Hare, City C1eik !r •r` DATE: May 30, 1995 (CC Meeting of 6/07/95) ITEM SUBJECT: CONSIDER REQUEST FOR WAIVER OF TEMPORARY USE PERMIT FEE FOR KIWANIS OF MOORPARK FOR PARKING LOT SALE. Discussion: The Kiwanis Club of Moorpark will be holding a parking lot sale at A - Z Self Storage on June 11, 1995 from 10:00 a.m. to 4:00 p.m. All proceeds from the parking lot sale will benefit youth programs some of which are co- sponsored with the City, such as Mardi Gras, Halloween Village and the Easter Eqg Hunt. Christine Hester, Sponsored Youth Chairperson for the Kiwanis Club, has contacted the City (see the attached letter) and requested that the $40.00 Temporary Use Permit Fee be waived. At its March 1, 1995 City Council meeting, the Council considered a request from the Community Christian Church for a waiver of the Temporary Use Permit Fee for their rummage sale. At that time, the City Attorney explained that in granting waivers of City fees, a distinction can be made between groups which are community based and groups which are not. The City Manager suggested that the Council might want to direct staff to write a policy establishing the City's procedure in waiving fees. He said the Council could possibly exempt the first event of each community based group each year. The Council's action at the March 1 meeting was to direct staff to establish a fee waiver policy for Council review. Although this policy has not yet been drafted, it would appear that the waiver of the fee for the Kiwanis Club as a community based group would be in line with the previous action takers by the Council. Staff Recommendation: Waive the Temporary Use Permit Fee for the Kiwanis of Moorpark for their parking lot sale to be held Tune 11, 1995. Attachments: 1. " �" '' Nip � MINUTES OF THE CITY COUNCIL Moorpark, California March 1, 1995 A Special Meeting of the City Council of the City of Moorpark was held on March 1, 1995 in the Conference Room of said City located at 799 Moorpark Avenue, Moorpark California. 1. CALL TO ORDER: Mayor Lawrason called the meeting to order at 6:35 p.m. 2. ROLL CALL: Present: Councilmembers Montgomery, Perez, Wozniak and Mayor Lawrason. Absent: Councilmember Hunter was absent due to his attendance at a funeral of a close friend. Staff Present: Steven Kueny, City Manager; Richard Hare, Deputy City Manager; Cheryl Kane, City Attorney; and Lillian Hare, City Clerk 3. PUBLIC COMMENT: None. 4. ACTION /DISCUSSION: A. Consider Reauest for Waiver of Temporary Use Permit Fee for Community Christian Church Rummage Sale of March 4 1995. Staff Recommendation: Direct staff as deemed appropriate. Mr. Kueny recapped that on February 23 the City received a request from the Community Christian Church to waive the $40 application fee for their rummage sale. This purpose is to raise money for youth to go on a mission trip to Mexico over their Spring Break to build houses for those that have littte or no place,, to live. Ms. Kane explained that in granting waivers of City fees a distinction can be made between groups which are community based and groups which are not. '?0;25 Minutes of the City Council Moorpark, California Page 2 0 March 1, 1995 MOTION: Councilmember Montgomery moved and Councilmember Wozniak seconded a motion to waive the temporary use permit fee for the Community Christian Church rummage sale to be held March 4, 1994 as a community based, tax exempt organization; this action not to be precedent setting and staff is directed to establish a policy for Council review to set up the procedures which the City could use in granting waivers of fees. Th motion carried by 4 -0 voice vote, Councilmember Hunter abs�t for the vote.
