Gilbert, Director of Public Works (/ ., A7201r DATE: December 6, 1993 (Council Meeting 12-15-93) SUBJECT: Consider Adjustment to the Approved Quantities of Work Performed in Constructing the 1993 Slurry Seal Project BACKGROUND Last October the City Council accepted the subject project as complete and authorized the recordation of the Notice of Completion. The staff report which accompanied that action mentioned receipt of a Notice of Potential Claim pertaining to certain disputed contract pay quantities. DISCUSSION Staff, the City Engineer's staff and the project inspectors have met with and had conference calls with the contractor on several occasions in an attempt to resolve the difference between the City's approved quantity for slurry seal applied to the streets and the contractor's calculation of that figure. This report recommends resolution of that dispute through the approval an increase in approved quantity slurry seal as described below. The City's approved tonnage figure for the aggregate crushed rock used for both Type I and Type II slurry seal is 2,599. The weight tickets show that 3 ,077 tons were delivered to the site. The difference between these two figures is 478 tons. Paid at the lesser bid amount of $74 per ton for Type I slurry, the initial amount of alleged underpayment was $35,372 . The City's approved quantity of aggregate was based upon an a method of measurement agreed to by the City and the contractor before the start of work. That method utilized a gauge on each truck which measured the amount of material being applied. It is now the opinion of staff that this gauge was not calibrated properly. We believe that the agreed to application rate (pounds of material applied per revolution of the gauge) was estimated incorrectly. Although mentioned by the Contractor at the time, the matter was not thoroughly discussed and application rate was not revised. slry93b,cmp Slurry Seal 1993 December 1993 Page 2 Both the Contractor and the City's inspectors measured the amount of waste at each of the stock pile sites. The Contractor estimated the amount of waste to be only 231 tons. This figure subtracted from the above mentioned difference of 478, leaves an additional pay amount of 247 T x $74 = $18, 278 . The City's two inspectors independently measured the amount of waste and estimated the amount to be 320 and 360 tons for an average of 340 tons. The 340 Ton figure subtracted from the above mentioned difference of 478, leaves an additional pay amount of 138 T x $74 = $10,212 . The Contractor has agreed to accept this increase. If approved, this increase revise the contract amount from $246,846 .96 to $257,059.96 . The total project costs will change form $267, 714. 02 to $277,926.02. The amount budgeted for the project is $300,000 . No additional appropriation will be required. RECOMMENDATION Staff recommends that the City Council approve an adjustment to the previously approved quantities for the 1993 Slurry Seal Project by increasing the tonnage of Type I Slurry Seal from 1,916 T to 2 ,054 (net increase 138 T x $74 =$10, 212) . s1ry93b.cmp
