Subject: Consider Approval of Minor Modification No. 5 to
Development Plan No. 290 (Litton).
Background
On June 27, 1983, the County of Ventura Resource Management Agency
approved Development Plan 290 for the construction of a 134,000
square foot industrial building. A total of 4 Minor Modifications
have been approved for this site. These modifications include: 1)
construction of two air conditioning towers, 2) construction of a
patio cover and recreation area, 3) locating a temporary building
on the roof(fortesting of a laser) and, 4) removed a 600 sq. ft.
storage building to perform soils testing. In addition, on June 26,
1991, Industrial Planned Development 90-15 was approved by the City
for the construction of an additional building on the site,
totaling 176,000 sq.ft. This permit expired on June 26, 1992.
This Minor Modification request is to allow the installation of a
pre -fabricated 473 sq.ft. portable building to be used as a
chemical storage facility. The proposed site is located 170' south
of the main building, adjacent to Condor Drive and the existing
equipment storage and delivery areas. The building is 4115" long,
1115" wide, 818" in height and will be painted white to match the
existing building. A concrete access ramp (18 slope) will be
located on the east side of the building. The construction of the
building includes two hour fire walls and fire sprinklers. Fire
Prevention District regulations require the building to contain
adequate security measures, to be determined by the City. For
security and aesthetic reasons, a condition has been created which
will require the construction of a split -face block wall
surrounding the building.

At present, a number of trees screen the building site when viewed
from the north and east (Condor Drive) side. The City will require
that the applicant plant additional trees on the south and west
side of the chemical storage facility. This will screen the view
from the driveway on the south, and from the parking lot.
This Minor Modification request meets all applicable Zoning Code
requirements. This Minor Modification request has been conditioned
to require that:
1) The facility shall be painted the same color (white) as the
existing building.
2) Additional landscaping shall be planted on the south and
west side of the unit as required by the Director of Community
Development.
3) All appropriate agencies shall approve the building
prior approval of the Zone Clearance.
4) The building shall be secured with a six foot high
perimeter wall constructed of split -faced block. Creeping Fig
shall be planted on four foot centers surrounding the wall.
5) Approval of a Zone Clearance is required prior to
installation of the building.
6) Failure to inaugurate this Minor Modification in twelve
months or less from the date of approval will render this
Modification null and void.
This proposal has been reviewed by the Director of Community
Development who approved the application on May 5, 1995. This
matter is being presented to the Council as a courtesy. Should the
Council, or any other party, desire to appeal the Director's
decision, a hearing should be scheduled. The last day for an appeal
to be filed is May 22, 1995. The next available hearing date is
June 7, 1995. If the Council takes no action, the Director's
decision will become effective on May 23, 1995.

Approved by the Director on: May 5, 1995
For: Approval of DP 290 Mionor Modification No. 5, request to place
a 643 square foot portable chemical storage building at 6101
Condor Drive.
As shown on Exhibit "A". The land involved is Assessor's Parcel
No.: 513-0-060-26 in the M-1 zone.
Categorically exempt from CEQA requirements as a Class 11,
Exemption for Minor Alterations.
Ordinance Compliance: Based upon the information and findings
developed by staff, it has been determined that this application,
with the attached conditions, meets the requirements of Moorpark
Ordinance Code Section 8111-2.1.2 - Permit Standards in that;
a. The Minor Modification is consistent with the intent and
provisions of the City's General Plan and the Zoning
Ordinance;
b. The Minor Modification is compatible with the character of
surrounding development;
C. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses,
d. The Modification would not be detrimental to the public
interest, health, safety, convenience, or welfare; and
e. The conditionally permitted use is compatible with existing
and planned land uses in the general area where the
development is to be located.

Appeals: As stated in section 5111-5, within 16 calendar days
after the permit has been approved, conditionally approved or
denied, any aggrieved person may file an appeal of the approval,
conditional approval or denial with the Community Development
Department who shall set a hearing date before the Planning
Commission to review the matter at the earliest convenient date.
This Minor Modification request has been conditioned to require
that:
