Lindley, Assistant to the City Manager DATE: October 26, 1994 (CC Meeting of November 2) SUBJECT: consider ordinance Number , Emergency Preparedness and Identify the Membership of the Moorpark Disaster council Background The City Council is being asked to amend Ordinance Number 106 to clarify the membership of the Moorpark Disaster Council. In March 1989, the City Council adopted Ordinance Number 106 which provides for the preparation and carrying out of plans for the protection of persons and property within the City in the event of an emergency and the creation of a Disaster Council. The Ordinance identifies representatives who "shall" serve on the Disaster Council including the Mayor, City Manager, Deputy City Manager, Department Head, and representatives of civic, business, labor, veterans, professional, or other community based organizations up to a maximum of 15 members. Members of the original Disaster Council were appointed in June 1989 and tasked with the development of the City's Emergency Management Plan. The City's Plan was completed and the Council has been inactive since April 1991. As you are aware, the City now has an active Disaster Assistance Response Team (DART) comprised of 22 trained volunteers and an additional 21 currently in training. The State of California will cover volunteer disaster workers under its workers compensation fund if they sign an oath and are certified under a state recognized disaster council. This is important since volunteers may be injured during training or when responding to a disaster. 00260 Emergency Preparedness Ordiance October 26, 1994 Page 2 The City of Moorpark's Disaster Council has been recognized by the State, and the City is not required to take any additional steps to ensure that its DART members are covered under the States workers compensation fund. However, staff recommends that the City Council amend the Municipal Code, Section 2.20.040, Creation and Membership, by deleting the word "shall" and inserting the word "may," as shown in attachment "A ". This will provide greater flexibility, allow the City to retain a current list of Disaster Council members, and eliminate any possible concerns about the existence of the City Disaster Council. Since the Disaster Council meets only when needed, which could be once a year or less, staff recommends that members from the community not be appointed at this time. Community members could be appointed and then resign without ever having met. Instead, staff suggests that the Disaster Council may wish to create ad hoc committees from time to time, which could include representatives from civic, business, and professional groups. This would allow the City to tap into the wealth of knowledge and experience available in the community when needed. Staff recommends that the City Council recognize the following City positions as Disaster Council members: the Mayor, City Manager, Deputy City Manager, Department Heads, Disaster Preparedness Coordinator, Police Chief, and Fire Chief. These individuals are familiar with the City's Disaster Plan and, with the exception of the Mayor, have received Incident Command System (ICS) training. The City Council is scheduled to receive ICS training in January, 1995. Recommendation Staff recommends that the City Council approve Ordinance Number for first reading, which amends Ordinance Number 106 regarding Emergency Preparedness, and identify the following City positions as Disaster Council members: the Mayor, City Manager, Deputy City Manager, Department Heads, Disaster Preparedness Coordinator, Police Chief, and Fire Chief. 00261 ORDINANCE NO. AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA, AMENDING SECTION 2.48.040 OF CHAPTER 2.48 OF THE MOORPARK MUNICIPAL CODE PERTAINING TO THE MOORPARK DISASTER COUNCIL. WHEREAS, Section 8610 of the Government Code allows cities to create disaster councils by ordinance, and WHEREAS, Section 8612 of the Government Code provides for the certification of a local disaster council by the California Emergency Council, and WHEREAS, the City Council of the City of Moorpark adopted Ordinance Number 106 establishing the Moorpark Disaster Council in accordance with the Government Code, and WHEREAS, the California Emergency Council has "certified" the Moorpark Disaster Council, and WHEREAS, the City of Moorpark has formed a Disaster Assistance Response Team whose members are registered disaster service workers with workers compensation benefits under provisions of the State of California Labor Code Section 4351; THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA, DOES ORDAIN AS FOLLOWS: SECTION 1. Section 2.20.040 of Chapter 2.20 of Title 2 of the Moorpark Municipal Code is hereby amended to read as follows: Section 2.20.040 - Creation and Membership. The Moorpark Disaster Council is hereby created and shall � consist of the persons set forth in the following subsections. - The Mayor of the City, who shall be Chairman. - The Director of Disaster Services, who shall be Vice - Chair. - The Assistant Director of Disaster Services. ::: »:<; Suich. .Chiefs of 'emergency service as are provided for in a current emergency plan of the City adopted pursuant to this chapter. - Such representatives of civic, business, labor, veterans, professional, or other organizations having an official emergency responsibility, as may be appointed by the Mayor, so that the total membership does not exceed fifteen (15). 00262 SECTION 2. The City Council hereby directs the City Clerk to certify the passage and adoption of this ordinance and shall cause the same to be published or posted in the manner prescribed by law.
