T. FINANCIAL) Background On February 2, 1995, C. T. Financial filed Lot Line Adjustment 95- 2. This request is to adjust the property line between Parcels A and B (Assessor Parcel numbers 500 -0- 350 -475 and 500 -0- 350 -495) which are located in the Carlsberg Specific Planning Area (SP 92- 1). These parcels are owned by Simi - Moorpark Freeway partnership and Conejo Freeway Properties partnership. Both partnerships are managed by Carlsberg Financial Corporation (C.T. Financial). The purpose of this Lot Line Adjustment is to adjust the property line between the two partnerships to conform to the boundaries of the proposed City park and the nature park which will be built as part of the Specific Plan. This Lot Line Adjustment will ensure that the improved park remain in Parcel A and that the nature park remain in Parcel B, and that each partnership retains approximately the same acreage that existed before the Lot Line Adjustment. The lots conform with all the requirements of the Residential Planned Development zone. The chart below illustrates the current and proposed lot sizes: Lot Number Present Lot Size- Proposed Lot Size Parcel A 271.04 acres 269.59 acres Parcel B 204.30 acres 205.75 acres All required legal documents have been reviewed and approved by the City Engineer. The Community Development Department has reviewed the request and determined that it meets all applicable codes and resolutions. 00060 The Director of Community Development approved the Lot Line Adjustment on May 5, 1995, with the appeal period ending May 22, 1995. This matter is being presented to the Council as a courtesy. In the event that the Council wishes to appeal the Director's decision, it may do so. Should the Council desire to appeal, it should set a hearing date. The next available hearing date is June 7, 1995. Financ:ia 2800 28 St. Suite 200 Santa Monica, Ca, 90405 This Lot Line Adjustment is hereby approved subject to the condition that all existing easement of Recorded at the time of approval of this Lot Line Adjustment shall remain in effect after the Lot Line Adjustment is approved. The approval expires in 180 days unless the attached exhibits are recorded at the Ventura County recorders Office prior to-the-expiration date. FINDINGS: This Lot Line Adjustment complies with the City of Moorpark Municipal Code in that neither a greater nor a lesser number of parcels than originally existed has been created and all the resulting lots will conform to all applicable zoning, General Plan, and Specific Plan requirements. COMPLIANCE WITH CALIFORNIA ENVIRONMENTAL QUALITY ACT: This Department has reviewed the project and found it to be categorically exempt according tc Section 15305 of the State Environmental Impact Report Guidelines (Class 5: Minor Alterations in Land Use Limitations). 00082 ATTACHMENT 1 RIGHT TO APPEAL: Pursuant to Section 8163 -4.1.3 of the City of Moorpark Municipal Code, any aggrieved party may appeal this Lot Line Adjustment approval within sixteen calendar days after such approval. Such an appeal must be made by filing an appeal form and submitting the required fee with the Department of Community Development of the City of Moorpark. Appeal forms may be obtained from the Department Of Community Development. If an appeal has been timely filed, the Department of Community Development will schedule a hearing date before the Planning Commission to review the matter at the earliest convenient date.
