Subject: Consider Approval of Minor Modification No. 10 to
Planned Development Permit No. 980 (Carlson) .
Background
On January 18 , 1984 , the County of Ventura Resource Management
Agency approved Resolution No. 84-63 , approving Planned Development
Permit 980 for the construction of a 125,113 square foot commercial
center. A total of 9 Minor Modifications have been approved for
this site. These modifications include: 1) modify storefront
designs, 2) redesign the parking lot, 3) redesign building J, 4)
enclose the bank lobby, 5) add a satellite dish to Thrifty's, 6)
modify the elevation of Clothestime, 7) add water vending machines
at Hugh's Market and outdoor seating in front of Flamingo's Yogurt,
8) modify the landscape planter design in front of Hughes and the
shopping cart storage areas, and 9) modify the sign program to
allow a 24' pylon sign. Part of this modification included
approval of a revised sign program allowing additional colors and
lettering styles. One condition of the revised sign program was
that all existing bronze wall signs were to be replaced within one
year of approval.
Discussion
This Minor Modification request is to modify the Landscape Plan and
the Sign Program (adopted with Minor Mod. No. 9) . This Minor
Modification request consists of three parts:
1 ) Modify the approved Landscape Plan. On September 22, 1994 a
field inspection of the site was conducted to determine if the
existing number of trees complied with the Landscape Plan approved
with the original permit. A total of 69 trees depicted on the
approved landscape plan did not exist on the site. The location of
these trees is shown on Attachment "A. " Almost all of these trees
were depicted on the plan but never installed when the center was
built.

The applicant proposes to remove 52 trees from the site, which will
be replaced with 73 trees. The trees to be removed are Eucalyptus
and Melaleuca. These trees are proposed to be removed due to their
potential damage their roots can cause to curbs and because of
their deteriorated appearance. These trees will be replaced with an
additional 73 trees, increasing the total number of trees from 199
to 220. These replacement trees and the landscape plan have been
approved by the City's Landscape Architect.
Staff Analysis: Although the original total of 69 missing trees is
not being met, this increase of 21 trees (of improved quality) in
the planters and parking area is deemed by staff to provide a
significant enough increase to iustify a modification of the
Landscape Plan.
2) Removal of the existing planters in front of buildings A, B, C,
E and G (the main building not including portions of Thrifty Drug
and Hughes). These planters will be replaced with additional new
but smaller, planters. In addition, concrete and brick decorative
paving will be provided where the planters were removed, including
in front of Thrifty Drug and Hughes.
Staff Analysis: Although the total landscaped area in the planters
will decrease, additional 15 gallon trees will be installed.
Pedestrian access will be improved because many of the existing
planters extend to within 2' to the curb..
3) Modify the sign program to allow the bronze signs to remain. The
original sign program (approved in PD 980) required all signs to be
bronze or ivory. Minor Modification No. 9 included a revision to
the sign program, part of which was to expand the range of allowed
colors to blue or red, with green, orange, white and yellow as
secondary colors. A provision of the approved Sign Program required
all bronze signs to be removed by April 6, 1995. The applicant is
requesting that the Sign Program be modified to eliminate the
condition requiring removal of bronze signs, thereby allowing
bronze as one of the permitted color choices.
Staff Analysis: Use of the bronze signs is not as visually
attractive as the other color choices, and will not be compatible
with the other signs. At present approximately one half of the
existing signs are bronze. However, the number of bronze signs will
decrease when signs are replaced or when signs for new tenants are
erected.
This Minor Modification request meets all. applicable Zoning Code
requirements. Staff recommends approval of this Minor Modification
request with the following conditions:
1) All new or replaced signs must be a color which is part of
the approved sign program. All. existing bronze signs must be

removed and replaced with conforming colors within four years
from the date of this approval.
2) All landscaping changes, removals, or additions must be
inspected by the City within 30 days weeks of installation.
Any modifications required by the City must be made within 30
days of notification.
3) Failure to inaugurate this Minor Modification in twelve
months or less from the date of approval will render this
Modification null and void. Should this occur, the landscaping
must be improved to meet the original Landscape Plan
requirements within 180 days
Due to the previous Council directive requiring a one year
abatement period for the bronze signs (Minor Modification No. 9),
the Director felt that the project would be better served if he
deferred action on this Minor Modification to the City Council.

Proposed site improvements for the Moorpark Town Center consists of
three components:
1. Hardscape remodel
2. Additional tree planting
3. Parking lot tree replacement
HARDSCAPE RMEDEL includes the removal of existing raised planters
in front of buildings A, E, & G. New paving at these areas include
concrete and brick bands to match existing paving and the
installation of small planters placed at the corners of the
building canopy. These modifications improve pedestrian access by
removing obstacles from the front of the entries as well as
visually improving the buildings appearance with added 15 .gallon
small trees.
ADDITIONAL TREE PLANTING is proposed throughout the center. 32
trees are schedules to be planted to fill in areas that will
enhance the overall appearance of the center. Eucalyptus
citriodora are proposed at the two entrances off L.A. Avenue, which
is consistent with the original design concept to identify these
entrances with tall, graceful trees. Evergreen canopy trees,
Cupaniopsi.s, are scheduled along L.A. Avenue and Moorpark Road to
fill in voids and complete this canopy tree -line look. Two
flowering Crepe Myrtles are scheduled to be planted in the existing
planters in front of the Post Office and 8 small canopy trees
(Raphiolepis standards) are proposed in front of the building
canopy.
PARKING LOT TREE REPLA FMFNT is scheduled in two phases. The two
tree species scheduled for removal and replacement are Eucalyptus
and Melaleuca. The existing Melaleuca is being removed because of
their potential to lift curbs and their "brown and dirty"
appearance. The Eucalyptus because of their erratic growth habit,
potential for breakage and unsightly appearance. The existing
Cupaniopsis and Elms are to remain. The selected replacement tree
is Liquidambar styraciflua "Palo Alto ", a deciduous tree, with red
fall color. This species is already doing well at the Town Center.
The replacement trees will be placed near the center of the planter
island, to allow the development of normal buttress roots.
The above scheduled improvements will greatly improve the visual
appearance of the Town Center, solve some pedestrian circulation
problems, and reduce future risk of curb damage.

SIGN CRITERIA

Definition of Terms
1. End Unit - A building with two primary elevations, usually located at the end of a
row of shops. The Director of Community Development shall determine which
shops meet this criteria.
2. Logo - A sign which depicts a local, regional, or national symbol, word, or design
used by a manufacturer or dealer to distinguish their products from those of their
competitors. The trademark is required o be registered and protected by law.
3. Freestanding (Out Parcel) Tenant - A tenant occupying lease space in a
freestanding building on a pad separate nd apart from major and other in -line
tenants.
4. Major Tenant - A tenant occupying lease space equal to or greater than 6,000
square feet.
5. Minor Tenant - A tenant occupying lease space equal to or less than 5,999 square
feet.
6. Monument Sign - A free standing sign, other than a pylon sign, no taller than five
(5) feet in height.
7. Painted Sign - Signs painted directly on i lhe. exterior surface of a building or
structure.
8. Primary Sign - Consists of the name of the Company, Corporation, Business or
Organization doing business at this location.
9. Pylon Sign - A free standing sign, the supports or uprights and structure of which
have received architectural enhancemei i
10. Secondary Sign - Consists of name of specialized department or services being
conducted within a Company, Corporation. Business or Organization doing
business at this location.

11. Sign - Any device or part thereof capable of visual communication or attraction
including any announcement, declaration, association, corporation, institution,
organization, product, service, event, location or other business entity by any
means, including words, letters, figures, design, symbols, fixtures, colors,
illumination or projected images. "Sign" shall not include any official notice,
directional, warning, or information signs or structures issued by any federal, state,
county or municipal authority.
12. Sign Maintenance - The repairs of faded, broken or electrical components of a
sign.
13. Trademark - A sign which depicts a local., regional, or national symbol, word, or
design used by a manufacturer or dealer to distinguish their products from those
of their competitors. The trademark is required to be registered and protected by
law.
14. Wall Signs - Signs which are in any manner affixed to any exterior wall of a
building or structure, the exposed face of which is in a plane parallel to the plane
of the wall and which projects a maximum of eight inches for major tenants and a
maximum of five inches for out parcels and minor tenants from the building or
structure wall.
15. Window Signs - Signs painted, attached, glued or otherwise affixed to a window or
otherwise easily visible from the exterior of the building.
General Requirements
Purpose: The purpose of the following criteria is to establish a coordinated sign
program that gives each tenant adequat(_� identification, while achieving a unified,
attractive appearance among all lease slxices. In order to maintain the inteurity of
the criteria and equity among all tenants, devia ions trom the criteria will not be approved.
2. Existing Signs: Upon enactment of this �,riteria, all existing signs which do not
meet this programs criteria at this center shall be considered legal non - conforming
signs and shall be allowed to be maintained (see Sign Maintenance, definitions)
until tenant vacates lease space.
3. Exceptions: All exceptions to these criteria must be approved by the landlord and
City of Moorpark Director of Community Development; a Minor Modification
may be requested. as determined by the Director of Community Development.

4. Landlord Approval: Prior to sign fabrication, the tenant shall submit three (3)
copies of drawings of the proposed signs to the landlord for approval. Such
drawings must include all of the items listed below under City Approval and
Permits" and shall be stamped by the landlord for submittal to the City of
Moorpark Department of Community Dtwelopmenl.
S. City Approval and Permits: When approved by the landlord, the tenant shall
secure a sign permit from the City of Moorpark Department of Community
Development by submitting three (3) copies fully dimensioned scaled drawings
which shall include the following-
a. A site plan showing the location ()l the lease span: on the site.
b. An elevation of the lease space drawn +( scale and showing sign placement and lease
space width.
C. A detailed elevation of the sign drawn w scale and showing all colors, materials,
dimensions and copv.
d. Fabrication and installation details, including structural and engineering data, U.L
electrical specification, and type and intensity of illumination (for electrical signs).
C- Any other drawings, details and information as required by City.
6. Colors: All signs shall be either red ( #2`193), blue ( #2051), bronze ( #2412) and
may include White, Yellow ( #2037), Green ( #2030). All bronze signs shall be
removed within the center by April 6, I195.
7. Cost of permits: All permits for signs and the installation thereof shall be
obtained and paid for the by the tenaw of his contractor.
8. Compliance with Code: All signs and it e installation thereof shall comply with all
local zoning, building and electrica ow, s

2. Main Business ID Sign: The main business identification sign shall be centered
on the building fascia, both vertically and horizontally, above the lease space.
With the approval of the City of Moorpark Department of Community
Development and the landlord, existing tenants may replace or upgrade signage in
accordance with this criteria. New tenants shall conform to this criteria in determining size and
area of new signs.
3. Delivery Entrance Sign: If applicable, the tenant may attach a sign consisting of
2" high Helvetica medium letters, identifying the business name and address on a
non - customer delivery entrance. The location of this sign will be subject to
landlord and Department of Community Development approval and shall not
exceed two (2) square feet in area.
4. Window Sign: Business information, hours, credit cards accepted, shall be placed
on the window to the right of the entrance, 6" to the right of the mullion, within a
one square foot area. Ivory vinyl lettering; in Helvelica medium shall be used, see
below. The sign shall not exceed 4 square feet.

One sign is allowed per building frontage /elevation, with the maximum of two (2) signs
per building frontage /elevation. The sign type, size, height, materials, and logos shall be
as specified in this sign program for minor or major tenants whichever is applicable.
Center Identification LRylon Sign (Exhibit A)
A maximum of one Pylon Sign shall be installed for the entire center, at locations
approved by the City Council.

Construction Requirements
1. Fasteners: All exterior signs. bolts, fastenings and clips shall be enameling iron
with porcelain enamel finish, stainless steel, aluminum, brass or bronze. No iron
of any type other rust prone materials i ) , any type will be permitted.
2. Sealing of Openings: All penetrations of the building structure required for sign
installation shall be neatly sealed in a �k,�ter tight condition.

3. Labels: A "U.L." label must be placed on every separate electrical sign element
(i.e.: every sign cabinet or channel letter). All required labels must be placed in a
conspicuous location. No other labels arc allowed.
4. Exposed lamps or tubing will not be permitted.
S. Concealment of Mechanical Equipment: Raceways, crossovers, conductors,
transformers and other equipment shall be concealed.
6. Repair of Damages: The tenant is responsible for assuring that the sign
contractor repairs (in a good and workman like manner) any damage caused by
the contractor's work within two (2) day,, after such damage is caused.
7. Responsibility for Work: The tenant shall be fully responsible for the work of its
sign contractors.
H. Cost of Electricity: Electrical service to all signs shall be on the tenant's meters and
shall be part of the tenant's operational cosc�.
9. Removal of Signs: Tenant shall remove sign within 30 days of vacating premises
and shall repair any damage therefrom, or shall be responsible for any costs
incurred to remove such signs. All existing bronze signs shall be removed by April
6, 1995; no new bronze signs shall be approved for installation within the center.
Prohibited Signage
Flashing Signs: Animated, flashing or audible signs will not be permitted.
2. Lettering painted directly on a building surtace will not be permitted.
3. Projections above ur below the designated sign areti or above the roof line will
not be permitted.

All Companies Bidding To Manufacture
1. Landlord Requirements: Consult the Landlord's attachment for any additional
sign requirements.
2. Inspection: Prior to acceptance and final payment, each sign will be inspected for
conformance to these criteria. Signs installed without such approval are subject to
removal at the tenant's expense. Signs installed in violation of this criteria will be
fined in accordance with Article 10 of the zoning ordinance.
No Assurances
The tenant acknowledges that the landlord gives no assurances that a sign
approved by the landlord, which is in accordance with the provision of these
criteria, will be acceptable to the City of 'Moorpark.
Other City Requirements
Any signs, banners, logos, advertisements not specifically discussed within this sign criteria
shall be subject to the sign requirements of Article 10 of the City of Moorpark Zoning
Ordinance, or as amended from time to time. All signs submitted to the City of
Moorpark, Department of Community Development, will be stamped and signed off by
the landlord.

For: This Minor Modification request is to modify the Landscape
Plan and the Sign Program. This Minor Modification consists of
the following three requests:
1) Modify the approved Landscape Plan. The applicant proposes
to remove 52 trees from the site, which will be replaced with
73 trees. The trees to be removed are Eucalyptus and
Melaleuca. These trees are proposed to be removed due to their
potential damage their roots can cause to curbs and because of
their deteriorated appearance. These trees will be replaced
with an additional 73 trees, increasing the total number of
trees from 199 to 220. These replacement trees and the
landscape plan have been approved by the City's Landscape
Architect.
2) Removal of the existing planters in front of buildings A,
B, C, E and G (the main building not including portions of
Thrifty Drug and Hughes) . These planters will be replaced with
additional new but smaller, planters. In addition, concrete
and brick decorative paving will be provided where the
planters were removed, including in front of Thrifty Drug and
Hughes.
3) Modify the sign program to allow the bronze signs to
remain. The original sign program (approved in PD 980)
required all signs to be bronze or ivory. Minor Modification
No. 9 included a revision to the sign program, part of which
was to expand the range of allowed colors to blue or red, with
green, orange, white and yellow as secondary colors. A
provision of the approved Sign Program required all bronze
signs to be removed by April 6, 1995. The applicant is
requesting that the Sign Program be modified to eliminate the
condition requiring removal of bronze signs, thereby allowing
bronze as one of the permitted color choices.

Parcel No's: 511 -0- 080 - 38/39/40/41
CEOA; Categorically exempt from CEQA requirements as a Class 1,
Exemption for Minor Alterations.
Ordinance compliance: Based upon the information and findings
developed by staff, it has been determined that this application,
with the attached conditions, meets the requirements of Moorpark
Ordinance Code Section 17.44.030 - Permit Standards, in that;
a. The Minor Modification is consistent with the intent and
provisions of the City's general Plan and the Zoning
Ordinance;
b. The Minor Modification is compatible with the character of
surrounding development;
C. The proposed Minor Modification would not be obnoxious or
harmful, or impair the utility of neighboring property or
uses;
d. The Modification would not be detrimental to the public
interest, health, safety, convenience,, or welfare; and
e. The conditionally permitted use is compatible with existing
and planned land uses in the general area where the
development is to be located.
Appeals: As stated in Section 17.44.090, within 16 calendar days
after the permit has been approved, conditionally approved or
denied, any aggrieved person may f=ile an appeal of the approval,
conditional approval or denial with the Community Development
Department who shall set a hearing date before the City Council to
review the matter at the earliest convenient date.
This Minor Modification request teas been conditioned to require
that:
1) All new or replaced signs must be a color which is part of
the approved sign program. All existing bronze signs must be
removed and replaced with a sign in a conforming color within
four years from the date of this approval.
2) All landscaping changes, removals, or additions must be
inspected by the City within 30 days following installation.
Any further modifications required by the City must be made
within 30 days of notification
3) Failure to inaugurate this Minor Modification in twelve
months or less from the date of approval will render this
Modification null and void. Should this occur, the landscaping
