Amend Temporary Refuse Collection Permit Requirements
and Processing Procedures.
The City currently has a non - exclusive temporary refuse collection
per it available to any refuse hauler for collection service
provided on a non - regularly scheduled and less than weekly basis -
suca as for construction, demolition, and land clearing projects.
A -efuse hauler must apply for a permit prior to providing
to orary refuse collection service, and pay a fee of $500 or
prItorough ated (monthly) amount for the one year permit period - October
1 September 30.
Per its are awarded by the City Council, at the beginning of the
per it cycle, to applicants meeting all of the agreement terms. The
Cit Manager may approve permit requests that are made anytime
dur•ng the permit cycle. Current significant requirements are
lis ed below:
Payment of a $500 fee, or prorated amount (based on $600) to
the City upon execution of the permit agreement;
Ten (10) percent franchise fee due to the City on gross
receipts (including landfill costs), payable to the City
quarterly;
Eight (8) percent AB 939 fee due to the City based on the bin
rental and transportation, excluding franchise fees and
landfill tipping\ dump fees;
A Blanket Encroachment Permit for the term of the
agreement, and regular notification to the City of
service dates and location; and
Establishment of a recycling program for material
collected from temporary bins;
Provision of necessary information to the City for
meeting AB 939 diversion goals.

The current permit cycle ends 9/30/93. In order to alleviate the
difficulties experienced during the current permit cycle, the
Public Works, Facilities, and Solid Waste Committee (Mayor Pro Tem
Montgomery and Councilmember Wozniak) and staff identified concerns
and propose changes to the existing permit. They are as follows:
Definition of "Temporary"
"Temporary" collection service is defined as, "... that which
is provided on a non - regularly scheduled,, - -&rtes 1-eeg , t4iafi- wee# -lY
basis. Temporary service includes all commercial and
residential service requiring the use of a drop box, and
commercial service requiring the use of a bin, as defined in
the Moorpark Municipal Code Chapter 8.36.040C and 8.36.040D,
on a temporary basis. Construction, demolition, and land -
clearing projects would be typical types of temporary
service."
Removing "less than weekly" better defines service that is
provided on a construction site. Depending on the project
size, drop boxes may be removed and replaced more frequently
than on a "less than weekly" basis.
Permit Fee
The current fee is $500 per year, prorated at $600 after the
first month (October) . The current rate structure encourages
some haulers to postpone their requests for a temporary
permit, until such time they have an actual request for
service, lessening the fees due to the City. The same may be
done by a non - franchised hauler who typically requests a
temporary permit at mid or late cycle, and as a result pays a
lesser fee.
In addition, haulers may be awarded a contract with the
property owner and provide collection services, unaware of the
City's requirement to obtain a temporary permit. Once
notified of the permit requirements, they decide not to obtain
a permit, and remove their bins after providing service for a
given length of time. Often, the staff time and energy spent
responding to non - permitted haulers is not justified by the
revenue generated from the permit fee.
To better address this issue, the Committee and staff propose
the establishment of a permit application period to apply for
a permit, rather than anytime throughout the year. During the
application period (e.g. September 1 - November 1 for 93/94),
haulers could obtain a permit for the same permit fee - $500.
After that time, no new permits will be issued until the next
permit application cycle. In the future, the application

period will be August 1 - September 30 to better correspond
with the established permit cycle. Staff will continue to
present a report to the City Council regarding permit requests
and renewals once a year, prior to the start of the permit
cycle - October 1st.
Notification of Bin Placement - Building Permit Attachment
Recently, non - franchised hauling companies provided drop box
services to two different projects. In each case, the
contractor and the hauler indicated that they were not aware
that the City operated under a franchised system for solid
waste collection services. One of the haulers applied for a
permit, after providing the service, when staff notified them
that they operated in violation of the Municipal Code.
In an effort to ensure that only the franchised or permitted
haulers provide service, staff has implemented the (attached)
notice which is included with the Building Permit application
form. This attachment lists haulers currently permitted for
the cycle concluding September 30, 1993 (The actual form will
list haulers permitted for the 1993/94 cycle). The contractor
must provide this information prior to being issued the
Building permit. The proposed form to be attached to the
Building permit will provide the City with the needed vehicle
to inform residents and contractors of the permitted haulers.
Additionally, the City will receive advance information
pertaining to bin placement.
Again, the current permit cycle ends September 30, 1993. Staff
mailed notices to the current permit holders and haulers throughout
the area, informing them of the availability of temporary
collection permits and permit requirements. To date, two of the
four currently permitted haulers (Anderson Rubbish and G.I.
Rubbish) have requested a permit.
Staff presented this item to the Public Works and Facilities
Committee on August 25, 1993, and received their concurrence.

The Public Works, Facilities, and Solid Waste Committee (Mayor Pro
Ten Montgomery and Councilmember Wozniak) and Staff recommend that
the City Council:
1. IAmend the Temporary Refuse Collection Permit requirements and
processing procedures as outlined in this report.

ATTACHMENT TO THE APPLICATION FOR A BUILDING PERMIT
The City of orpark operates under a franchise system for the collection and transportation of solid waste materials.
Only the Ci 's franchised haulers may provide roll -off and commercial bin services. These services include all
commercial d residential service requiring the use of a drop- box/ roll -offs for the removal of construction, demolition,
and land -cle ring debris, as well as continued commercial /business solid waste collection. Please contract with a
hauler from t e list below, fill out the form, and submit this notice with the Building Permit application.
