SUBJECT: Farmer's Market, Item 8.E. ; Staff Report Revision
Please find attached a revised report concerning Item 8.E. intended
by staff to replace the previous report submitted to the Council on
Friday, September 17, 1993 . The revisions are minor and are the
result of a clerical and computer problem which occurred while
making final changes to the report.
Revisions include: 1) the "Recommendation" which now specifies that
the Council approve the proposed location of the event as well as
the other items previously requested, and; 2) the "Discussion"
portion concerning business complaints about the event has also
been slightly modified.
Staff apologizes for this mistake. Please feel free to contact me
if you have any questions or concerns.

SUBJECT: Consider Approval of the Proposed Certified Farmer's
Market, to be Held each Saturday afternoon in the north
Metrolink Parking Lot, (north Lot)
The following report will provide the conditions developed by staff
to allow the proposed Certified Farmer's Market ("Market") to occur
on High Street in the north Metrolink Parking Lot, on Saturdays
from 3:00 P.M. to 7:00 P.M. . The Market would like to open on
October 9, 1993.
Background
On July 21, 1993 , the Chamber of Commerce proposed to the City
Council that a Farmer's Market be considered each Saturday on High
Street. This request was made in response to the City's request of
the Chamber that they plan events that attracted people to downtown
Moorpark. The Market plans to have between 15 and 20 vendors, all
selling goods that they have grown or made, to occupy the most
westerly section of the north Metrolink parking lot. No
entertainment has been planned, but eventually, they hope to have
a small musical group accompany the Market. The Chamber's proposal
with a tentative list of goods to be sold, attached layout and
proposed sign concept is provided in Attachment "A" .
The proposal is being presented by the Chamber and Cynthia Korman,
who runs the Market in Ojai. Ms. Korman has addressed many of the
same concerns expressed by Moorpark business people and the City
with her project in Ojai.
Between July 21 and August 26, staff met with representatives from
the proposed Market and the Chamber of Commerce, received feedback
from various City departments, and developed a report to the
Council's Economic Development Committee, (Councilmembers Hunter
and Perez, Councilmember Hunter could not be at the meeting, and
Mayor Lawrason who could not attend as the alternate did provide
input for the Committee's discussion) .
At the Committee, the location of the Market was considered as well
as the impact that the proposed event would have on the downtown
merchants. It was also presented that the Committee would like the
proposal to be handled by staff like any other private enterprise
requesting to have a special event in the City.
The Committee appeared to be satisfied with conceptual descriptions
of the draft conditions that would be applicable to the Market.
These conditions are now formalized and presented in Attachment
"B" . The only outstanding concern at that time was the issue
related to public access to parking in the Metrolink lot, and the
direction received was to try and find a different location.
Staff met again with the representatives from the Chamber of
Commerce and the proposed Farmer's Market and evaluated various
alternative locations within the downtown area. To receive the
necessary agricultural permits, the Market has to be located on
asphalt or gravel. Closing Magnolia Avenue was carefully
considered, but property owners in that area require access to and
from their driveways which could make the Market vulnerable to
pedestrian/vehicular traffic conflicts. The south lot at the
Metrolink station was also considered, but because traffic would be
forced to enter and leave the Market via Moorpark Avenue, this
option did not satisfy the Chamber's need to attract business to
High Street.
Discussion
Attachment "B" are the conditions developed by the Department of
Community Development and Administrative Services which are
intended to assure that this event would have a minimal adverse
impact on residents and businesses owners. Verbal confirmation has
been received from Ms. Korman, the Fire Department and the Moorpark
Police who have agreed that this event under these conditions poses
no serious threat to the success of the event or related health and
safety matters at this time.
The most significant concern expressed by the Moorpark Police
Department is that they cannot tow vehicles from the Metrolink lot,
which means that some accommodations by the Market would have to be
considered to allow persons arriving on the afternoon AMTRACK to be
able to have access to their cars and be able to leave at will,
(this stipulation would also apply to anyone parking there and
visiting shops on High Street) .
In discussions with Ms. Korman, this issue is similar to the
situation in Ojai where a public lot is used for the Market, and
she is prepared to work around parked cars, and allow pedestrians
and train passengers who arrive after the Market is set up to have
access to their cars and be able to leave. As proposed, the north
Metrolink parking lot would be closed with a rope to parking during
the event, however, there would be ample parking available on High
Street and in the south Metrolink lot if needed.
Signs are proposed to be posted in front of the Metrolink lot on
Fridays announcing the event. A sign permit will be issued for the
Market which has proposed three and possibly four signs, using the
same conceptual design as used in Ojai, and provided in Attachment
"A" . They have requested to place temporary signs at both the

eastern and western entrances from state highways onto High Street,
and to place one in front of the north Metrolink parking lot.
Staff mentioned that parking would not be prohibited prior to the
event on Saturdays, but perhaps a sign warning persons parking in
the lot that the event will be occurring on a permanent basis could
evolve. A permanent sign is being developed by the City of Ojai
for the Ojai Market.
Competition from the Market to local businesses cannot be avoided,
but the Market would like to promote High Street in conjunction
with their event. Ms. Korman has proposed using a map of the High
Street merchants as a promotional flyer, and perhaps offering
coupons to the local shops from the Market. To assure that all
concerns are addressed, each business on High Street will be
contacted via a hand delivered letter by Ms. Korman. If needed,
staff, Ms. Korman and concerned parties would meet in an attempt to
mitigate concerns.
Only those who make their goods can participate in the "Certified"
Farmer's Market. Therefore, the concept of allowing local
businesses to have a space in the Market is unlikely. Because of
this requirement, the Market offers goods which are unique to the
area. For example, flowers are typically a big sales item at a
Farmer's Market, and they are very different from the types of
goods offered by a florist, (hand-cut flowers versus an arrangement
of flowers, with no gifts or cards sold at the Market) . To
eliminate a type of good sold at the market based on a concern from
a local shop owner, could eventually lead to the elimination of the
Market, (i.e. , there is a produce store currently being developed
on Walnut Street) .
Staff researched this issue with the Chamber of Commerce in Ojai,
Ventura, Camarillo, Thousand Oaks and Calabasas. A unanimous
response was that the Markets were a benefit to each community and
surrounding businesses. In Ojai, when one shop complained about the
parking and the Market blocking public access to their store, an
unsolicited petition of 22 Ojai businesses in support of the Market
was given to the Ojai Council .
Staff has spent approximately 12 hours on this project through
Friday, September 10, which when combined with the cost of the Zone
Clearance and Sign Permit would equal and expense of $966. This
cost will increase as a result of developing the staff report and
finalizing the details for this event. In treating this
application as staff would a private business, all expenses would
be recovered. In addressing this matter with the Chamber of
Commerce, representatives expressed that this proposal was
developed in response to the City's requirement, and did not feel
that a bill from the City could be justified. In discussing this
matter with Ms. Korman, she described how other cities including
Ojai waived the permit fees, donated the land and helped to promote
the initiation of the event. Ms. Korman is hopeful that the City

would make the same considerations.
Reportedly, it takes two years of established business to make a
profit at this endeavor, and the City would be prolonging this
process and/or placing it at risk of surviving if the total
expenses were applied to the application. Staff has conditioned
the Market to reimburse the City for any expenses incurred after
the initial issuance of the permit, which includes changes to the
proposed use of the site.
The time line for this event is to be able to obtain related
permits and establish the business and vendors for the Market by
October 9. The Chamber was hoping for September 25, but the
turnaround is too quick for the Market to organize. The following
weekend is Country Days, therefore, the Market is hopeful that
October 9th will be their first event. The Zone Clearance is valid
for six months, at which time the entire program can be evaluated
and continuation considered, therefore, if approved by the Council,
the permits would last until April 9, 1994.
Summary
The significant issues related to the proposal to have a Farmer's
Market on High Street have been presented in this report. Staff
feels that concerns relating to parking and the impact on local
businesses will be adequately addressed. The remainder of
conditions will be developed by staff to include concerns relative
to risk management, sales tax reporting and the final details for
signs and public outreach.
Recommendation
That the City Council approve the location and authorize staff to
continue to develop conditions and incorporate those conditions
shown in Attachment "B" , issue a Temporary Zone Clearance for a
period of six months to the Farmer's Market beginning October 9,
1993 , and consider waiving the hourly cost of staff associated with
the development of this program.

PROPOSAL: To establish a FaLmer' s Market in MooLpark.
J3ACKGROUND: As part of the Economic Development ' s Program of
Work, approved by the City Council, the Chamber of Commerce, in
its effort to promote "Shop Moorpark" , and as part of the
revitalization of Downtown, is sponsoring a Moorpark centered
Farmers Market . The Chamber envisions drawing customers to the
Downtown area, hence creating an awareness of the shops located in
Downtown. We also plan a Sidewalk Sale while the Fa Lmer' s Market
is in progress.
This project involves two phases.
a) Farmers Market
b) Sidewalk Sale
This proposal only seeks to address the Farmers Market . The
Chamber has contracted with Cynthia KoLman, of the Ojai Falmer' s
Market, to manage the Moorpark Certified Farmer' s Market .
LOCATION: The market is to be held on High Street, on the north
side of the Metrolink parking lot. (see attached) .
TIME: Saturday evening from 4 : 00 p.m. to 7 : 00 p.m. Our
current starting date is September 11, 1993 .

TEMPORARY ZONE CLEARANCE
ADDRESS: 320 High Street, north Metrolink Parking Lot
APPLICANT; Cynthia Korman
DATE OF APPROVAL: September 22, 1993 (activities beginning on
October 9, 1993)
1. Any expansion of uses other than those approved as part of
this Temporary Zoning Clearance (including the use of
electricity or other utilities) will render this Temporary
Zoning Clearance void. Any changes to this permit must be
approved by the City Council if deemed necessary upon the
discretion of the Director of Community Development.
2. This Temporary Zoning Clearance will expire on April 9, 1994
and is valid for six (6) months, from date of issuance.
Should the applicant wish to extend the time limit or change
the nature of the Temporary Zoning Clearance, further review
and approval will be required from the City Council if deemed
necessary upon the discretion of the Director of Community
Development.
3 . The hours of operation (for setup, operation of the Market and
clean up) shall be every Saturday, between the hours of 3 :00
p.m. and 7:00 p.m.
4. No vehicles except for vehicles parked in the lot prior to
3:00 p.m. , (other than grower/vendor vehicles) will be
permitted to park in the north Metrolink parking lot, 320 High
Street, during the hours of operation as stipulated in
Condition "3" above. Ingress and egress into the parking lot
via the driveway on High Street will be restricted to only
grower/vendor vehicles.
5. No more than twenty-five (25) growers and/or vendors shall be
allowed to participate in the Farmer's Market at any one time.
Stalls, booths, and other sales areas shall be organized for
ease of access and movement of pedestrian traffic through the
area.
6. Vendors shall be limited to selling only the produce or food
products as required by the State or County of Ventura and as
required to be a "Certified" Farmer's Market.
7. The parking lot shall provide adequate ingress and egress for
those automobiles authorized to utilize the parking lot.
Under the parking ordinance, a two-way driveway must be a
minimum of 20 feet wide.
8. All conditions of the Ventura County Fire Department shall be
met prior to opening the Farmer's Market, and the City will be
provided written proof from the Fire Department verifying
compliance.
9. If it is determined that operation of the Farmer's Market has
violated any conditions imposed by Environmental Health, the
Temporary Zoning Clearance shall be void.
10. The design of the signs, the location of any signs, and the
date that they may be erected shall be approved by the
Director of Community Development, prior to erecting them in
order to advertise the market. No signs will be allowed on
public property without an encroachment permit, except, banner
signs will be allowed on the site as approved by the Director.
11. The applicant shall be responsible to allow the owners of cars
which may be parked in the north Metrolink parking lot (320
High Street) to remove their cars during the Farmer's Market
hours of operation, (pursuant to Condition 3) .
12. Verification that restroom and washroom facilities will be
provided for Farmer's Market clientele and growers/vendors
shall be submitted in a letter form to the Department of
Community Development, prior to operation. All private
business owners associated with any arrangements needed to
satisfy this condition shall certify their willingness to
cooperate in written form provided to the City, prior to
operation.
13. No vehicles shall be parked within the dirt parking lot to the
west of the Farmer's Market site.
14. At the close of each Farmer's Market, the Metrolink parking
lot shall be cleared of all wet or dry debris. The Farmer's
Market will provide the City with a cleanup plan which
addresses this condition prior to operation.
15. At the applicant's expense, trash receptacles shall be
provided and trash shall be disposed of during the hours of
operation and at the conclusion of each event.
16. The Moorpark Certified Farmer's Market will accept
responsibility for, and if necessary reimburse the City for,
any expenses incurred as a direct result of holding this
event, (in addition to any initial fees, to include but not
limited subsequent permit modifications, trash clean-up,
police services, or repairing damage to City facilities) . The
applicant shall be billed for the staff time expended to
perform these duties.
17. At the City's discretion, security measures may be required.

18) Obtain written notice of the intent to conduct this event from
all businesses located on High Street and within one block of
High Street (including Walnut Street, and Moorpark Avenue) , in
a form first approved by the City, which includes notice the
business owner of their right to protest the event, and
provide the businesses acknowledgement of receipt of this
notice to the City no less than five working days prior to the
start of the event.
19) Assure that the Farmer's Market and all vendors associated
with the Market obtain a valid business registration permit.
20) Provide all vendors with the appropriate forms provided from
the City for the purpose of reporting to the State Board of
Equalization all sales tax earned while selling goods at the
Certified Farmer's Market in Moorpark.
21) Provide the City with the appropriate insurance and certify as
to the acknowledgement of these conditions as detailed in
Exhibit "A" (insurance) and Exhibit "B" (indemnification

INSURANCE REQUIREMENTS
The Moorpark Certified Farmer's Market agrees to obtain and keep in
full force and effect the following insurance coverage for the
period of the subject event. Further agreeing to provide the City
of Moorpark and the Moorpark Chamber of Commerce and their
officers, employees, servants and agents with a certificate of
insurance verifying that the City of Moorpark and the Chamber of
Commerce has been added to the policy as an additional named
insured for the coverage outlined below without deductible. The
Certificate of Insurance shall provide for a ten day notice from
the insurance carrier to the City of Moorpark and the Chamber of
Commerce in the event the insurance is to be canceled.

SUBJECT: Consider Approval of the Proposed Certified Farmer's Market,
to be Held each Saturday afternoon in the north Metrolink
Parking Lot, (north Lot)
The f llowing report will provide the conditions developed by staff to
allow the proposed Certified Farmer's Market ( "Market ") to occur on High
Street in the north Metrolink Parking Lot, on Saturdays from 3:00 P.M.
to 7:00 P.M.. The Market would like to open on October 9, 1993.
On July 21, 1993, the Chamber of Commerce proposed to the City Council
that a Farmer's Market be considered each Saturday on High Street. This
request was made in response to the City's request of the Chamber that
they plan events that attracted people to downtown Moorpark. The Market
plans to have between 15 and 20 vendors, all selling goods that they
have qrown or made, to occupy the most westerly section of the north
Metrolink parking lot. No entertainment has been planned, but
eventually, they hope to have a small musical group accompany the
Market. The Chamber's proposal with a tentative list of goods to be
sold, attached layout and proposed sign concept is provided in
Attach ent "A ".
The pr posal is being presented by the Chamber and Cynthia Korman, who
runs tie Market in Ojai. Ms. Korman has addressed many of the concerns
expressed by Moorpark business people and the City with Ojai, and is
willing to work with the Moorpark representatives in order to get the
event initiated.
Betweei July 21 and August 26, staff met with representatives from the
propos d Market and the Chamber of Commerce, received feedback from
various City departments, and developed a report to the Council's
Economic Development Committee, (Councilmembers Hunter and Perez,
Counci member Hunter could not be at the meeting, and Mayor Lawrason who
could of attend as the alternate did provide input for the Committee's
discus ion).
At the Committee, the location of the Market was considered as well as
the impact that the proposed event would have on the downtown merchants.
It was also presented that the Committee would like the proposal to be
handled by staff like any other private enterprise requesting to have a
specia event in the City.

Attac ment "B" are the conditions developed by the Department of
Commu ity Development and Administrative Services which are intended to
assurE that this event would have a minimal adverse impact on residents
and businesses owners. Verbal confirmation from Ms. Korman, the Fire
Department and the Moorpark Police have agreed that this event under
these conditions poses no serious threat to the success of the event or
relat d health and safety matters at this time.
The most significant concern expressed by the Moorpark Police Department
is th t they cannot tow vehicles from the Metrolink lot, which means
that some accommodations by the Market would have to be considered to
allow persons arriving on the afternoon AMTRACK to be able to have
access to their cars and be able to leave at will, (this stipulation
would also apply to anyone parking there and visiting shops on High
Street).
In discussions with Ms. Korman, this issue is similar to the situation
in Ojai where a public lot is used for the Market, and she is prepared
to work around parked cars, and allow pedestrians and train passengers
who arrive after the Market is set up to have access to their cars and
be able to leave. As proposed, the north Metrolink parking lot would be
closed with a rope to parking during the event, however, there would be
ample parking available on High Street and in the south Metrolink lot if
needed.
Signs are proposed to be posted in front of the Metrolink lot on Fridays
annou cing the event. A sign permit will be issued for the Market which
has proposed three and possibly four signs, using the same conceptual
desigr as used in Ojai, and provided in Attachment "A ". They have
requested to place temporary signs at both the eastern and western
entralces from state highways onto High Street, and to place one in

front of the north Metrolink parking lot. Staff mentioned that parking
would not be prohibited prior to the event on Saturdays, but perhaps a
sign 6arning persons parking in the lot that the event will be occurring
on a permanent basis could evolve. A permanent sign is being developed
by th City of Ojai for the Ojai Market.
Competition from the Market to local businesses cannot be avoided, but
the Market would like to promote High Street in conjunction with their
event Ms. Korman has proposed using a map of the High Street merchants
as a promotional flyer, and perhaps offering coupons to the local shops
from the Market. To assure that all concerns are addressed, each
business on High Street will be contacted via a hand delivered letter by
Ms. Korman. If needed, staff, Ms. Korman and concerned parties would
meet in an attempt to mitigate concerns. Unresolved concerns could then
be directed to the Council's Economic Development Committee for
resoliftion, and the Council if needed.
Only those who make their goods can participate in the "Certified"
Farmex 's Market. Therefore, the concept of allowing local businesses to
have z space in the Market is unlikely. Because of this requirement,
the Market offers goods which are unique to the area. For example,
flowe s are typically a big sales item at a Farmer's Market, and they
are very different from the types of goods offered by a florist, (hand -
cut f owers versus an arrangement of flowers, with no gifts or cards
sold it the Market). To eliminate a type of good sold at the market
based on a concern from a local shop owner, could eventually lead to the
elimiration of the Market, (i.e., there is a produce store currently
being Ideveloped on Walnut Street).
Staff researched this issue with the Chamber of Commerce in Ojai,
Ventura, Camarillo, Thousand Oaks and Calabasas. A unanimous response
was that the Markets in each city brought "life" back to "dying"
neighborhoods. This was especially true in Camarillo, the Janss Mall in
Thousand Oaks and in Calabasas. In Ojai, when one shop complained about
the parking and the Market blocking public access to their store, an
unsolicited petition of 22 Ojai businesses in support of the Market was
given to the Ojai Council.
Staff aas spent approximately 12 hours on this project through Friday,
SeptemDer 10, which when combined with the cost of the Zone Clearance
and Sign Permit would equal and expense of $966. This cost will
increase as a result of developing the staff report and finalizing the
details for this event. In treating this application as staff would a
private business, all expenses would be recovered. In addressing this
matter with the Chamber of Commerce, representatives expressed that this
proposal was developed in response to the City's requirement, and did
not feel that a bill from the City could be justified. In discussing
this matter with Ms. Korman, she described how other cities including
Ojai w ived the permit fees, donated the land and helped to promote the
initia ion of the event. Ms. Korman is hopeful that the City would make
the sate considerations.

Reporl edly, it takes two years of established business to make a profit
at th s endeavor, and the City would be prolonging this process and /or
placing it at risk of surviving if the total expenses were applied to
the a plication. Staff has conditioned the Market to reimburse the City
for a y expenses incurred after the initial issuance of the permit,
which includes changes to the proposed use of the site.

the business and vendors for the Market by October 9. The
Chamb r was hoping for September 25, but the turnaround is too quick for
the Market to organize. The following weekend is Country Days,
therefore, the Market is hopeful that October 9th will be their first
event. The Zone Clearance is valid for six months, at which time the
entirE program can be evaluated and continuation considered, therefore,
if ap roved by the Council, the permits would last until April 9, 1994.
The s gnificant issues related to the proposal to allow a Farmer's
Market on High Street have been presented in this report. Staff feels
that doncerns relating to parking and the impact on local businesses
will be adequately addressed. The remainder of conditions will be
develcped by staff to include concerns relative to risk management,
sales ax reporting and the final details for signs and public outreach.
That tqe City Council authorize staff to continue to develop conditions
and incorporate those conditions shown in Attachment "B ", issue a
Temporary Zone Clearance for a period of six months to the Farmer's
Market beginning October 9, 1993, and consider waiving the hourly cost
of staff associated with the development of this program.

PROPOSAL: To establish a Farmer's Market in Moorpark.
BACKGROUND: As part of the Economic Development's Program of
Work, approved by the City Council, the Chamber of Commerce, in
its effort to promote "Shop Moorpark ", and as part of the
revitalization of Downtown, is sponsoring a Moorpark centered
Farmers Market. The Chamber envisions drawing customers to the
Downtown area, hence creating an awareness of the shops located in
j Downtown. We also plan a Sidewalk Sale while the Farmer's Market
is in progress.
This project involves two phases.

b) Sidewalk Sale
This proposal only seeks to address the Farmers Market. The
Chamber has contracted with Cynthia Korman, of the Ojai Farmer's
Market, to manage the Moorpark Certified Farmer's Market.
LOCATIOU: The market is to be held on High Street, on the north
side of the Metrolink parking lot. (see attached).
TIME: Saturday evening from 4:00 p.m. to 7:00 p.m. Our
current starting date is September 11, 1993.
