SUBJECT: Consider Resolution to adopt stipulate "approving
authority" for entitlements
Background
The City Council adopted Resolution 88 -523 on 11/29/88. The purpose
of the resolution was to create a set of permit approval processing
standards. Among other things, the resolution states that a "Major
Modification" is to be acted upon; by the body which granted the
original approval. Planning staff ~ias followed this mandate since
the resolution's inception, except in the case of the Urban West
proposal entitled Major Modificatior No. 1 to TR4637 and RPD 89 -4.
In the case of this modification, the Cit °/ Council felt that the
project should be reviewed by the Clanning Commission prior to the
Council's review. The Council was (.:,c::)gni.zant of the fact that it had
been over 4 years since the or -ginai project. had been reviewed by
the Planning Commission and approvec:l by the Council. By stipulating
that the Planning Commission i- evi.e.w the �)roject, the processing
time was extended, however, the fin a'[ Marc, j e'ct, as approved, appears

Staff believes that this change in 1.:)iocedure worked for the benefit
of the project, the citizens and th.F CLty. 1Itaff therefore proposes
that Resolution No. 88 -523 be amended t:o reflect this change in
policy. The Resolution is also no i.onger synchronous to the Zoning
Code on various issues. The Zoriinq Code has gone through a myriad
of changes since 1.988, The Resc>Lut ..c ,n as sr, contains syntax errors

Staff has amended the resolution using the "legislative amendment
format" so that the Council can rE- acj.ily see the changes which are
proposed.
Recommendation:

A RESOLUTION OF THE CITY OUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DIRECTING THAT iFRTAIN PERMIT APPROVAL PROCESSES BE
PREFORMED BY CERTAIN CITY 0! "FICIALS; AND THE REPEALING OF
RESOLUTION NO. 86 -276.
Whereas Resolution No. 86 -2'� prescribes the city offices that
approves various permits; and
Whereas, the City Council a< wg�.i.l as the staff have recommended
changes to said approval authority;
NOW, THEREFORE, THE CITY - Ot1NCII OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
Section 1. Resolution No. 8+- -176, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA PRESCRIBE THAT CERTAIN PERMIT APPROVAL PROCESS BE
PREFORMED BY CERTAIN CITY OFFICIALS AND THE REPEALING OF ALL
RESOLUTIONS IN CONFLICT THEREWITH..
adopted February 18, 1986 is hereby rescL.ncled.
Section 2. Where the Planning Commission is authorized to
approve or disapprove an entitlement herein, such decision is appealable to
the City Council. Where the Director of Community Development is
authorized to approve or disapprove at, - ititlement and subsequently to the
City Council.
Section 3. A request for a Modification to an entitlement
herein shall be deemed a "Minor Moditi.cation ", as determined by the
Director of Community Development, wher, <.uch a modification does not alter
the intent of the determining body. ) ether modifications are deemed
"Major Modifications ".
Section 4. Major Modifications shall be approved or
disapproved by the official of body granting the original approval or an
appeal thereof, and shall be processed i1i th,2 same manner as the original
approval.
Section 5. Where the City Council LS the body with approving
or disapproving authority, the action hill first be processed through the
Planning Commission for its recommendato3:.
Section 6. Approval of di approval shall be performed by the
following City offices of Officials:

floor area.
g. Industrial Planned Development Permits - Planning

20,000 square feet of gross floor area for all

20,000 square feet or more of gross floor area for
all buildings pit vr)lved.
All new construction, regardless of gross floor
area size that is within three hundred feet (300')
of a resident:.al zone )r use shall require City

ESTABLISHING CERTAIN PERMIT APPROVAL PROCESSES
TO BE PERFORMED BY CERTAIN CITY OFFICIALS;
AND THE REPEALING OF RE „SOLUTION NO. 88 -523
Whereas Resolution No. 88 -52- ;:D- rescrLbes the city officials

Whereas, the City Council as well as the staff have
recommended changes to said appro-il authcrity;
NOW, THEREFORE, THE CITY CO'.IN,. L :�F THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOW
Section 1. Resolution No ?8523 is hereby rescinded.
Section 2. Major Modifi;_at ions shall be approved or
disapproved by the approving aw..Iority granting the original

by the Zoning Code
Section 3. Where a City 'ounc:i approved entitlement has
not been inaugurated in two years r_, more, and a Major Modification

entitlement or any extension theret:.c,, the Modification shall first
be reviewed by the Planning C-C)mPI:issio1, who shall forward a
recommendation to t:he City Counc:_i. i -i -he Manner stipulated by the
Zoning Code.

authority, the Planning CommissiDn shall first review the
application and shall make appropriate recommendations to the City
