SUBJECT: Resolution to Vacate Certain Surplus City Owned
Right -Of -Way Located on the Property Known as
Gisler Field V- 95 -01, Deed Property to Moorpark
Redevelopment Agency, and Approve a Lot Line
Adjustment
•
The City Council is requested to take the following actions: (1)
vacate a portion of surplus City owned right -of -way known as Lassen
Avenue, La Palma Court, and Gisler Avenue which is also known as
Liberty Bell Road, (2) by grant deed convey the vacated right -of-
way to the Moorpark Redevelopment Agency, and (3) approve a lot
line adjustment creating two lots of record for the property known
as Gisler Field.
I. DISCUSSION ON VACATION•
The Agency is requesting that the City Council vacate the
City owned right -of -way (streets) located south of
Poindexter Avenue, north of Los Angeles Avenue, east of
Moorpark Estates, and west of Chaparral School and K-
Mart. After the right -of -way is vacated convey the
property to the Agency by grant deed. The Agency will
then convey portions of the Agency property for
commercial development, housing development, and for City
park purposes.
B. Street Vacation:
The final design of the streets and all necessary
easements shall be provided as final maps for the
commercial, housing and park projects are approved and
filed.

C. Report of Conformity
On February 27, 1995, the Planning Commission of the City
of Moorpark adopted Resolution No. 95 -302 (attached)
finding the proposed street vacation to be in conformance
with the Moorpark General Plan. This action was taken to
satisfy Section 65402 of the Government Code of the State
of California.
D. Resolution of Intent•
Local agencies may vacate surplus street right -of -way by
adoption of a resolution pursuant to the requirements of
applicable provisions of the Streets and Highways Codes
of the State of California. Those provisions require a
public hearing to be conducted and due notification of
said hearing to be given. On February 22, 1995, the City
Council adopted Resolution No. 95 -1103 (attached),
stating its intent to proceed with the vacation of the
subject surplus street right -of -way. Said Resolution
called for a public hearing to be held on March 15, 1995,
to hear any objections to this proposed action.

It is suggested that the Moorpark Redevelopment Agency pay $5.25 a
square foot for the property. This is the cost per square foot
that Ventura Pacific Properties I, Inc. is paying for the property
and the value set in the Summary Report. The payment to be made
from future tax increment revenues. The right -of -way contains
approximately 5.45 acres. The City will eventually receive half of
the 5.45 acres for park purposes (2.73 acres). It would be
appropriate for the Agency to pay $623,180 for the right -of -way to
be utilized for the commercial development and the housing
development.
The City Council is being requested to deed the vacated
right -of -way to the Moorpark Redevelopment Agency. This

property will be sold to Ventura Pacific Properties I,
Inc., in accordance with the Disposition and Development
Agreement for the development of 15 ± acres for
commercial development. There is no attachment for this
action. The right -of -way will be conveyed to the Agency
by grant deed.
III. DISCUSSION ON LOT LINE ADJUSTMENT:
The City Council is being requested to approve a lot line
adjustment for the property known as Gisler Field. The
lot line adjustment will (1) decrease the number of lots
to two (see Exhibit "A" attached), set the boundary for
the commercial development, and (3) enable the Agency to
expedite the transfer of land to Ventura Pacifica for the
development of the new shopping center.

Staff recommends that the City Council take the following actions:
1. Adopt the attached resolution vacating the right -of -way.
2. Authorize the deeding of the vacated right -of -way to the
Moorpark Redevelopment Aqency.
3. Approve the lot line adjustment.

RESOLUTION NO. 95 -1103
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, DECLARING ITS INTENT
TO VACATE LASSEN AVENUE AND OTHER
RIGHTS -OF -WAY AS SHOWN IN EXHIBIT "A"
WHEREAS, Lassen Avenue and other rights -of -way has been dedicated
to the City for public street purposes via the recordation of
Parcel Map 21PM35; and
WHEREAS, subsequent to said recordation, the design of the
circulation system for the properties to be served by said street
have been significantly amended; and
WHEREAS, the circulation system no longer requires and does not
include the public street identified on Exhibit "A ".
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
Section 1. That the public interest, convenience and
necessity so requiring, it is the intention of the City Council of
the City of Moorpark to vacate the rights -of -way as identified on
Exhibit "A" which rights -of -way are in the City' of Moorpark,
California. Further particulars with reference to said proposed
street and rights -of -way vacation may be obtained from certain maps
and reports on file in the office of the City Clerk of the City of
Moorpark.
Section 2. That the Planning Commission of the City of
Moorpark has determined that said street and rights -of -way vacation
is in conformance with the Moorpark General Plan as required by
Section 65402 of the Government Code of the State of California.
Section 3. That the City Council of the City of Moorpark
hereby elects to proceed with said vacation pursuant to the
provisions of Part 3, Division 9 of the Streets and Highways Code
of the State of California.
Section 4. That 7:00 p.m. on the 15th day of March, 1995, in
the Community Center at 799 Moorpark Avenue in the City of
Moorpark, California, is hereby fixed as the time and place at

which a hearing will be held before the City Council, at which time
and place all persons interested in or objecting to the proposed
vacation may appear and be heard.
Section 5 The City Clerk is authorized and directed to post
notices of said proposed vacation conspicuously along the line of
the street to be vacated at least ten (10) days before the date of
said hearing. Such notices shall be prepared and posted pursuant
to Section 8322 of the Streets and Highways Code of the State of
California.
Section 6. This resolution shall be posted in three public
places in the City of Moorpark.

THERE WILL BE A PUBLIC HEARING before the City Council at 7:00 P.M.
on the 15th day of March, 1995, to be held in the Community Center
at 799 Moorpark Avenue in the City of Moorpark, California. The
Purpose of the Public Hearing is to consider the VACATION of La
Palma Court and Gisler Avenue and a portion of Lassen Avenue which
are considered surplus right -of -way as described herein. All
persons interested in or objecting to the proposed vacation may
appear and be heard.
On February 22, 1995, the City Council of the City of Moorpark
adopted Resolution No. 95 -1103, a resolution of Intent to Vacate

RESOLUTION NO. PC 95 - 302
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF MOORPARK, CALIFORNIA FINDING THAT THE
VACATION OF LA PALMA COURT, LASSEN AVENUE AND
GISLER AVENUE IS IN CONFORMANCE WITH THE
GENERAL PLAN OF THE CITY OF MOORPARK
WHEREAS, vacation of a portion of Lassen Avenue now in use for
public purposes, and the vacation of La Palma Court and Gisler
Avenue (also known as Liberty Bell Road) which streets are not use
for public purposes, is required for the development of the
property located north of Los Angeles Avenue, south of Poindexter
Avenue, east of Chaparral School and K -Mart Shopping Center, and
east of Moorpark Estates; and
WHEREAS, such development is being approved by the City of
Moorpark and the Moorpark Redevelopment Agency; and
WHEREAS, the Planning Commission of the City of Moorpark has
considered the matter of vacating the rights -of -way as depicted on
Exhibit "A" attached; and
WHEREAS, Section 65402 of the Government Code of the State of
California requires that no street shall be vacated until the
location, purpose and extent has been reported upon by the planning
agency of the city as to conformity with the general plan.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF
MOORPARK DOES HEREBY RESOLVE:
Section 1. The Planning Commission hereby finds that the
vacation of the rights -of -way as generally shown on Exhibit
"A" attached is in conformance with the Circulation Element of
the adopted General Plan of the City of Moorpark.
