SUBJECT: Consider a Resolution Restricting the Parking of
Unattached Trailers and Semitrailers on City Streets
DISCUSSION
A. Seventy -two Hour Limit
Section 10.04.220 of the Moorpark Municipal Code prohibits the
improper storage of vehicles on City Streets. Pursuant to this
Section a vehicle may not park in one location for more than
seventy -two (72) hours. One of the methods of determining if a
violation of this Section has occurred, is noting whether or not
the reading on the vehicle's odometer has changed.
B. Improper Storage of Unattached Trailers and Semitrailers on City
Streets
In that trailers and semitrailers do not have odometers, it is
not possible to demonstrate that an unattached trailer or
semitrailer has not been moved. Accordingly, the City has found
it difficult to impossible to enforce the seventy -two (72) hour
parking limitation on unattached trailers and semitrailers. The
subject resolution (attached) will resolve this problem by
prohibiting the parking of unattached trailers and semitrailers
on a City streets, except as provided for in the Resolution.
C. Prohibiting the Parking Unattached Trailers and Semitrailers
Section 22507 of the California Vehicle Code (CVC) states in
part as follows:
"Local authorities may, by ordinance or resolution, prohibit
or restrict the stopping, parking or standing of vehicles,
including but not limited to, ..., on certain streets or
highways, ... during all or :•ertain hours of the day."

In a recent decision, the courts have upheld the right of local
authorities to prohibit or restrict the parking of specific
types of vehicles on City streets. It is the opinion of the
City Attorney that the City may use this provision of the
California Vehicle Code to prohibit the parking of unattached
trailers and semitrailers on City streets.
If adopted, the attached resolution will establish a parking
prohibition for trailers and semitrailers on any street within
the City of Moorpark, with the following exceptions:
1) any trailer or semitrailer attached to a vehicle capable of
moving the trailer or semitrailer;
2) any trailer or semitrailer in the process of being loaded or
unloaded;
3) any trailer displaying a Temporary Trailer Parking Permit;
and,
4) any trailer or semitrailer which i4 disabled for a temporary
period of time.
D. Temporary Trailer Parking Permits
At a recent meeting of the Transportation and Streets Committee
(Mayor pro tem Hunter and Councilmember Wozniak) , there was
discussion of a need to permit the storage of a trailer on the
street in front of a residence for an extended period of time to
allow for the loading and unloading of said trailer. It was not
deemed necessary to extend this privilege to semitrailers.
In order to accommodate this perceived need, the attached draft
resolution provides for the issuance of Temporary Trailer
Parking Permits. The resolution sets forth certain minimum
standards to be used in administering the issuance of such
permits, which are restated as follows:
1) the maximum duration of any permit shall be (7) seven days;
2) no more than twelve (12) permits may be issued to any given
address or trailer license number during any one year period;
3) no more than one (1) permit may be issued to a given address
during any given period of time;
4) the trailer must be legally parked in front of the address of
the permittee.

5) a permit issued to a trailer does not exempt the trailer or
the owner of said trailer from any established parking
restrictions, including parkinq prohibitions established for
the purpose of facilitatinq street sweeping.
E. Signs
In order to be effective, it will be necessary to post signs
giving notice of this parking restriction. In lieu of posting
such signs at frequent intervals on every street in the City,
the resolution directs that such signs be placed at all
entrances to the City and at certain other locations as deemed
appropriate by the City Manager to provide for adequate notice.
In addition, the Resolution stipulates the minimum size of the
sign and the sign lettering to ensure that such signs are
readable by passinq motorists_
RECOMMENDED ACTION
Staff recommends that the City Council adopt the attached
resolution restricting the parkinq of unattached trailers and
semitrailers on City streets.

RESOLUTION NO. 94
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NOORPARK, CALIFORNIA, PROHIBITING THE
PARKING OF UNATTACHED TRAILERS AND
SEMITRAILERS ON CITY STREETS
WHEREAS, Section 22507 of the California Vehicle Code (CVC)
provides for the prohibition or restriction of the stopping,
parking or standing of vehicles on certain streets or highways
during all or certain hours of the day; and,
WHEREAS, it has been determined that such parking restrictions
may be made to apply to specific types of vehicles, as specified by
the local agency; and,
WHEREAS, the City Council has determined that the public health
and safety would be better served if the parking of unattached
trailers and semitrailers on City streets were restricted; and,
WHEREAS, CVC Section 22507 also provides for the issuance of
permits exempting certain vehicles from specified parking
restrictions; and,
WHEREAS, the City Council has determined that such parking
permits, making trailers exempt from said parking restrictions
under certain specified conditions, should be made available to
and, upon request, issued to the owner of a trailer.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS:
SECTION 1. That, except as noted in Section 2 below, the
parking of any trailer or semitrailer upon any highway, street,
alley, public way or public place is hereby prohibited.
SECTION 2. That said the parking prohibition shall not apply to
any trailer or semitrailer meetinq the (..riteria for exemptions,
said criteria being defined as follows:
a) any trailer or semitrailer which is at all times while so
parked attached to a vehicle capable of moving the trailer or
semitrailer in a normal manner upon the highway, street,
alley, public way or public place.
b) any trailer or semitrailer which is in the process of being
loaded or unloaded.

c) any trailer which displays a Temporary Trailer Parking Permit
issued by the City in accordance with the provisions set
forth in Section 3 of this Resolution.
d) any trailer or semitrailer which is disabled in such a manner
and to such an extent that it is impossible to avoid
stopping, and temporarily leaving the disabled trailer or
semitrailer on that portion of the highway, street, alley,
public way or public place ordinarily used for vehicular
parking.
SECTION 3. That the City Manager shall establish policies and
procedures for the issuance of Temporary Trailer Parking Permits,
said policies and procedures to include the following minimum
provisions:
a) a permit shall be issued to an unattached trailer when the
owner or renter of said trailer requests said permit in order
to allow for the parking of said trailer on a City street for
an extended period of time for the purpose of loading and /or
unloading;
b) the maximum duration of any permit shall be (7) seven days;
c) no more than twelve (12) permits may be issued to any given
address during any one year period:
d) no more than one (1) permit may be issued to a given address
or trailer license number during any given period of time:
e) the permitted trailer must be Legally parked in front of the
address of the permittee.
f) a permit issued to a trailer does not exempt the trailer or
the owner of said trailer from any established parking
restrictions, including parking prohibitions established for
the purpose of facilitating street sweeping.
SECTION 4. That the City Manager is directed to place and
maintain signs giving notice of said parking prohibition at a
conspicuous location at each entrance to the City, as well as at
other additional locations as deemed necessary and appropriate by
the City Manager, to facilitate the proper and adequate notice of
said parking prohibition.

SECTION 5. That the minimum size of said signs shall be forty -
eight inches by thirty -six inches (4811 x 36 "), with sign lettering
having a minimum size of six inches (F > 111
