Gilbert: Director of Public Works DATE: February 23. 1994 (Council Meeting 3 -2 -94) SUBJECT: Bond Exoneration for Tract 3019 & Tract 3525 (Warmington) OVERVIEW This requests approval of the exoneration of certain bonds related to the construction and maintenance of improvements within the subject tracts. BACKGROUND In June of 1991 the City Council approved the exoneration and /or reduction of a number of bonds posted to guarantee the improvements within Tracts 3019 and 3525. In June 1992 the City Council exonerated all but one of the bonds initially deposited to guarantee the construction of the required tract improvements. That action was taken based on a requirement that the developer file a new bond to guarantee certain work required to resolve a subsidence problem. That bond was filed with the City and is still in effect. DISCUSSION A. Remaining Bond When the initial bonds for this development were exonerated in June of 1992, one bond ( #931842] which should have been exonerated, was not. It is recommended that this bond be exonerated at this time. B. Subsidence Bond As stated above, the June 1992 action required to posting of a new bond ( #1209025] to assure the correction of a subsidence problem. Mac . C` Bond Exoneration Page 2 C. Request for Exoneration The developer has requested that both of the bonds currently filed with the City be exonerated. The developer's engineers have provided the City with a letter stating that, in their opinion, the area where a subsidence problem once occurred has remained stable for approximately two years and that the corrective measures initially proposed, that of installing a lens grout in the problem area, are no longer warranted. The City Engineer for this project (Willdan Associates) agrees that it appears that the problems may have been resolved. However, they suggest that a bond be retained for another five years and that the sewer line in question be smoke - tested to confirm that it is no longer leaking. Earlier this month the developer performed a smoke test on the subject segment of the sewer main. The test revealed no evidence of any leakage. Although the former City Engineer again recommended that a bond be retained to deal with any possible future problem, it the opinion of staff that the ground in this area has proven to be stable and that no additional assurances are required by the leveloper. D.
