Lindley, Assistant to the City Manager,",,,' February 22, 1994 (CC of March 2) Consider Assembly Bill 122 Regarding Mobilehome Rent Control Assembly Bill 122 (Andal), mobilehome rent control, makes a legislative finding that local rent control measures have a "deleterious effect on the statewide mobilehome rental housing market," a statement that is disputed by the League of California Cities and others. If approved, AB 122 would preempt all local mobilehome rent control ordinances and programs. Staff is recommending that Council express its opposition to AB 122 because it would preempt the City's existing mobilehome rent control Ordinance, and would intrude in the City's right to determine any future such policies. As currently proposed, the bill takes away authority currently under local control. In the City of Moorpark, as in most other cities, the Council took action to enact a mobilehome rent control because many mobilehome residents are low income and senior citizens and need protection from inappropriate rental increases. It is imperative that the authority to respond to the needs of residents, as demonstrated by the City's Ordinance, be maintained by local elected officials. To do otherwise could seriously impact the economic well -being of many of the City's residents. Recommendation Staff recommends that Council express its opposition to AB 122, Mobilehome Rent Control, and direct the Mayor to write a letter conveying the City's position to thE, appropriate Legislative Committee.
