SUBJECT: Consider Agreement with the Embassy Group
Representatives of the Embassy project have indicated they
will not be going forward with their project at the northwest
corner of Spring Road and Tierra Rejada Road.
As you are aware, the two Commercial Planned Development
Permits (PD 1062 and 1063) for the property have expired.
The land division that accompanied the PD's, however, was
recorded. The Subdivision Agreement, approved as part of the
final map, includes a bond to guarantee certain public
improvements required of Embassy. Embassy has requested a
refund of unused fees and exoneration of the bonds. The City
has taken the position that since the land has been divided,
Embassy must meet its obligations as contained in the
Subdivision Agreement.
To resolve the dispute between Embassy and the City, it has
been agreed that certain fees will be returned to Embassy,
bonds exonerated by the City and a Reversion to Acreage
processed.
STAFF RECOMMENDATION
Approve agreement subject to final language approval of City
Manager and City Attorney; and authorize the Mayor to sign
the Agreement.
