Paul Porter, Senior Planner DATE: February 8, 1994 (CC meeting of March 2, 1994) SUBJECT: PLANNING COMMISSION REVIEW OF RESIDENTIAL PLANNED DEVELOPMENT PERMIT NO. 89 -4 (MAJOR MODIFICATION NO. 1), VESTING TENTATIVE TRACT MAP NO. 4637 (MAJOR MODIFICATION NO. 1) AND ZONE CHANGE NO. 93 -3 Background On May 16, 1993, the City Council adopted Resolution No. 90 -673 approving Residential Planned Development Permit No. 89 -4 for construction of 257 residential townhouse units with three recreational areas, Vesting Tentative Tract Map No. 4637 for the residential townhouse lots and common open space areas and Zone Change No. 89 -2 to change the existing zoning from PC (Planned Community) to RPD- 13.38u. The project is located south of Mountain Trail Street between Mountain Meadow Drive and Cedar Spring Street (Assessor's Parcel No. 505 -0- 153 -01). Urban West Communities filed for a Major Modification to the above captioned project on November 29, 1993. As proposed, the revised project consists of 162 multifamily (Traditions) units on approximately 10.35 acres and 108 patio homes on approximately 11.67 acres. The Traditions will have an estimated sales price range from $140,000 to $180,000, while the patio home will have an estimated sales price range from $190,000 to $220,000. The proposed patio homes portion of the project provides a departure from other single family residential projects in the general area in that: 1) the front yard setbacks are smaller front yard setbacks than the normal front yard setback requirement of 20 feet for single family residences. This proposed project provides a setback of approximately 20 feet from the garage to the street and 10 feet from the front of the houses to the street. The proposed street width shown on the site plan is 30 feet. The applicant has verbally indicated they will increase the street width to 32 feet; 2) sidewalks will be provided on only one side of the street; 3) the proposed streets widths are narrower the standard width of 36 to 40 feet; and 4) proposed on- street parking will be allowed on only one side of the street (The streets are proposed to be private). PP02:08 :9411.24pMz\CC1 JMV 1 At the time of submittal of the project, staff informed the applicant that the revised project required a new filing of a Residential Planned Development and a Vesting Tentative Tract Map. Upon submittal of additional information from the applicant's attorney, staff agreed with the filing of a Major Modification for the proposed project pursuant to Section No. 8111 -7.1.3 of the City's Zoning Ordinance is appropriate for this proposed project. Discussion Section No.8111 -7.1.2 of the Zoning Ordinance requires that Major Modifications to permits be acted upon by the decision - making authority which approved the original permit. As a result Major Modifications are brought directly to the City Council for review without first being reviewed by the Planning Commission. This proposed project was discussed by the Community Development Committee (Lawrason and Perez) on February 7, 1994. The Committee recommended that this Major Modification first be reviewed by the Planning Commission for recommendations to the City Council. The Committee's recommendation was due to the fact that the modifications to this project such as: reduced front yard setbacks, on- street parking is provided on only one side of the street, and reduced street widths is a departure from what has been approved by the City in the past. It is expected that this project would go to the Planning Commission by April, 1994. Recommendation Direct staff to have the Planning Commission review the modifications to the proposed project at a public hearing prior to bringing the project to the City Council for public hearing and consideration.
