Traffenstedt, Senior Planner -D5T- DATE: March 29, 1995 (CC Meeting of 4/5/95) SUBJECT: CONSIDER PRELIMINARY COST ESTIMATES AND SCOPE OF WORK FOR DEVELOPMENT OF CITYWIDE TRAFFIC MITIGATION FEE PROGRAM BACKGROUND An implementation measure for the City's General Plan Circulation Element is the adoption of a transportation improvement fee program, which will enable circulation (roadway and bikeway) improvements to be funded by new development and, in conjunction with a City capital improvement program, will determine estimated dates for construction. A phasing /improvement plan is to be included that identifies project specific improvement responsibilities and requires fair share funding for cumulative circulation improvements. The City Traffic Engineer and Community Development Department have been involved in data collection to assist with the development of a Citywide Traffic Mitigation Fee Program. Preliminary cost estimates for the roadways anticipated to be funded by a Citywide Traffic Mitigation Fee are attached (Attachments 1 and 2) and are discussed in the following section.. Also included in this report is a suggested scope of work for remaining tasks to be completed by staff to develop the Citywide Traffic Mitigation Fee Program. DISCUSSION Cost Estimates The attached summary cost estimates prepared by the City Traffic Engineer are for three planned roadways: Route 118 bypass, Route 23 bypass, and the Broadway extension. Since the Broadway extension is proposed to be constructed in conjunction with development of the Specific Plan No. 8 area (and any County development of Happy Camp Canyon Regional Park), staff is not proposing that the funding of Broadway be included in the Citywide dst- 03- 29- 95111: 20amC:\WP5I\STFRPT\CC4- 5CTY.WID 00 -905 The Honorable City Council March 29, 1995 Page 2 Traffic Mitigation Fee Program. Staff also gave consideration to other future planned roadways, including but not limited to Casey Road extension, Spring Road extension, and "C" Street, but determined that these roadways should be funded entirely by private development. The underlying premise is that any roadway or roadway improvement required to provide access for a development project, and /or to mitigate direct project impacts, should be funded by that development project. The intent of the Citywide Traffic Mitigation Fee Program would be to fund the transportation improvements required to solve cumulative traffic problems. Routes 118 and 23 bypass facilities are intended to mitigate cumulative traffic problems. Route 118 is the more critical facility, since it would relieve projected traffic congestion on Los Angeles Avenue. Attachment 1 provides the cost estimates for Route 118 /Route 23 interchange improvements. Four different interchange options are analyzed. Caltrans has not reviewed the conceptual design options, and staff does not know at this time whether all options are feasible. Attachment 2 provides the cost estimates for the construction, engineering, and right -of -way acquisition for the extensions of Routes 118 and 23 within the City as arterial roadways. The summary cost estimates given in the attachments for Routes 118 and 23 are based on the following assumptions: The horizontal alignment is based on the Circulation Element of the General Plan. The width of roadway segments is based on the Circulation Element of the General Plan (assumes six -lane arterial for Route 118 and four -lane arterial for Route 23). Geometric standards and construction items are based on the County of Ventura Road Standards and are based on an at -grade design (i.e., not based on Caltrans standards). Unit prices of the Ventura County Public Works Agency were used; all dollar values are 1.994 dollar values. Right -of -way cost based on unit prices obtained from real estate agents experienced in the City of Moorpark and Ventura County, and an assumed mix of different land use categories. The total cost estimated for the four different Route 118 /Route 23 interchange options vary from approximately $9 million to $88 million. The full freeway -to- freeway connection for that interchange ( option 4 ) is estimated to cost over $88 million, given the expensive bridge work that would be required. The least dat- 03- 29- 95111: 20amC: \WP51 \STFRPT \CC4- 5CTY.WID oo ?ss The Honorable City Council March 29, 1995 Page 3 expensive option (Option No. 2), estimated at approximately $9 million, would only provide for a connection to State Route 118, and would not provide for southbound and northbound movements. Option 1 would cost approximately $2 million more than Option 2, and would provide for connections to the State Route 23 bridges and a ramp modification at New Los Angeles Avenue. Option 3, estimated to cost approximately $19 million, is a combination of Options 1 and 2, but does not require a New Los Angeles Avenue ramp modification. Attachment 1 includes exhibits which illustrate the different design options. The total cost for construction of the Route 118 and 23 bypass facilities would vary dependent upon the interchange design proposed. The following cost summary table gives the total estimated cost for the construction of the Route 118 and 23 bypass facilities in the City. The attachments should be referred to for the cost breakdown for construction, engineering, and right -of -way acquisition. Actually, a significant portion of the future right -of- way could probably be obtained as a dedication condition in conjunction with approval of subdivision maps within specific plan areas or through negotiated development agreements with owners of the specific plan properties. Scope of Work for Future Work Tasks The County of Ventura recently approved a traffic impact mitigation fee. The Final Engineering Report, Traffic Impact Mitigation Fee Analysis Phase 1, July 1994, is on file with the Community Development Department. Attachment 3 consists of excerpted information from the County report, which provides a discussion of anticipated Federal /State funding, and includes tables comparing adopted traffic impact fees for various jurisdictions and the proposed County fees. dst- 03- 29- 95111: 20amC:\WP5I\STPRPT\CC4- 5CTY.WZD 00297 The Honorable City Council March 29, 1995 Page 4 The factors that must be considered, in addition to cost estimates, to determine the appropriate City traffic mitigation fee, include potential Federal /State funding, existing City revenue sources, and existing and /or future development that could be charged a fee or assessment to pay for the construction of the Routes 118 and 23 bypass facilities. Attachment 4 is a table that shows already approved projects that were conditioned to agree to participate in any future assessment district or other financing technique to mitigate cumulative traffic impacts. Estimated cumulative totals for dwelling units, commercial and industrial building square footage, and acreage for commercial and industrial projects are included. As identified in the second footnote for that table, several of the Mountain Meadows residential projects had a condition imposed that requires participation in a citywide traffic mitigation program; however, this condition is not applicable to future homeowners. In other words, the fee would only be applicable to those dwelling units not yet sold at the time of fee adoption. Attachment 5 is a table that provides an estimate of future dwelling units and commercial /industrial development potential by zone designation and approximate acreage and dwelling units (for vacant land that does not yet have entitlement approvals). The information in this table is important, because the projected future dwelling units and commercial and industrial acreage provide some indication of future revenue potential. To give an example of potential fund revenue for vacant land, not yet approved for development, staff calculated future dwelling units as 4,864 (based on 1,340 future dwelling units plus 3,524 maximum density dwelling units for specific plans), and estimated combined acreage for commercial, industrial and institutional as 310 acres (based on approximately 232 future commercial /industrial acres plus approximately 78 acres of currently proposed commercial/ institutional land uses for Specific Plan areas 1 and 8). Staff then applied a $3,000 per dwelling unit and $16,800 per commercial/ industrial/ institutiona L acre estimated fee amount as follows: 4,864 du's x $3,000 = $14,592,000 310 acres x $16,800 = $ 5,208,000 $19,800,000 This estimated revenue of $19,800,000 is less than one -half of the amount required to fund the least expensive Route 118 /Route 23 bypass facilities option, as summarized in Table 1 on page 3 of this staff report. dat- 03- 29- 95111: 20amC:\WP5I\STFRPT\CC4- 5CTY.WID 00298 The Honorable City Council March 29, 1995 Page 5 If the number of dwelling units in this example is increased by 1,380, to reflect the density limit for the specific plan areas, a $3,000 per dwelling unit fee would result in an additional $4,140,000, which would increase the total revenue from $19,800,000 to $23,940,000. In addition to potential future Citywide Traffic Mitigation Fee revenue, there is an existing Citywide Traffic Mitigation Fund that had a balance of $661,314 as of January 31, 1995 (derived from a $3,000 per dwelling unit mitigation fee that was imposed on several residential projects, and a $200,000 payment for the Mail Marketing project, as identified in Attachment 4). The Los Angeles Avenue Area of Contribution (LA AOC) fund might also be a potential revenue source. Further review of planned improvement projects is required to determine if existing or anticipated LA AOC revenue may be in excess of that required to fund planned projects, and if any excess can be applied to Citywide Traffic Mitigation. Attachment 6 shows that the balance of the City's LA AOC fund was $6,981,145 as of June 30, 1994 (this amount includes the cash balance as well as accounts receivable for a loan to certain properties for the Mission Bell Assessment District AD- 92-1). Attachment 7 is a table identifying anticipated LA AOC revenue, based on already approved projects, for which the LA AOC fee has not yet been collected (or not fully collected) as of March 1995. This report is intended to initiate discussion regarding what roadway improvements should be funded by the Citywide Traffic Mitigation Fee Program and to receive Council authorization to proceed with other tasks required to develop and implement a fee program. Tasks yet to be done include: Obtain Caltrans review and comments on the conceptual interchange and roadway designs and cost estimates. Develop a recommendation regarding the appropriate future Route 118 /Route 23 interchange improvements to be funded by the City's Program. Revise right -of -way estimates to take into consideration actual planned land use (e.g., commercial land is probably over - estimated), and to deduct the cost for the future Route 118 /Route 23 right -of -way within the specific plan areas. Analyze potential Federal /State funding and revise the estimated Program costs based on this funding assumption. dst- 03- 29- 951 11: 20amC: \WP5I \STFRPT \CC4- 5CTY.WID 0 0?99 The Honorable City Council March 29, 1995 Page 6 Determine if any portion of the LA AOC funds could be transferred to the Citywide Traffic Mitigation fund (after all planned LA AOC projects are completed). This will require updating of the AOC and is a planned item of work in the 1994- 1995 fiscal year. Develop a recommendation regarding whether existing development should help fund the Citywide Traffic Mitigation Fee Program. Determine if all future development will participate in the Citywide Traffic Mitigation Fee Program. Develop an estimate of potential revenue from County projects, if a reciprocal agreement is executed between the City and the County. Develop a recommendation regarding the appropriate fee for the different land use categories. Develop a capital improvement program, which will contain the streets and highway segments to be funded, schedules for construction based on anticipated revenue, and clarify what level of development can be accommodated on existing designated state highways and City roadways, based on City and Regional Transportation Plan level-of-service standards. Coordinate with the County and Ventura County Transportation Commission regarding regional =improvements to be cooperatively funded. Develop a draft ordinance and. fee resolution RECOMMENDATION 1. Review the staff report and attachments. 2. Discuss and provide direction to staff regarding future roadways to be funded by a Citywide Traffic Mitigation Fee. 3. Direct staff to proceed with the development of a Citywide Traffic Mitigation Fee through completion of the tasks outlined in the staff report 4. INTRODUCTION The objective of this cost estimate is to determine the major cost elements and to prepare a cost estimate for each of the following roadway segments: A. SR118 west from SR23 to Los Angeles Avenue west of Gabbert Road. B. SR23 from SR118/SR23 junction to Boardway Road. C. Broadway Road from Walnut Canyon Road to SR118 including Alamos Canyon Road Interchange. II. CRITERIA Criteria for the cost estimate includes: Horizontal alignment based on the Circulation Element of the General Plan. • Width of roadway segments based on the Circulation Element of the General Plan. • Geometric standards and construction items followed the Road Standards of County of Ventura, except the Alamos Interchange, which followed the Caltrans standards. Some actual construction practices might vary if City of Moorpark undertook the construction. However, the total estimated costs are deemed to be appropriate. • Unit prices of the Ventura County Public Works Agency were used, except for the Alamos Interchange, which the Caltrans cost data were used. All dollar values are 1994 dollar values. • Right of way cost based on unit prices obtained from real estate agents experienced in the City of Moorpark and Ventura County, and an assumed mix of different land use categories. \028069.RPT \dc 1 00314 III. ATTACHMENT 3 D. ANTICIPATED FEDERAL/STATE FUNDING: 1) County Road Improvements In determining the amount of funding that might be allocated to the projects from existing sources, a conservative approach was taken. The history of transportation funding in the recent past is that several traditional sources of revenue reserved for transportation have been lost. This has resulted in almost all available funding currently being completely utilized for routine ongoing road maintenance and administration purposes. Recent action by the U. S. Congress in financing portions of the federal deficit by use of gas tax funds, and less than full funding for authorized federal transportation programs make dependence on continuation of federal or state funding beyond the current year for local road projects a questionable strategy. Accordingly, anticipated funding sources for county road improvements do not include state/federal funding, as these funding sources cannot be guaranteed. The availability of state /federal funding for required improvements to conventional state highways and freeways is considered differently and is discussed later in this subsection. 2) Freeway and Conventional State Highway Imrovements The determination of how to allocate a fair share of the cost of projected improvements to the state highway system within the unincorporated area of Ventura County was problematic. Caltrans District 7 personnel were consulted and they were helpful in providing recent examples of project applications, project cost estimates and other relevant data. While the data and assistance were helpful, it did not lend itself to a specific mathematical formula or model that could be used to determine a "fair share" allocation of the cost of those improvements to the local jurisdiction. One might argue that the entire state highway system is the responsibility of the state, in that the state receives a substantial portion of federal and state gas tax revenues for the maintenance and upgrade of the state highway system. However, the recent failure of a state transportation bond issue and the failure of Ventura County to pass a transportation sales tax in 1990 has exacerbated the problem of transportation funding. The California Transportation Commission has identified a funding shortfall of $3.3 billion in the 1994 State Transportation Improvement Program (STIP). Accordingly, VCTC's ability to fund future Caltrans projects through the STIP is severely limited. Only those projects currently identified as funded in the approved flexible congestion relief priority list can be reasonably assured of funding through the STIP. Also of relevance is the decision of Concerned Citizens of Calaveras County vs Board of Supervisors (1985) 166.90, which essentially requires local government to ensure that there will be funds available to make all improvements to the state highway system that the local agency's general plan indicates will be needed to adequately serve projected growth. The final factors considered are the provisions of the CMP which require that a deficiency plan be prepared when any road segment falls below LOS E, and the provisions of the County General Plan, which currently block new discretionary development unless a full funding mechanism has been established for road improvements needed to maintain an acceptable LOS on the roads serving that development. Because traditional federal and state funding sources will not be adequate to fully fund the state and federal highway improvements necessary to support the projected growth in Ventura County, and because local government will have tO make up the differences, it seems 00379 prudent for the county to establish a mechanism to fund its anticipated "fair" share of Such improvements. The important question is what is a "fair share "? Models had to be developed which incorporated all of these diverse factors and approximated, to the extent of the data and guidance available, an appropriate "fair share ". An important issue is the cost of mainline freeway improvements. Costs may well be as high as $5 - 10 million per lane mile, considering the cost of structures, rights of way and other factors. The high unit costs of mainline freeway improvements had to be appropriately allocated or these costs would skew whatever model was developed. In attempting to determine an appropriate allocation percentage, examples of local agency or developer participation with Caltrans on freeway mainline improvements were provided by Caltrans District 7 personnel, and were reviewed. The local agency or developer participation on these projects ranged from 8 to 15% of the total cost of the improvements. The Intermodal Surface Transportation Efficiency Act (ISTEA) requires the establishment of a National Highway System (NHS) to provide an interconnected system of principal arterial routes which will serve major population centers, meet national defense requirements, and satisfy several other national priorities identified in ISTEA. Accordingly, a higher -percentage of intercounty and interstate traffic can be expected on the NHS, which is expected to encompass a substantial portion of the freeways in the County. This supports the position that the local increased traffic resulting from development and, consequently, the local government's fair share of the improvement costs will be significantly less than 100% It was decided to use ISTEA as a model for this portion of the fair share cost apportionment. Under ISTEA, federal funding of eligible transportation projects in California is approximately 88.5 % and the local share is 11.5 %. As the NHS consists of the heaviest traveled and highest priority transportation corridors in the state, the assumption was made that future requirements on these transportation corridors would be supported and funded to at least the level set forth in ISTEA. This percentage was within the range of experiential percentages noted above and was, therefore, considered to be reasonable. With regard to conventional state highways such as Route 150, this assumption is not as supportable. Conventional highways carry a higher percentage of intra- county traffic, there is substantially less inter - county traffic on most of these routes, and the increase in traffic on these routes would seem to result primarily from traffic generated by growth within the county. In a discussion with VCTC staff, it was indicated that probably less than 10% of current traffic on conventional state highways can be attributed to out of county origins. A detailed estimate of this traffic would require significant and costly analysis. The assumption was made that the projects shown as funded in the CMP and on the approved FCR priority list (Table 4) would be funded through the VCTC. The project } OU380 costs for conventional state highway improvements were then discounted by the anticipated amount of available FCR funding. The assumption was then made that the State and Local Transportation Partnership Program ( SLTPP), commonly known as SB -300, or a similar successor program, would continue to assist local agencies to accomplish qualifying work. The percentage of state contribution to SLTPP projects has averaged approximately 15% since inception, and it was decided to utilize the SLTPP percentage as a model for determining a fair share allocation for conventional state highway improvements. The local share contribution on such projects is 85 %. (Where other state funds are utilized, the project would not be eligible for SLTPP funding, but on the average this was considered to be a reasonable model.) State Route 33 from Casitas Springs to Oak View was considered a special exception to the models developed previously because this portion of State Route 33 is currently close to exceeding the acceptable LOS identified in the General Plan. The General Plan does not call for improvements to Highway 33 north of Oak View. Construction of the Casitas Springs By -pass, as identified in the VCTC FCR priority list (Table 4, escalated to 1994 dollars), is estimated to cost $32,000,000. Construction of this by -pass should alleviate the current congestion encountered on this portion of the roadway. State Route 33;is currently operating very close to the upper limit of LOS "E" and it would not be correct to attribute responsibility for funding the entire $32,000,000 solely to future county -wide development. The existing traffic from the 1993 CMP traffic counts is 20,100 vehicles per day (VPD). The projected traffic volume for year 2010 is 24,000 VPD. The cost of improvements is $32,000,000. The fair share of improvements is calculated based on the percentage increase in traffic over the current traffic volume to the year 2010 projected traffic volume. (24,000 - 209100) x $32,000,000 = $5,200,000 24,000 On this basis, the amount to be apportioned to future development is $5,200,000. In that the cost of this project has already been discounted to approximately 16 %, no further adjustment was made. The remainder of the cost of this project will have to be made up from other sources. E. TRAFFIC INFLUENCE ZONES: In reviewing the methodology by which some other counties have developed traffic mitigation fees, it was observed that traffic influence zones were established on a geographical basis.
