Administrative Services Managers / July 1 I , 1995 (CC Mtg, 07/19195) Consider Bid Solicitations for Play E(lulpment at Mountain Meadows Park CL_ i Staff is presenting the draft bid solicitation and specifications for the installation of playground equipment at Mountain Meadows Park for the Council's consideration. This equipment is proposed to be purchased by the Community Development Block Grant ( "CDBG ") as part of the removal of architectural barriers at this park. BACKGROUND During the annual CDBG hearing in March of this year, the Council appropriated $25,300 of surplus monies from the First Street Improvement project for the removal of architectural barriers at Mountain Meadows Park. It was described to the Council that removing architectural barriers to persons with limited mobility and replacing these barriers with facilities that provide access to these same persons, is an eligible use of CDBG monies. It was also described to the Council that the project would be completed in three steps: I) staff to remove the existing barriers; 2) a qualified company will purchase and install new equipment and related safety surface materials at the park, and; 3) if sufficient funds remained, a sidewalk of approximately fifteen feet in length will be completed between the existing sidewalk adjacent to Mountain Meadows Drive and the play area. DISCUSSION Staff has been working on this project since April, 1995, by completing the needed revisions to the HUD grant application and the required environmental work, and presenting the proposed project to the Parks and Recreation Commission for consideration. The grant changes and environmental approval were received two weeks ago. Attachment "A" is staffs report to the Parks and Recreation Commission which became the design specifications for the equipment in the bid document provided as "Attachment "B ", (Attachment "B" is available on the Council's desk for consideration). The Commission specifically reviewed equipment and safety surfaces designed by one manufacturer for each, however, the bid specifications will present a more general description of the materials needed. Staff anticipates that the more general description will open the bid process 00005 to the satisfaction of the federal procurement provisions, as well as provide the City with more options to select from when making the final selection. This project is somewhat unique however, because new existing equipment is in place and will not be removed, which narrows the project and the specifications close to being a "sole source" selection, (if the new and existing equipment are to match). Nonetheless, HUD prefers that "sole source" be determined by the open bid process, rather than by staffs interpretation of needs Staff has confirmed with the County that two significant CDBG regulations apply to this project. The first is the open bidding/procurement policy and the second is enforcement of the federal prevailing wages. The attached bid document allows for the proper bid solicitation process, includes the special federal provisions, and the most current prevailing wage document.. The bid document only addresses the procurement and installation of the playground equipment and the safety surface. As proposed, CDBG will reimburse the City directly for its actual expenses to complete the removal of the barriers and installation of sidewalks. Federal prevailing wage requirements (Davis Bacon) and the procurement provisions are not applicable to in -house work at this funding level. The Davis Bacon requirements do apply to the installation of the equipment. However, this work will last less than one week. Staff does not expect there to be sub - contractors or other related complications that can make the Davis Bacon requirement cumbersome The enforcement of these provisions will be minimal. The bid closing date is August 2 t, 1995, Depending on how much lead time is needed to receive the specified equipment, the project could be completed by late September, or the first week in October •: • That the City Council authorize bid solicitation for the Mountain Meadows playground equipment and the City Manager to contract for installation to the lowest responsible bidder.
