, meeting, the City Council directed staff to compile cost: to send a notice to all City residents advising the public of a number of matters including: • these trailer / semitrailer parking restrictions; • street sweeping parking restrictions; • reporting inoperative street lights; • stormwater quality regulatia.)ns (NPDES); etc. Staff has estimated that such a double -sided one page mailer in an envelope, sent to all addresses within the City, would cost approximately $2,500. H. City Attorney Review The City Attorney has revieweri this report and the attached Resolution. RECOMMENDED ACTION (Roll Call Votel Staff recommends that the City Council take the following actions: 1. Adopt the attached resolution restricting the parking of unattached trailers and semitrailers on City streets. 2. Approve an appropriation of funds and a budget amendment of $2,500 (Acc. # 03- 142 -624) for the mailing of a notice to all residents regarding the subject parking restrictions and other public information items. unmotor
