Aguilera, Director of Community Deyelopmentl� Kathleen Mallory Phipps, Associate Planner PkP DATE: April 30, 1993 (CC meeting of May 5, 1993) SUBJECT: RESCIND ORDINANCE NUMBER 154 (MCDONALD'S CORPORATION ZONE CHANGE ZC 93 -2) AND ADOPT THE ATTACHED ORDINANCE DESIGNATING THE ZONING ON A PORTION OF ASSESSOR'S PARCEL NUMBER 512 -0 -150 -380 (MCDONALD'S CORPORATION SITE) AS COMMERCIAL PLANNED DEVELOPMENT (CPD) BACKGROUND On November 4, 1992, the City Council adopted Ordinance Number 154 which changed the zoning on 43,540.20 square feet (less than one acre) of land located on the Northeast corner of Spring Road and New Los Angeles Avenue (McDonald's Corporation project site) from Residential Planned Development (RPD) to C -2 (General Commercial) . However, the intended zone designation for this parcel was Commercial Planned Development (CPD) . The remainder of land, Assessor's Parcel Number 512 -0 -15 -380 and 720 or 2.85 acres of land, were rezoned to CPD as part of the City's follow up action to revised the zoning consistent with the updated Land Use Element. DISCUSSION Since it is the City's policy to re -zone all new commercial sites to CPD, on April 5, 1993, the Planning Commission considered the proposed zone change and recommended the rescission of Ordinance Number 154 and adoption of the attached Ordinance designating the zoning on the subject parcel as CPD. The CPD zone designation is consistent with the site's General Plan designation of C -2. RECOMMENDATIONS 1. Open the public hearing and accept public testimony. 2. Determine that modification to the City's Zoning Ordinance is categorically exempt pursuant to the State CEQA Guidelines, Section 15061(b)(3) in that the proposed amendment does not have the potential for causing a significant effect on the environment.
