Myers, Solid Waste Coordinator DATE: February 21, 1995 (CC Meeting of March 1, 1995) SUBJECT: Consider Solid Waste Collection Rate Increase to Multi- family Can Service Rates in Zone III, Amending Section 1 of Resolution 94 -1091 for the Purpose of Updating the Solid Waste Management Fees and Services. SUMMARY The City Council is being asked to approve a $1.14 increase to the monthly residential solid waste collection rates in multi - family can service Zone III (Track numbers 3070 and 4170 - Varsity Park Patio Homes), effective March 1, 1995. BACKGROUND Prior to 1990, the Varsity Park Patio Homes Homeowners Association (HOA) negotiated solid waste collection rates with their hauler, G.I. Rubbish. In 1990, when the City franchised for solid waste and recycling services, the City recognized the existing rates for all multi - family residents receiving curbside can collection service. Such multi - family residential areas were identified in the franchise agreements as Zones I - III and at that time, each zone received a different negotiated rate. The Varsity Park Patio Homes HOA is located in Zone III. Since 1991, the City has increased the base (refuse) rates in Zones II and III incrementally each year to equal Zone I in order for all three zones to pay the same amount for curbside can collection. The current rates in Zone I - III are lower than the rates charged to regular single - family residents, although the services provided are the same. The only difference is the billing systems (central versus individual) utilized. However, the franchise agreements do not specify how haulers are to bill the residents in Zones I - III. The Varsity Park Patio Homes HOA Board has recently taken action to have G.I. Rubbish bill the (250) homeowners individually for solid waste collection services, effective March 1, 1995. G.I. Rubbish previously provided one bill to the HOA and the Association included the solid waste and recycling service fees with the residents' homeowners association assessments. G.I. Rubbish indicated that they preferred to invoice the HOA rather than directly bill the homeowner. However, due to the HOA's action, G.I. Rubbish is requesting that the rates set by the City Council for the Varsity Park Patio Homes (Zone III) be amended. 00153 Honorable City Council Zone III Rates March 1, 1995 Page 2 G.I. Rubbish has requested that the Zone III monthly rates of $16.26 be increased ($1.14) to equal the single - family monthly rate of $17.40, since the services provided are the same and the future billing methods will also be the same. Rubbish change its billing method to bill each homeowner directly. The City did not have any input in the decision of HOA Board. Although a recent mailing by the HOA to their residents incorrectly attributed the billing change to a City action, the HOA's management company had previously indicated that they had been experiencing financial losses due to residential delinquencies in HOA assessment payments. G.I. Rubbish bills for the number of houses in the HOA and it appears that when the HOA paid the G.I. Rubbish bill, they were covering the costs of the delinquent residents. Staff reviewed this matter and has determined that G.I. Rubbish's request provides equity among rates charged to residents receiving identical refuse collection and billing services. RECOMMENDATION (Roll Call Vote) Staff recommends that the City Council: 1. Approve the monthly solid waste collection rate increase to the multi- family can service rates in Zone III in the amount of $1.14. 2. Amend Section 1 of Resolution 94 -1091 for the purpose of updating the Solid Waste Management Fees and Services. Attachment 00154
