Rubin, Solid Waste Coordinator, /� September 17, 1993 (9/22 Council Meeting) Consider First Reading of the Amended Solid Waste Ordinance 123, Municipal Code Chapter 8.36. At he September 8, 1993 City Council meeting, Council approved the Req ired Refuse Collection Enforcement Policy, and proposed ame dments to the City's Solid Waste Ordinance 123, Municipal Code Cha ter 8.36. The City Council directed staff to confirm ordinance revisions with the City Attorney, and present the amended ordinance for a first rea ing at the September 22, 1993, City Council meeting. The City Attorney provided comments to staff which have been inc rporated (see highlighted and strike -out items) in the ordinance that was presented to Council on September 8, 1993. Spe ifically, two of the three exemptions, originally identified, hav been amended. Rather than addressed as exemptions, they have bee included in the definitions. The definition for "Residential occ pant" has been revised to state that with City Manager app.oval, duplexes and triplexes on one parcel may share solid waste collection service. The "Commercial occupant" definition now states that upon request and with City Manager approval, a resident who owns a business within the City and disposes solid waste generated residentially at the business, shall be deemed a Commercial Occupant and not a Residential Occupant. The only remaining exemption addresses service to residents whose property presents physical limitations for the collection of solid waste. Those individuals would be exempt if the cost to collect ref se is extraordinary. Those who qualify for the exemption must pay a Solid Waste Management fee. Other revisions to the ordinance include the addition of lan uage that specifies the requirement for solid waste services and payment for such services. ION Sta f recommends that the City Council approve Solid Waste Ord nance 123 as amended for first reading.
