SUBJECT: CONSIDER MINOR MODIFICATION NO. 12 TO PLANNED DEVELOPMENT
PERMIT NO. 1041 FOR REVISION OF COLOR PALATE FOR 87 HOMES
OF TRACT 3963 -4 (WARMINGTON CAMPUS HILLS ASSOCIATES)
Background
On June 14, 1994, Warmington Campus Hills Associates filed Major
Modification No. 3 to Planned Development Permit Number 1041 and
Tract 3963 in order to constructed 87- single family homes in
completion of Phase 4. The City Council adopted Resolution No. 94-
1051 conditionally approving Major Modification No. 3 on July 20,
1994. Conditions of Approval regarding the color of the homes are
as follows:
5. S -shape concrete tile roofing shall be installed, consistent
with the approved tiling for the entire tract. The roof
colors for the 87 homes shall match the existing homes and
shall be approved by the Director of Community Development.
6. All of the proposed colors (roofing, trim, and buildings) for
the 87 homes (in completion of Phase 4) shall match the
existing 44 homes already constructed within Phase 4 of the
Tract and be complementary to those homes constructed as part
of Phases 1 -3 within the entire Tract. All colors for the 87
homes shall be approved by the Director of Community
Development.
Discussion
On November 3, 1994, Warmington Campus Hills Association applied
for Minor Modification No. 12 requesting a Modification of the
color palette for the remaining 87 homes. Condition No. 19 of
Major Modification No. 3 requires any minor modifications to
Planned Development Permit Number 1041 and Tract 3963, as a result
of Major Modification Number 3 ( Warmington Homes) be presented to
the City Council as an Action /Discussion Item.

The applicant has provided the Board of Directors of the Campus
Hills Home Owners Association with a sample board of the exterior
palette materials. The Board of Directors of the Campus Hills
Homeowners' Association has reviewed and has indicated in a letter
to the Director of Community Development dated October 11, 1994
that the specified colors will fit into the overall architectural
scheme of the community and approved the color mix for the
applicant's exterior palette.
The Director of Community Development has reviewed the exterior
color palette and agrees that the proposed modification of the
exterior colors of the remaining 87 homes is compatible with the
existing development. Therefore the Director approved the Minor
Modification on November 23, 1994 with the appeal period ending on
Friday December 9, 1994. If no appeal has been filed, the
Director's decision will stand. Pursuant to Resolution No. 523,
the Director has the authority to approve Minor Modifications.
This matter is being presented to the City Council pursuant to
Council policy. Should the City Council or any interested party
wish to appeal the Director's decision, the next available hearing
date would be January 4, 1995.
Recommendation:
Uphold the Director of Community Development's decision to approve
Minor Modification No. 12.

materials and color board pursuant to conditions 5 and 6 of
Major Modification No. 3 to RPD -1041.
Action: Approved
The above approval is made subject to the following condition.
California Environmental Quality Act (CEQA) Compliance: This
Department has reviewed the project to ascertain if there will be
a significant effect on the environment. It has been determined
that this project is categorically exempt from CEQA requirements as
a Class 1 exemption for minor alterations.
Ordinance Compliance: Based upon the information and findings
developed by staff, it has been determined that this application,
with the attached conditions, meets the requirements of Moorpark
Ordinance Code Section 8111 -2.1.2 - Permit Standards, in that:
a. The Minor Modification is consistent with the intent and
provisions of the City's General Plan and the City's Zoning
Ordinance;
b. The Minor Modification is compatible with the character of
surrounding development;
C. The proposed Minor Modification is not obnoxious or harmful,
and does not impair the utility of neighboring property or
uses;

d. The Modification is not detrimental to the public interest,
health, safety, convenience, or welfare.
Appeals: As stated in Section 8111 -8, within 16 calendar days
after the permit has been approved, conditionally approved or
denied, any aggrieved person may file an appeal of the approval,
conditional approval or denial with the Community Development
Department who shall set a hearing date before the City Council to
review the matter at the earliest convenient date.

Warmington Homes has provided the Board of Directors of the Campus Hills
Homeo«-ners-Association with a sample board of exterior palette materials which they
intend to use on the 87 lots currently under development. They have asked the Board to
re,,iew the sample board color mix and indicate our approval to you in writing.
The Board of Directors of the Campus Hills Homeowners Association has reviewed
samples of exterior palette materials provided to us by Warmington. A listing of these
materials is attached to this letter. If Warmington builds homes with the specified colors
on this sample board and included on this list, we believe that their homes will fit into the
overall architectural scheme of our community very well. Accordingly, we approve of this
current color mi-�c for their exterior palette.
