SUBJECT: Consider Resolution No. Off/Amending Resolution No.
94 -1056 Establishing Speed Limits for Certain Streets by
Deleting Therefrom Segment 14, Pecan Avenue
1. On August 17, 1994, the City Council adopted Resolution No. 94-
1056 establishing the prima facie speed limits for those
streets which require a Traffic Speed Survey to justify speed
limits to be enforced by radar devices.
2. The list of streets set forth in that resolution included Pecan
Avenue.
3. Pecan Avenue was added to the street segments included in the
recently completed Traffic Speed Survey because it was believed
that such a survey was required to support radar enforcement of
the speed limit posted on this street. That belief was based
on an understanding that residential streets exceeding one -half
(�) mile in length required such a Traffic Speed Survey.
4. The results of the Traffic Speed Survey showed that the 85th
percentile speed was 38.5 MPH. Based on this information, the
recommended and approved Speed Limit for Pecan Street was set
at 35 MPH.
DISCUSSION
Section 40802 (Exhibit 1) of the California Vehicle Code (CVC) sets
forth the language pertaining to Speed Traps. This section states
that in order to use radar devices to enforce speed limits, posted
speed limits must be supported by a Traffic Speed Survey. However,
this section also states that this section of the CVC does not

apply to local streets. The section goes on to define a local
street as either:
1. a street which meets all three of the following conditions:
• not more than 40' wide;
• not more than one -half mile long; and,
• not more than one lane in each direction; OR...
2. a street defined as a local street on the latest functional
usage map submitted to the Federal Highway Administration
(FHWA).
Since Pecan Street is more than one -half mile in length, it does
not meet definition #1 above. It has been recently determined,
however, that Pecan Street does meet definition #2 above. The 1992
Functional Classification System Map, recently prepared by Caltrans
and forwarded to the FHWA, identifies all of the Minor Collector,
Major Collector, Minor Arterial, Principal Arterial and Freeways in
the City. Those streets not so identified are, by definition,
local streets.
If this fact had been realized prior to the preparation of the
recent Traffic Speed Survey, Pecan Avenue would not have been
included in that study.
It would be appropriate, therefore, to delete Pecan Avenue from the
list of street segments listed in Resolution No. 94 -1056. Such an
action would allow for the posting of 25 MPH speed limit signs
consistent with the signs posted for other residential streets.
Adopt Resolution No. 94- amending Resolution No. 94 -1056 by
deleting therefrom Segment No. 4: Pecan Avenue and providing for
the placement of 25 MPH signs on said street.

Speed Trap
40802. A "speed trap" is either of the following:
(a) A particular section of a highway measured as to distance and %%ith
boundaries marked, designated, or otherwise determined in order that the
speed of a vehicle may be calculated by securing the time it takes the vehicle
to travel the known distance.
(b) A particular section of a highway with a prima facie speed limit
provided by this code or by local ordinance pursuant to paragraph (1) of
subdivision (b) of Section 22352, or established pursuant to Section 22354,
22357, 22358, or 22358.3, which speed limit is not justified by an engineering
and traffic survey conducted within five years prior to the date of the alleged
violation, and where enforcement involves the use of radar or other electronic
devices which measure the speed of moving objects. This subdivision does
not apply to local streets and roads.
For purposes of this section, local streets and roads shall be defined by
the latest functional usage and federal -aid system maps as submitted to the
Federal Highway Administration. When these maps have not been submitted,
the following definition shall be used: A local street or road primarily
provides access to abutting residential property and shall meet the following _
three,conditions:
(1) Roadway width of not more than 40 feet.
(2) Not more than one -half mile of uninterrupted length. Interruptions
shall include official traffic control devices as defined in Section 445. - -
(3) Not more than one traffic lane in each direction.
