From: Jaime Aguilera, Director of Community Development/ Prepared by Craig Malin, Assistant Planner Date: July 7 , 1995 (City Council meeting July 19 , 1995) Subject: Consider Approval of Minor Modification No. 2 to Planned Development Permit No. 1059 (Chevron) . Background On January 19, 1987 , the Planning Commission of the City of Moorpark adopted Resolution PC 87-129 approving the construction of a service station. One Minor Modification was approved in 1989 for the installation of a soil vapor filter. Discussion On May 18 , 1995 , Chevron filed Minor Modification No. 2 and is making the following requests: (Note: sign descriptions and locations are included on the site plan and sign plan) 1) Replace the existing monument signs. At present there are two monument signs , one in the planter facing New Los Angeles Avenue and one in the planter facing Spring Road. These signs measure 7'8" and 8 ' in height by 12 ' in width. Both signs are proposed to be replaced with new signs measuring 8'1" x 10. ' One sign will be placed on Spring Road and one sign will be relocated from the planter on New Los Angeles Avenue to the planter on the corner of Spring Rd. and Los Angeles Ave. This request has been approved, however, each sign must meet the maximum sign size specified by the code, 5' height and 6' width maximum. 2) Reduce the width of the planter on New Los Angeles Avenue from 18' to 7' in width. Approval of this request is not necessary to improve vehicular movements and will result in a reduction in the amount of landscaping. Staff has not approved this request. 1 4.010073 3) Install one Chevron logo on the canopy (sign type No. 2). Staff has approved this request. 4) Install two new canopy signs (sign type No. 3). Staff has approved the installation of one sign, not two. 5) Install one business appreciation sign in the planter on New Los Angeles Ave. (sign type No. 4). 6) Install two business appreciation placards on the pump islands (sign type No. 5) 7) Install four self service signs on the pump islands (sign type No. 6). 8) Install four Chevron logo decals on the pump islands (sign type No. 7). 9) Install one disabled parking sign. 10) Replace guard posts for the large Pecan tree, propane tanks, air /water dispenser, pump islands and building. 11) Replace canopy lights. The illumination level will not be affected. 12) Install new concrete drive slab (around the pump islands). 13) Install new concrete tank slab (over the storage tanks). 14) Repair brick planter box around the Pecan tree. 15) Install new Veeder -Root TLS 350 leak detection system for gasoline storage tanks. 16) Sealcoat the paved asphalt area. 17) Extend the pump islands (towards the center) to accommodate new trash dispensers.. 18) Install A.T.M. point of sale equipment on the pump islands. 19) Install new gasoline storage tank lines. Note: sign types 8 (24 hour decal), 9 (food mart decal), 10 ( enter only) , 11 ( exit only) and 12 ( right turn only) as noted on the plans are existing and will not be modified. 2 000074 Staff Decision This Minor Modification request meets all applicable Zoning Code requirements. This Minor Modification request has been conditioned as follows: 1) A Sign Permit must be approved before any signs can be installed or replaced. 2) A Zoning Clearance must be approved before any modifi- cations, including landscaping, can be installed. 3) Additional landscaping shall be planted on the eastern property line to include but not limited to an additional five trees (36" box). This landscaping shall be approved by the Director of Community Development prior to approval of the Zoning Clearance. 4) No modifications shall be made to the landscaping on the southern property line except. for routine maintenance. 5) Failure to inaugurate this Minor Modification in twelve months or less from the datE of approval will render this Modification null. and void. 6) Applicant must submit a lighting plan from a licensed lighting engineer for approval by the Director of Community Development. 7) Request No. 1 is approved. Maximum size of monument signs is 5' height, 6 width.' 8) Request No. 2 (planter reduction) is denied. 9) Request No. 4 (canopy sign is approved for only one sign. 10) Request. No. 5 (customer appreciation sign) is denied. 11) Request No. 6 (customer appreciation sign) is denied. This proposal has been reviewed by the Director of Community Development who conditionally approved the application on July 7, 1995. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, a hearing should be scheduled. The last day for an appeal to be filed is July 24, 1995. The next available hearing date is August 2, 1995, 1995. If the Council takes no action, the Director's decision will become effective on July 24, 1995, 1995. K t 715 Receive and File the Report. CEQA: The project is Categorically Exempt from CEQA requirements as a Class 1, Exemption for Minor Alterations. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 17.44.030 Permit Standards, in that; a. The Minor Modification is �::onsistent with the intent and provisions of the City's 'General Plan and the Zoning ordinance; O i b. The Minor Modification is compatible with the character of surrounding development; C. The proposed Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring property or uses; d. The Modification would not be detrimental to the public interest, health, safety, convenience, or welfare; and e. The conditionally permitted use is compatible with existing and planned land uses in the general area where the development is to be located. Appeals: As stated in Section 17.44.090, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval, conditional approval or denial with the Community Development Department who shall set a hearing date before the Planning Commission to review the matter at the earliest convenient date.
