SUBJECT: Consider Resolution Directing the Planning Commission to Hold a
Public Hearing, and Provide a Recommendation to the City Council
on Amendments to Title 17 (Zoning) of the Moorpark Municipal Code
Addressing Standards for Accessory Dwelling Units; Standards for
Residential Roof Replacements Adjacent to Arterial Roads; Allowed
Uses On Land Developed with Overhead Electrical Utilities; Short
Term Rentals; Marijuana; and Permit Approval Expiration, Time
Extensions and Discontinuance of Use, and Determining that this
Action is Not a Project Approval Subject to the California
Environmental Quality Act
BACKGROUND/DISCUSSION
Staff is proposing to prepare amendments to the Zoning Ordinance to address the
following items. These would require a public hearing and recommendation by the
Planning Commission prior to consideration by the City Council after holding a public
hearing.
1. Standards for Accessory Dwelling Units —Although the City Council adopted new
standards for accessory dwelling units in July of 2017, the State in its 2017
legislative session amended laws further restricting the ability of local agencies to
regulate these uses. Necessary changes are primarily related to allowing
accessory dwelling units with proposed homes instead of just existing homes,
and parking standards.
2. Standards for Residential Roof Replacements Adjacent to Arterial Roads — Much
of the residential development along arterial roads (as defined in the General
Plan) since incorporation has been with concrete or clay tile roofs. This roof
material is an important part of the streetscape on these roads. Staff is
recommending adding a provision to the Zoning Ordinance to require that any
replacement of tile roofs on homes adjacent to arterial roads be done with tile
roofs. This would help maintain the character of the streetscape on these roads.

3. Allowed Uses on Land Developed with Overhead Utility Lines — Staff
recommends that the Zoning Ordinance be reviewed to ensure the review
process and allowed uses in existing overhead utility corridors are consistent with
the purpose of the Zoning regulations to protect and promote the public health,
safety, and general welfare, to provide the environmental, economic, and social
advantages which result from an orderly, planned use of resources, to establish
the most beneficial and convenient relationships among land uses, and to
implement the city's general plan.
4. Short Term Rentals — Because of technology like Airbnb, a number of short term
rentals (less than 30-day lease) are being operated locally. These include room
rentals and whole house rentals. Short term room rentals fall within the existing
Bed and Breakfast Inn category and require a Conditional Use Permit. Short
term rentals of whole houses are not a residential use and are not permitted in
the residential code. Staff is proposing to update the Zoning Ordinance to
address these uses.
5. Marijuana — The State has had clean up legislation on its marijuana laws after
the passage of Proposition 64. Staff is recommending updating the Zoning
Ordinance to use the same terms used in State legislation.
6. Permit Approval Expiration, Time Extensions, and Discontinuance of Use — Staff
is proposing revisions to the Zoning Ordinance to improve clarity for permit
approval expiration, time extensions, and discontinuance of use.
ENVIRONMENTAL DETERMINATION
The action of the City Council at this time is not a "project approval" subject to the
California Environmental Quality Act as it is only seeking the recommendation of the
Planning Commission. The level of environmental review on such an ordinance will be
determined prior to Planning Commission recommendation.

RESOLUTION NO. 2018-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
MOORPARK, CALIFORNIA, DIRECTING THE PLANNING COMMISSION
TO HOLD A PUBLIC HEARING, AND PROVIDE A RECOMMENDATION
TO THE CITY COUNCIL ON AMENDING TITLE 17 (ZONING) OF THE
MOORPARK MUNICIPAL CODE ADDRESSING STANDARDS FOR
ACCESSORY DWELLING UNITS; STANDARDS FOR RESIDENTIAL
ROOF REPLACEMENTS ADJACENT TO ARTERIAL ROADS;
ALLOWED USES ON LAND DEVELOPED WITH OVERHEAD
ELECTRICAL UTILITIES; SHORT TERM RENTALS; MARIJUANA; AND
PERMIT APPROVAL EXPIRATION, TIME EXTENSIONS AND
DISCONTINUANCE OF USE, AND DETERMINING THAT THIS ACTION
IS NOT A PROJECT APPROVAL SUBJECT TO THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT
WHEREAS, Section 17.44.050 of the Municipal Code provides that the City
Council may initiate proceedings to consider amendments to the Zoning Ordinance by
the adoption of a resolution of intent; and
WHEREAS, the City Council wishes to initiate proceedings to consider
amendments to the Zoning Ordinance Amendment addressing standards for accessory
dwelling units; standards for residential roof replacements adjacent to arterial roads;
allowed uses on land developed with overhead electrical utilities; short term rentals;
marijuana; and permit approval expiration, time extensions and discontinuance of use;
and
WHEREAS, the Community Development Director has determined that the
initiation of proceedings for a Zoning Ordinance Amendment is not a project approval
subject to the California Environmental Quality Act.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. ENVIRONMENTAL DETERMINATION: The City Council concurs
with the determination of the Community Development Director that the initiation of
proceedings for a Zoning Ordinance Amendment is not a project approval subject to the
California Environmental Quality Act.
SECTION 2. INITIATION OF PROCEEDINGS: The City Council hereby
authorizes the initiation of proceedings to consider amendments to the Zoning
Ordinance addressing standards for accessory dwelling units; standards for residential
roof replacements adjacent to arterial roads; allowed uses on land developed with
overhead electrical utilities; short term rentals; marijuana; and permit approval
expiration, time extensions and discontinuance of use.

SECTION 3. DIRECTION TO PLANNING COMMISSION: The Planning
Commission is hereby directed to study, hold a public hearing, and provide a
recommendation to the City Council on this matter.
SECTION 4. CITY CLERK CERTIFICATION AND FILING: The City Clerk
shall certify to the adoption of this resolution and shall cause a certified resolution to be
filed in the book of original resolutions.
