Traffenstedt, Senior Planner DATE: October 28, 1993 (CC Meeting of 11 -3 -93) SUBJECT: CONSIDER AMENDING ORDINANCE NO. 137, THE MOORPARK ZONING ORDINANCE, BY REVISING SECTIONS 8102 -0 AND 8107 -1.7 RELATIVE TO SECOND DWELLINGS BACKGROUND The public hearing for this item was closed at the City Council's October 20, 1993, meeting. The Council did request staff to make minor revisions, as discussed below, and return the revised ordinance for first reading at the November 3, 1993, meeting. DISCUSSION At the October 20th meeting, staff was directed to revise the draft ordinance to make the size limitations for a second dwelling consistent with those in the existing code; delete the requirement for a conditional use permit, and include instead a requirement for neighborhood notification; and include language allowing a fee to be imposed to pay for staff work required to process the application for a second dwelling. Attached is a revised draft ordinance which includes the requested revisions. By deleting the requirement for a conditional use permit, the only permit required is a zoning clearance, which is a ministerial decision. The Director of Community Development could make a determination that an application for a second dwelling is not consistent with the requirements of Section 8107 -1.7 of the Zoning Ordinance, and deny the request for a Zoning Clearance. The applicant would then have the right to appeal the Director's denial decision to the Planning Commission. Based on recent changes to the Zoning Ordinance, only the applicant for a ministerial decision (i.e., Zoning Clearance) can appeal an approval /denial decision. A section has also been added to the draft ordinance, Section 8107- 1.7.2 which allows the Director to defer a decision of an application for a second dwelling to the Planning Commission. dst- 10- 28- 931 10 :31amC: \WP51 \stfrpt \2DU- ORD.rpt The Honorable City Council October 28, 1993 Page 2 RECOMMENDATION Adopt an ordinance amending Ordinance No. 137, the Moorpark Zoning ordinance, by revising Sections 8102 -0 and 8107 -1.7, introduce the ordinance for first reading, and waive full reading.
