SUBJECT: Consider Purchase of Surplus Caltrans Property on
the South Side of Los Angeles Avenue West of the
Freeway Overpass (La Falda)
OVERVIEW
This presents for consideration an offer from Caltrans to
sell certain surplus property (Exhibit 1).
DISCUSSION
A. Surplus Right -of -Way
The subject property was apparently a part of lands
acquired by Caltrans for the construction of the freeway
connector project. Once the ultimate right -of -way needs
were set, it was determined that the subject property was
no longer needed and the property was declared surplus.
B. Access to La Falda
The freeway project severed an existing "paper street"
(La Falda Avenue) just south of the subject parcel.
Caltrans is in the process of re- establishing street
access to the properties fronting that street by conveying
a new street on the east side of the subject parcel (see
Exhibit 1).
C. Prior Offer
State law requires that surplus public property first be
made available to other public agencies before it is sold
on the open market. In December of 1990, the City first
received an inquiry from Caltrans regarding the City's
interest in acquiring the property. At your meeting of
February 6, 1991, the City Council directed staff to send

a letter of interest to-,Caltrans.--,- -Upon receipt of that
letter, Caltrans ordered the preparation of an appraisal
and other documents in preparation for more substantive
negotiations.
In May of 1991, the City was notified that Caltrans offer
had been withdrawn.- They stated that it was their intent
to exchange the property for rights -of -way being acquired
elsewhere.
D. Auction
Several months ago the City became aware of the proposed
auction of the subject property. The intended exchange of
the property apparently did not take place. Staff then
contacted Caltrans regarding the proposed sale of the
property in light of the withdrawal of their offer of the
property to the City. Caltrans then realized that they
were in error in making the property available for sale
prior to receipt of the City's response.
E. New Offer
The City is in receipt of a second offer from Caltrans for
the sale of the subject property. (Exhibit 2). The
property is being offered for the appraised value of
$84,900.
F. Description
1. Location: The subject property is located on the south
side of Los Angeles Avenue just west of the southbound
freeway overpass. The subject property and the
adjacent future street (discussed below) are shown on
Exhibit 1.
2. Size: The size of the parcel is approximately 13,552
s.f. (0.3 acres), including a slope easement, measuring
approximately 90' x 1501.
3. Zoning Designation: M -2
4. Current Use: The property is now being leased from
Caltrans by the adjacent property owner (Red Iron
Fabricators) on a month -to -month lease.

5. Flood Zone: The elevation entire property is
significantly lower (six to ten feet) than the
elevation of the street. A cursory review of the Flood
Zone maps indicates that all, or almost all of the
property is within Zone A (one hundred year storm flow
area).
G. Potential Public Uses of the Property
The City is or may be involved in a number of projects
and /or programs which directly impact, or which may impact
the subject property. Those efforts include 1) the
acquisition of right -of -way for the widening and possible
realignment of Los Angeles Avenue; 2) the development of
possible Redevelopment Projects in the area; 3) location
and development of a Corporate Yard at a site yet to be
determined; 4) nuisance abatement efforts in the area; and
more. The acquisition of the subject property could
benefit one or all of these efforts. The most obvious
benefit is in meeting the right -of -way needs of the future
Los Angeles Avenue widening project. It would appear at
this time that there is an actual or potential public need
for the acquisition of the property. If it is determined
that after the street right -of -way needs are met that the
remaining property is no longer of public benefit, said
property could be declared surplus by the City.
H. Property Value
It is questionable whether or not the appraisal report
prepared by Caltrans fully addressed factors hindering the
"developablity" of the site, such as the flooding problems
discussed above. If staff is directed to proceed with
acquisition negotiations, it would be our intent to
clarify the value of the property vis -a -vis these
concerns.
I. Redevelopment Agency
The property in this area is zoned for industrial use.
There has been discussion of a possible Redevelopment
Project to consolidate properties in this area to
facilitate future development. Staff has reviewed of the
Redevelopment Project Area Map (Exhibit 3) and has
determined that the property in question is not within the
boundaries of the Redevelopment Agency.

J. Committee Review
On September 30, 1992, the Public Works / Facilities
Committee considered this matter. The Committee
recommended that the City Council consider proceeding with
the acquisition of the property and that the matter be
referred to executive session for further discussion.
RECOMMENDED ACTION
Subject to the findings and directions of the City Council in
executive session, staff recommends that the City Council
take the following actions:
1. Authorize staff to commence discussions with Caltrans
regarding the possible acquisition of the subject
property;
2. Authorize staff to make an offer for the purchase of said
property for a reasonable price as determined by the City
Manager not to exceed the appraised value of the property;
and,
3. Appropriate funds in the amount of $100,000 from the Los
Angeles Avenue AOC for acquisition, appraisal and related
costs for said property.
