HomeMy WebLinkAboutAGENDA REPORT 1992 1007 CC REG ITEM 08L�ll i:o) ITEM g• 1- • MOORPARK 799 Moorpark Avenue Moorpark, California 93021 (805) 529 -6864 MOORPARK, CAUFORN!A MEMORANDUM City Counc Meetng TO: The Honorable City Council of ACMON: FROM: Paul Porter, Senior Planner, DATE: September 11, 1992 (CC meeting of October 7,41.992) ,_�� SUBJECT: REVISIONS TO CITY'S ZONING ORDINANCE Background On February 20 1991, the City Council rescinded the previous Zoning Ordinance as well as Ordinance Nos. 74 (Parking /Setbacks), 76 (Maximum Density), 113 (Signs), 83 (Produce Stands), 112 (Day Care Facilities), 121 (1,000 foot notification), and 130 (RPD Zones) in their entirety. The Council adopted the then current County Ordinance with several modifications. In using the Ordinance during the past year, staff has noted that there has been a need to make several minor modifications in order to clarify certain sections of the Ordinance and to better fit the needs of the City. In the future, staff intends to rewrite the Zoning Ordinance in its entirety, but suggests that minor modifications to the Ordinance be done at this time as a clean -up action. The types of proposed clean -up actions to the ordinance include the following: 1. Modifications to certain definitions; 2. Placement of Language in Section 8105 -4 requiring RPD permits for five or more units in residential zones pursuant to Ordinance No. 130; 3. Add requirement for industrial users in properties adjacent to residential zoned properties to obtain a City Council approved Conditional Use Permit; 4. Modifications to the section 8106 of the Ordinance relating to Development standards and accessory structures in certain setback areas; 5. Add a provision in Section 8106 -8.6 require that lighting shall be designed to have a sharp cut -off at property lines; 6. Changes to Article 8 related to Parking requirements; 7. Changes to setback requirements for RPD Zones in Article 8; 8. Addition to Article 10 requiring that the location of political signs be shown on a map and submitted as part of the application and that it is illegal to place them on top of, or on other signs; PP09:11:92 /2:22pM : \Z0N0RD.CC 1 199 y PAUL W. Changes to Article 11 relating to entitlements requiring that signs for approved for Planned Development permits are governed by the permit and not Article 10 relating to signs, addition of a section relating to Temporary Use Permits and the addition of a provision relating to Posting of property for public hearings; Addition to Article 8 noting that in the event there is a question as to the location of a zoning boundary, the City Council has the authority to make a determination as to the location of the zoning boundary line and; Add a provision to Section 8105 -5 allowing churches in industrial zones by approval of modifications to existing Industrial Planned Development Permits for buildings with approved IPD's, or with approval of an IPD for proposed new buildings; and Other minor modifications as deemed necessary to further clarify sections contained in the Zoning Ordinance. commendation Adopt the attached resolution directing the Planning Commission to study, set a public hearing and provide a recommendation to the City Council pertaining to reviewing the proposed changes to the City's Zoning Ordinance.
